Vietnam Amnesty – Problems Of Justice And Line-Drawing, Kent Greenawalt Jan 1977

Vietnam Amnesty – Problems Of Justice And Line-Drawing, Kent Greenawalt

Faculty Scholarship

The troublesome issue of pardon for crimes connected with the Vietnam War raises some of the most complex and difficult questions in the philosophy of law. What are the purposes of criminal punishment? Under what conditions is violation of obligations imposed by law morally justified? When, and on what conditions, is it proper to excuse those who have violated the law for conscientious reasons? How much should decisions whether to pardon turn on what offenders "deserve" and how much should they turn on what will be socially acceptable and promote future social harmony? How far should the desirability of dispositions …

Recent U.S. Efforts To Control Nuclear Proliferation, John D. Gleissner Jan 1977

Recent U.S. Efforts To Control Nuclear Proliferation, John D. Gleissner

Vanderbilt Journal of Transnational Law

The explosion of a nuclear device by India on May 18, 1974, initiated a new wave of concern for the prospects of limiting the proliferation of nuclear weapons. Subsequent developments such as the Nixon proposal to provide nuclear materials to Egypt and Israel and the announcement by West Germany of its intentions to sell Brazil a plutonium reprocessing facility increased fears in the United States that the number of countries possessing nuclear weapons would continue to grow at the expense of world peace and security. Apprehension is likely to continue since the development of an atomic bomb blueprint by a …

Arms Sales And The Major Western Powers, Arthur Cyr Jan 1977

Arms Sales And The Major Western Powers, Arthur Cyr

Vanderbilt Journal of Transnational Law

The purpose of this essay is to discuss analytically the overseas arms sales policies of the three major Western supplier nations--the United States, Britain, and France. It is appropriate to group them together because they all have similar goals and characteristics. All are Atlantic Area NATO nations. They are democratic and are based upon largely private economies. The three nations have general histories of cooperation and alliance dating back to before the beginning of this century.

This analysis is based on the assumption that military trade between the industrialized and lesser-developed countries is especially likely to destabilize international relations since …

The Schneiderman Case: An Inside View Of The Roosevelt Court, Jeffrey F. Liss

Michigan Law Review

Only rarely in the study of Supreme Court history do events, personalities, records, and historical sources converge to afford an intimate view of that institution. Schneiderman v. United States, in its own right an important decision in the field of denaturalization law, provides such an opportunity. The manuscript collections of the major adversaries on the Court are well-preserved, and a surviving major figure from among the parties to ·the litigation has provided personal insight into the intricacies of the case.

The Trial Of General Tomoyuki Yamashita: A Case Study In Command Responsibility, L. H. Redford Oct 1975

The Trial Of General Tomoyuki Yamashita: A Case Study In Command Responsibility, L. H. Redford

History Theses & Dissertations

The case of General 'Tomoyuki Yamashita, the subject of this thesis, established a precedent in international law, at least so far as the United States respected that law, Its successful prosecution prepared the way for the prosecution of numerous, subsequent war crimes cases, upon a standard of liability developed and approved by the United States in Yamashita, and without regard for the attenuated procedural protections granted in American civil courts. General Mac-Arthur played an important part in Yamashita’s trial, and this essay shall also discuss the extent of his interest and involvement in the case.
