This study explores how the media narratives and political perspective of pretrial publicity (PTP) can influence jurors’ perceptions in sexual assault cases, raising significant concerns about justice in courtrooms. Specifically, it examines whether media framing of a real-life sexual assault case — through varying media narratives, with media that either challenges or endorses rape myths, and media source (liberal vs. conservative) — affects mock jurors’ rape myth acceptance (RMA), views of victim credibility, and judgements of perpetrator guilt. Participants first completed a RMA scale, then read mock news articles varying in media narrative and political affiliations (media source), followed by …

On October 9, 2025, the Washington and Lee Law Library hosted the fifth W&L Law Fall Scholarship Celebration. The event was co-sponsored by the Frances Lewis Law Center and took place in the Law Library's main reading room from 5:00 to 7:00 p.m.

This review examines the AALL 2025 program “AI in Law Libraries: Discussing Ethical Considerations and a Way Forward,” focusing on the ethical challenges artificial intelligence presents for law librarians and legal professionals. The author highlights discussions on the Model Rules of Professional Conduct, responsible and transparent use of AI, risks such as hallucinations and bias, and broader concerns including environmental impact and the future of human labor. The review emphasizes that the program raised important questions rather than definitive solutions, underscoring the need for ongoing, profession-wide dialogue as AI continues to evolve.

While the constitutional right to an abortion was the law of the land in the U.S., Texas sought to restrict that right in line with their political agenda by passing S.B. 8 (2021), referred to as the “Texas Heartbeat Act”. This statute made access to abortions illegal past six weeks, or once a heartbeat is detected. Widespread agreement has existed for centuries that a free press is essential to democracy. But legal scholars have spent almost no effort thinking about why else we might need a free press. This article attempts to widen the aperture. It argues that as the free press is essential to democracy, it is just as essential to a separate value: the rule of law.

In Singapore, most land is state-owned, with the state generally issuing leasehold estates via state leases of not more than 99 years1, depending on the intended land use. Naturally, the value of a leasehold estate, which erodes over time as the lease approaches the end of its term, is a key component of the premium charged for lease renewals, or the tax imposed for permission given in relation to a development that would increase the value of the land. Comparative analysis of European and certain Asian approaches to governance often degenerates into simplistic dichotomies based on universal human rights assumptions. This chapter rejects such dualities, ill-informed by theory and historical reflection. The emerging argument is founded on a historical realist approach to theorising difference. Assisted by Polanyi’s double movement, the detailed substantive comparison is preceded by considerations of how recent trends in governing AI have uniformly adopted a countermovement against the dis-embedding of data and technology from the social leading to a risk/responsibility paradigm. This is the 11th annual review of Singapore’s performance in international moot court competitions. In a nutshell, 2024/25 has been a tremendous, record-breaking season for Singapore – and a particular duck has finally been broken. In the highest-tier or Grand Slam competitions, Singapore Management University emerged world champions in the Jessup, Vis East, International Criminal Court, and Frankfurt competitions; the previous world record for most Grand Slam wins in a season was 2 (held by various universities), and this new record may well increase to 5, depending on whether SMU can successfully defend its world championship at the Lachs Space …

