Recognizing The Liability Of Social Hosts Who Knowingly Allow Intoxicated Guests To Drive: Limits To Socially Acceptable Behavior, Robert W. Gomulkiewicz

Gradually, courts have joined these efforts to alleviate the harm caused by the intoxicated driver. A few courts have recognized an action in tort against those who contribute to drunken driving by serving intoxicating liquor. These courts have acted, in part, to relieve victims of the costs of drunken driving and to distribute the costs among those responsible for its occurrence. Washington courts should recognize the liability of a negligent social purveyor of alcoholic beverages. Courts need not be constrained from recognizing a common law cause of action because of competing social interests or legislative inaction. Washington courts should rule …

We shall not define precisely industrial policy other than to note that the cases we intend to examine involve some form of general, integrated, economic policy that, among other things, includes industry-specific measures that have had direct or indirect consequences for other countries through trade or investment links. Many other characteristics, including program integration; abridgment of private business governance, perhaps involving varying degrees of compulsion or subsidy; non-market incentives; and subordination of the market mechanism, may or may not be present in the industrial policies discussed. Industrial Policy And The Rights Of Labor: The Case Of Foreign Workers In The French Automobile Assemble Industry, Mark J. Miller
Michigan Journal of International Law
The foreign labor which made possible Western Europe's postwar economic growth has become a permanent, if belatedly recognized, component of the region's labor markets. Technological change and new industrial policies stressing efficiency, skilled labor, and rationalization threaten foreign workers, raising complex and important issues of law and social policy in the debate over labor's role in industrial policy. These changes already have resulted in grave problems which make agreement and clarification of the rights of foreign workers in national and international law a matter of considerable urgency.

The purpose of this Article is to highlight lessons that may be learned from the area of labor protection in urban mass transit. Public transportation is quite relevant to the issues of federal influence on local public service delivery, because the local transit industry is presently governed my the Urban Mass Transportation Act (UMT Act). This Article traces the development of federal intervention in the urban mass transit industry. Just prior to its adjournment in 1982, and subsequent to hotly contested debates, the 97th Congress enacted the Surface Transportation Assistance Act of 1982 (STAA). The Act contained a number of controversial provisions, not the least of which was one requiring that "not less than 10 per centum of the amounts authorized to be appropriated" by the act were to be expended on small business "owned and controlled by socially and economically disadvantaged individuals ... ." Such small businesses have become known, as disadvantaged business enterprises, or DBE's.
