Article 9(3) of the Constitution1 states that “Where a person is arrested, he … shall be allowed to consult and be defended by a legal practitioner of his choice.” However, art 9(3) does not stipulate the point in time at which an arrested person is entitled to consult counsel. The local jurisprudence over the past few decades have affirmed the interpretation that an arrested person is not entitled to access counsel immediately upon arrest, but only after a reasonable amount of time has elapsed. The High Court in James Raj s/o Arokiasamy v Public Prosecutor (“James Raj”) has now shed …

Redressing The Patent Imbalance In Genetic Testing, Cheng Lim Saw
Research Collection Yong Pung How School Of Law
In one of the most highly anticipated decisions emanating from the apex Court in the US in recent times, the US Supreme Court in Association for Molecular Pathology v Myriad Genetics Inc was asked to consider, in the main, the patentability of a naturally occurring gene sequence which had been specifically isolated from the human genome. Although the patent was eventually denied, this seminal case will certainly not be the last word on what is clearly a very controversial subject, at least outside of the US.

The goals of all ASEAN member states are to “accelerate economic growth, social progress and cultural development” and “promote peace and stability” in the region. To achieve these goals, the public will need to trust and respect the Judiciary. Such trust and respect can be lost if there are inefficient practices that result in delay in the courts. The Singapore Judiciary is presently lauded for “its efficiency, its technological sophistication, its accessibility and the confidence of Singapore’s citizens and businesses in the system.” The World Economic Forum has also ranked Singapore first (out of 142 countries) in recognition of Singapore’s …

Adapting To Change: The State Of Singapore Private Enterprise In China, Wilfred How, Caroline Yeoh
Research Collection Lee Kong Chian School Of Business
One of the most affluent and developed nations in its region, the city-state of Singapore relies largely on tapping global resources for economic growth, to ameliorate its tiny land area and accompanying lack of natural resources. Its current prominence is to a great degree owing to an early recognition of the need for such, and a well-documented stratagem of expanding its foreign direct investments (FDIs) as a means to stimulate economic development (Huff, 1995; Murray and Pereira, 1995) and strengthen the city-state’s ‘external economy’ - one which saw the island progress through a number of distinct phases of overseas investment …
Financial Development, International Capital Flows, And Aggregate Output, Jurgen Von Hagen, Haiping Zhang
Financial Development, International Capital Flows, And Aggregate Output, Jurgen Von Hagen, Haiping Zhang
Research Collection School Of Economics
We develop a tractable two-country overlapping-generations model and show that cross-country differences in financial development can explain three recent empirical patterns of international capital flows: Financial capital flows from relatively poor to relatively rich countries, while foreign direct investment flows in the opposite direction; net capital flows go from poor to rich countries; despite its negative net international investment positions, the United States receives a positive net investment income. International capital mobility affects output in each country directly through the size of domestic investment and indirectly through the aggregate saving rate. Under certain conditions, the indirect effect may dominate the …
Nonparametric Testing For Anomaly Effects In Empirical Asset Pricing Models, Sainan Jin, Liangjun Su, Yonghui Zhang
Nonparametric Testing For Anomaly Effects In Empirical Asset Pricing Models, Sainan Jin, Liangjun Su, Yonghui Zhang
Research Collection School Of Economics
In this paper we propose a class of nonparametric tests for anomaly effects in empirical asset pricing models in the framework of nonparametric panel data models with interactive fixed effects. Our approach has two prominent features: one is the adoption of nonparametric component to capture the anomaly effects of some asset-specific characteristics, and the other is the flexible treatment of both observed/constructed and unobserved common factors. By estimating the unknown factors, betas, and nonparametric function simultaneously, our setup is robust to misspecification of functional form and common factors and avoids the well-known “error-in-variable” (EIV) problem associated with the commonly used …