The Singapore President's role is not only ceremonial: from 1991, it has encompassed the substantive function of serving as a guardian of public reserves and the integrity of the public service. A person must meet certain qualifying criteria in order to run in a Presidential election. This article focuses on one set of qualifying criteria, namely, the "service criteria": the requirement that candidates have had certain experience in serving in certain roles in the public sector or the private sector. Climate justice is growing concerns in the sphere of climate policy, yet few practical tools exist to measure whether climate action is fair, inclusive and prioritizing the most vulnerable. This paper examines existing global frameworks, such as the Environmental Performance Index (EPI), Nationally Determined Contributions (NDCs), and emerging tools like PRISM and JUSTICE Integrated Assessment Models (IAMs). While these initiatives offer valuable insights, most of them lack actionable and efficient metrics to quantify climate justice implementation. Indigenous people manage significant global terrestrial surface while simultaneously guarding around 80% of the world's biodiversity (With methodological uncertainty), despite only comprising a small fraction of the global population.Their traditional ecological knowledge (TEK) supports essential climate solutions and helps in the adaptation and mitigation of greenhouse gas emissions. The climate emergency is deepening and needs urgent attention involving radical, binding, and multilateral measures. Ecocide is the large-scale and deliberate destruction of ecosystems which undermines human security, destabilizes the fragile states and increases geopolitical tensions. It has been contended in this policy brief that ecocide needs to be internationally criminalized pursuant to the Rome Statute of the International Criminal Court (ICC) to place environmental destruction firmly within the scope of global peace and security. This article presents the findings derived from the construction of an Index that evaluates the state of promotion of Civil Society Organizations (CSOs) across Mexico’s 32 federal entities during the year 2021. It also outlines the criteria considered in building the Index and the results obtained in each of its dimensions. The Index provides a comprehensive and multidimensional perspective on the study of CSO promotion, analyzing legal, institutional, and programmatic dimensions with the aim of comparing progress and setbacks in this area. This policy paper examines how climate change accelerates cross-border displacement, especially in regions most vulnerable to ecocide and environmental degradation. Climate refugees remain unprotected under international law, as the 1951 Refugee Convention excludes environmental grounds for asylum, leaving populations exposed to human rights violations and securitized responses. It analyzes legal and institutional gaps, highlighting failures in global climate governance and the disproportionate risks faced by SIDS and other affected regions. The paper calls for COP30 to mandate a high-level UNFCCC forum on climate displacement and ecocide to build a just, cooperative, and rights-based international framework.

This policy paper examines the Climate justice, Ecocide and security implications of carbon market mechanisms for Indigenous Peoples (IPs). Despite global recognition of Indigenous people participation , existing frameworks under the UNFCCC and mechanisms often lack enforceable safeguards to protect Indigenous sovereignty. The paper identifies critical gaps in governance, particularly the absence of Indigenous-led oversight in Carbon markets. Drawing on two case studies: Yurok Tribe and Ogiek people, it demonstrates how carbon markets can reproduce neo-colonial patterns of resource appropriation. งานวิจัยนี้มีวัตถุประสงค์เพื่อศึกษาความรับผิดทางแพ่งของบริษัทแม่ต่อผู้เสียหายที่ได้รับผลกระทบจากพื้นที่ปนเปื้อนสารอันตรายของบริษัทลูก โดยเป็นการศึกษาวิจัยเอกสารจากบทบัญญัติกฎหมาย คำพิพากษาศาล หนังสือตำรา และบทความเชิงวิชาการที่เกี่ยวข้อง ทั้งในประเทศและต่างประเทศ ผลการศึกษาพบว่า ปัจจุบันพระราชบัญญัติส่งเสริมและรักษาคุณภาพสิ่งแวดล้อมแห่งชาติ พ.ศ. 2535 ยังไม่มีบทบัญญัติให้บริษัทแม่เข้ามารับผิดชอบในความเสียหายจากพื้นที่ปนเปื้อนสารอันตรายของบริษัทลูก หากบริษัทแม่มีส่วนร่วมในแหล่งกำเนิดมลพิษหรือกำกับดูแลบริษัทลูก แต่ขาดการยึดถือแหล่งกำเนิดมลพิษทางกายภาพหรือเจตนาเพื่อตนอย่างใดอย่างหนึ่งไป อันไม่ครบองค์ประกอบของการเป็นผู้ครอบครองที่ต้องรับผิดตามมาตรา 96 หากบริษัทแม่มีการกระทำที่ไม่คำนึงถึงความเป็นนิติบุคคลของบริษัทลูกที่ไม่ใช่การกระทำละเมิด หากแต่เป็นการใช้โครงสร้างความเป็นนิติบุคคลของบริษัทลูกในทางมิชอบ อันได้แก่ การใช้นิติบุคคลเป็นเครื่องมือเพื่อหลบเลี่ยงหรือรับหน้าที่หรือความรับผิด และการมีทรัพย์สินปะปนกัน ดังนั้น จึงสมควรกำหนดบทบัญญัติที่เกี่ยวกับความรับผิดของบริษัทแม่ภายใต้พระราชบัญญัติดังกล่าว เพื่อให้ผู้เสียหายในคดีมลพิษจะได้รับความเป็นธรรมในการเยียวยา

วิธีการทางกฎหมายอันเหมาะสมและบทบัญญัติของกฎหมายที่เพียงพอต่อการลงโทษนิติบุคลคลซึ่งละเลยหน้าที่อันต้องกระทำการหลังการขุดเหมืองแร่นั้นถือเป็นประเด็นในทางกฎหมายที่หลายประเทศทั่วโลกไม่ได้ให้ความสนใจเท่าไรนัก นอกจากการละเว้นหน้าที่ดังกล่าวโดยประมาทจะส่งผลร้ายทั้งทางตรงและทางอ้อมต่อสิ่งแวดล้อมและชุมชน บริเวณรอบพื้นที่แล้ว การกระทำดังกล่าวยังส่งผลเสียต่อตัวนิติบุคคลด้วย ในอินโดนีเซียมีผู้เห็นว่าการบังคับใช้มาตรการบังคับทางปกครองเพียงอย่างเดียวก็สามารถป้องปรามการกระทำดังกล่าวได้อย่างเพียงพอ แต่อย่างไรก็ตาม เมื่อได้ศึกษาเปรียบเทียบกฎหมายของอินโดนีเซียกับประเทศไทยและแอฟริกาใต้แล้ว พบว่ามีการใช้มาตรการทางอาญาควบคู่ไปกับมาตรการบังคับทางปกครอง ดังนั้น กรณีดังกล่าวจึงนำมาสู่ปัญหาของงานวิจัยฉบับนี้ว่า การบังคับใช้มาตรการทางอาญาควบคู่ไปกับมาตรการบังคับทางปกครองต่อความผิดฐานละเลยหน้าที่ที่พึงต้องกระทำหลังการขุดเหมืองแร่โดยประมาทจะมีผลสัมฤทธิ์มากกว่าการใช้มาตรการบังคับทางปกครองเพียงอย่างเดียวหรือไม่ และการใช้โทษทางอาญาในความผิดฐานดังกล่าวนั้นขัดต่อหลักความได้สัดส่วนและหลักการกำหนดความผิดในทางอาญาหรือไม่ บทความวิจัยนี้จึงมุ่งศึกษาปัญหาดังกล่าวโดยเน้นการวิเคราะห์หลักเกณฑ์ทางทฤษฎีที่เกี่ยวข้อง และเปรียบเทียบกฎหมายของประเทศไทยและแอฟริกาใต้

บทความวิจัยนี้ศึกษาพัฒนาการของการตีความมาตรา XXI(b) ขององค์การการค้าโลก (WTO) เกี่ยวกับข้อยกเว้นด้านความมั่นคง ตั้งแต่ยุค GATT จนถึงปัจจุบัน โดยวิเคราะห์แนวปฏิบัติและคำวินิจฉัยในการยกอ้างข้อยกเว้นนี้ ผลการศึกษาพบว่า ในยุค GATT และ WTO ตอนต้น การตีความมาตรา XXI ยังขาดความชัดเจน โดยมีการอ้างอิงข้อยกเว้นนี้น้อยมาก และในกรณีที่มีการอ้างอิง ส่วนใหญ่มักยุติด้วยการเจรจา ตกลงกันโดยไม่ผ่านกระบวนการวินิจฉัยที่จะก่อให้เกิดบรรทัดฐานหรือแนวปฏิบัติ อย่างไรก็ตาม นับตั้งแต่ยุคสงครามการค้า การอ้างอิงข้อยกเว้นนี้ตามมาตรา XXI(b) ได้แพร่หลายมากขึ้น และคณะกรรมการวินิจฉัยข้อพิพาทแห่ง WTO ได้แสดงแนวโน้มที่ชัดเจนยิ่งขึ้นในหลายประเด็น เช่น การให้รัฐใช้ดุลพินิจในส่วนของบทนำและเป็นอำนาจพิจารณาของคณะกรรมการวินิจฉัยข้อพิพาทในบทเฉพาะ การแบ่งองค์ประกอบของบทบัญญัติและการตีความ “ผลประโยชน์สำคัญในด้านความมั่นคง” แต่ยังคงมีประเด็นที่ไม่ชัดเจน โดยเฉพาะในเรื่องการตีความ “สถานการณ์ฉุกเฉินในความสัมพันธ์ระหว่างประเทศ” และขอบเขตการใช้ดุลพินิจของรัฐที่จะถูกตรวจสอบโดยคณะกรรมการวินิจฉัยข้อพิพาท