Duplicate record, see https://ink.library.smu.edu.sg/lkcsb_research/3631/. The current research explored whether perspective-taking increases willingness to engage in contact with stereotyped outgroup members. Across three studies, we find that perspective-taking increases willingness to engage in contact with negatively-stereotyped targets. In Study 1, perspective-takers sat closer to, whereas stereotype suppressors sat further from, a hooligan compared to control participants. In Study 2, individual differences in perspective-taking tendencies predicted individuals’ willingness to engage in contact with a hooligan, having effects above and beyond those of empathic concern. Finally, Study 3 demonstrated that perspective-taking’s effects on intergroup contact extend to the target’s group (i.e., another …
Informal Banking And Early International Entrepreneurs: The Case Of The Chettiars, Jayarani Tan, Wee Liang Tan
Informal Banking And Early International Entrepreneurs: The Case Of The Chettiars, Jayarani Tan, Wee Liang Tan
Research Collection Lee Kong Chian School Of Business
As moneylenders during nineteenth century colonial period the Chettiars were functioned as informal bankers in Asia. They began as communal entrepreneurs in their clan but grew beyond their domestic borders. Despite their smallness and resources, they were able to internationalize. This paper reports a study into their internationalization examining the manner they were able to successfully venture abroad. We found that external factors like the British protectorate and internal factors like their unique socio-cultural institutions and norms and values served as enabling factors for their internationalization. These include a family culture of training the sons for the business, embracing business …

How Jamini Roy Found A Home In Baker Street, Nirmalya Kumar
Research Collection Lee Kong Chian School Of Business
Jamini Roy is considered the father of Indian modern art as he attempted to use his paintings to find cultural independence from Western notions of art grafted by the British on its colonies. This quest was taking place alongside the India's fight for political independence. On his death in 1972, the Indian government declared his art national heritage and banned all further exports. The chapter describes how one of the largest collections of Jamini Roy paintings in the world came to be curated in an apartment on Baker Street in London. The author interweaves the story of Jamini with his own …
A Definition Of The State, Chandran Kukathas
A Definition Of The State, Chandran Kukathas
Research Collection School of Social Sciences
A state is a form of political association, and political association is itself onlyone form of human association. Other associations range from clubs to businessenterprises to churches. Human beings relate to one another, however, not only inassociations but also in other collective arrangements, such as families, neighborhoods, cities, religions, cultures, societies, and nations. The state is not the only form ofpolitical association. Other examples of political associations include townships, counties, provinces, condominiums, territories, confederations, internationalorganisations (such as the UN) and supranational organisations (such as the EU). Todefine the state is to account for the kind of political association it is, and to …
Specification Testing For Transformation Models, Arthur Lewbel, Xun Lu, Liangjun Su
Specification Testing For Transformation Models, Arthur Lewbel, Xun Lu, Liangjun Su
Research Collection School Of Economics
Consider a nonseparable model Y=R(X,U) where Y and X are observed, while U is unobserved and conditionally independent of X. This paper provides the first nonparametric test of whether R takes the form of a transformation model, meaning that Y is monotonic in the sum of a function of X plus a function of U. Transformation models of this form are commonly assumed in economics, including, e.g., standard specifications of duration models and hedonic pricing models. Our test statistic is asymptotically normal under local alternatives and consistent against nonparametric alternatives. Monte Carlo experiments show that our test performs well in …
A New Approach To Bayesian Hypothesis Testing, Yong Li, Tao Zeng, Jun Yu
A New Approach To Bayesian Hypothesis Testing, Yong Li, Tao Zeng, Jun Yu
Research Collection School Of Economics
In this paper a new Bayesian approach is proposed to test a point null hypothesis based on the deviance in a decision-theoretical framework. The proposed test statistic may be regarded as the Bayesian version of the likelihood ratio test and appeals in practical applications with three desirable properties. First, it is immune to Jeffreys’ concern about the use of improper priors. Second, it avoids Jeffreys–Lindley’s paradox, Third, it is easy to compute and its threshold value is easily derived, facilitating the implementation in practice. The method is illustrated using some real examples in economics and finance. It is found that …
Job Market Signaling With Human Capital Investment, Gea Myoung Lee, Seung Han Yoo
Job Market Signaling With Human Capital Investment, Gea Myoung Lee, Seung Han Yoo
Research Collection School Of Economics
In this paper, we consider the social value of signaling by recasting the Spence's (1973) signaling model in a causal relationship: human capital investment is necessary to reduce the marginal cost of signaling. Our model contains distinct features: (i) the choice of signaling a§ects the level of human capital investment and (ii) the proportion of high and low type in the entire workers is endogenously determined. From the perspective of welfare, we compare two contrasting forms of signaling, separating and pooling, and Önd that the choice of a proper form of signaling is dependent on how each signaling induces the …
Optimal Estimation Of Cointegrated Systems With Irrelevant Instruments, Peter C. B. Phillips
Optimal Estimation Of Cointegrated Systems With Irrelevant Instruments, Peter C. B. Phillips
Research Collection School Of Economics
It has been known since Phillips and Hansen (1990) that cointegrated systems can be consistently estimated using stochastic trend instruments that are independent of the system variables. A similar phenomenon occurs with deterministically trending instruments. The present work shows that such "irrelevant" deterministic trend instruments may be systematically used to produce asymptotically efficient estimates of a cointegrated system. The approach is convenient in practice, involves only linear instrumental variables estimation, and is a straightforward one step procedure with no loss of degrees of freedom in estimation. Simulations reveal that the procedure works well in practice both in terms of point …
Changing Views On Media Ethics And Societal Functions Among Students In Singapore, Benjamin Hill Detenber, Sonny Rosenthal
Changing Views On Media Ethics And Societal Functions Among Students In Singapore, Benjamin Hill Detenber, Sonny Rosenthal
Research Collection College of Integrative Studies
This panel study assessed changes in ethical ideology and beliefs about the societal function of media over the course of undergraduate communication education in Singapore. First, students' agreement with the ethical principles of truth telling, independence, and accountability increased. Second, change in agreement with the ethical principle of minimizing harm was negatively related to change in justification of contentious newsgathering methods. Third, belief that the media should function as a watchdog increased and that it should serve national development decreased. Change in these variables was inversely correlated. We relate these findings to global contexts and make recommendations for curriculum development.

With the rapid increase of online social network users worldwide, social media feeds have become a rich and valuable information resource and attract great attention across diversified domains. In social media data, there are abundant contents of two-way and interactive communication about products, demand, customer services and supply. This makes social media a valuable channel for listening to the voices from the market and measuring supply chain risks and new market trends for companies. In this study, we surveyed the potential value of social media in supply chain risk management (SCRM) and examined how they can be applied to SCRM …

Research into software engineering (SE) education is largely concentrated on teaching and learning issues in coursework programs. This paper, in contrast, provides a meta analysis of research publications in software engineering to help with research education in SE. Studying publication patterns in a discipline will assist research students and supervisors gain a deeper understanding of how successful research has occurred in the discipline. We present results from a large scale empirical study covering over three and a half decades of software engineering research publications. We identify how different factors of publishing relate to the number of papers published as well …
From Emotions To Shared Values, David Chan
From Emotions To Shared Values, David Chan
Research Collection School of Social Sciences
In an invited commentary, SMU director of Behavioural Sciences Institute Professor David Chan noted that although the negative emotions that dominated 2013 have led to some positive outcomes, emotions cannot be the foundation for society’s progress. Professor Chan suggested that, moving forward, Singapore should focus on three shared values (integrity, fairness, social harmony) and three guiding principles (rule of law, accountability, people-centricity).
Between Evangelism And Multiculturalism: The Dynamics Of Christianity In Indonesia, Chang Yau Hoon
Between Evangelism And Multiculturalism: The Dynamics Of Christianity In Indonesia, Chang Yau Hoon
Research Collection School of Social Sciences
Christianity has experienced rapid growth in Indonesia, particularly the Evangelical and Pentecostal/Charismatic movements, which find fertile ground among the urban middle class. This phenomenon has given rise to fears of Christianisation among the Muslim majority, who perceive the Christian growth as a moral threat. Tensions between Christians and Muslims have been part and parcel of religious developments in Indonesia. The author addresses the ways in which Protestant churches in Indonesia negotiate between evangelism (to fulfil the ‘Great Commission’) on the one hand, and multiculturalism (peaceful coexistence with difference) on the other. The article will examine how Christians in Indonesia navigate …

Recruiting The All-Female Rani Of Jhansi Regiment: Subhas Chandra Bose And Dr Lakshmi Swaminadhan, Tobias Frederik Rettig
Research Collection School of Social Sciences
The recruitment of the all-female Rani of Jhansi Regiment of the Indian National Army in Japanese-controlled Singapore and Malaya, with a particular focus on the period between the first female guard of honour on 12 July 1943 through to the opening of the regiment's main camp in Singapore on 22 October 1943, has to date been insufficiently studied. Starting with the conception of the Regiment in an Axis submarine by the Indian nationalist leader Subhas CHANdra Bose (1897–1945), this paper examines the ideas and figures that inspired the regiment and the role of Bose and Dr Lakshmi Swaminadhan (1914–2012) in …

Research Collection School of Social Sciences
Two studies evaluated the correspondence between self-reported well-being and codings of emotion and life content by the Linguistic Inquiry and Word Count (LIWC; Pennebaker, Booth, & Francis, 2011). Open-ended diary responses were collected from 206 participants daily for 3 weeks (Study 1) and from 139 participants twice a week for 8 weeks (Study 2). LIWC negative emotion consistently correlated with self-reported negative emotion. LIWC positive emotion correlated with self-reported positive emotion in Study 1 but not in Study 2. No correlations were observed with global life satisfaction. Using a co-occurrence coding method to combine LIWC emotion codings with life-content codings, …
The Fiduciary Doctrine As A New Pathway: An Alternative Approach To Analysing Native Customary Rights In Sarawak, Hang Wu Tang
The Fiduciary Doctrine As A New Pathway: An Alternative Approach To Analysing Native Customary Rights In Sarawak, Hang Wu Tang
Research Collection Yong Pung How School Of Law
This paper explores the use of the fiduciary doctrine whereby the state is conceived as a fiduciary vis-à-vis her native peoples and attendant equitable remedies are made available for the native customary rights over land in Sarawak. Thus far, most challenges to extinguishment of native customary rights in Sarawak have proceeded on constitutional grounds, with little success. This article draws on the jurisprudence of fiduciary law in other parts of the Commonwealth and argues that this is a viable alternative cause of action against the state.

Little India Riot: The Dog That Did Not Bark, Tan K. B. Eugene
Research Collection Yong Pung How School Of Law
In a commentary, SMU Associate Professor of Law and NMP Eugene Tan said that in the aftermath of the Little India riots, the focus and dominant narrative had been on law and order issues, with the Government emphasising that it was a spontaneous "one-off" event. He said that there was a need to consider if Singapore was prepared to shoulder more of the costs of having a large foreign labour force. However, he also noted that an immediate cutback of the workforce size would be simplistic and is not the solution, as reducing reliance on foreign workers could not be …

Followership, Leadership And Social Influence, Burak Oc, Michael R. Bashshur
Research Collection Lee Kong Chian School Of Business
Traditional research in leadership has largely relegated followers to the role of passive recipients or, at best, moderators of leader influence and behaviors. However, recent work in the area of followership has begun shifting this focus and emphasizing the possibility that followers actively have an influence over leaders, in particular leader behavior. This paper revisits traditional areas of the leadership literature and builds on the emerging followership literature to reintroduce followers as part of the social context of leaders. In an attempt to build theoretical rationales for how followers influence leader behavior we draw on the social influence (e.g., Social …
