‘A Hussy Who Rode On Horseback In Sexy Underwear In Front Of The Prisoners’: The Trials Of Buchenwald’S Ilse Koch, Mark A. Drumbl, Solange Mouthaan
‘A Hussy Who Rode On Horseback In Sexy Underwear In Front Of The Prisoners’: The Trials Of Buchenwald’S Ilse Koch, Mark A. Drumbl, Solange Mouthaan
Scholarly Articles
Ilse Koch’s trials for her role in atrocities at the Nazi Buchenwald concentration camp served as visual spectacles and primed her portrayal in media and public spaces. Koch’s conduct was credibly rumored to be one of frequent affairs, simultaneous lovers, and the sexual humiliation of prisoners. The gendered construction of her sexual identity played a distortive role in her intersections with law and with post-conflict Germany. Koch’s trials revealed two different dynamics. Koch’s actions were refracted through a patriarchal lens which spectacularized female violence and served as an optical space to (re)establish appropriate feminine mores. Feminist critiques of Koch’s trials …

Brain-Computer-Interfacing & Respondeat Superior: Algorithmic Decisions, Manipulation, And Accountability In Armed Conflict, Salahudin Ali
Brain-Computer-Interfacing & Respondeat Superior: Algorithmic Decisions, Manipulation, And Accountability In Armed Conflict, Salahudin Ali
Catholic University Journal of Law and Technology
This article examines the impact that brain-computer-interfacing platforms will have on the international law of armed conflict’s respondeat superior legal regime. Major Ali argues that the connection between the human brain and this nascent technology’s underlying technology of artificial intelligence and machine learning will serve as a disruptor to the traditional mental prerequisites required to impart culpability and liability on commanders for actions of their troops. Anticipating that BCI will become increasingly ubiquitous, Major Ali’s article offers frameworks for solution to BCI’s disruptive potential to the internal law of armed conflict.
Innovative Thinking: Modernizing Outer Space Governance, Diane M. Janosek
Innovative Thinking: Modernizing Outer Space Governance, Diane M. Janosek
Catholic University Journal of Law and Technology
Space security is essential to global safety and prosperity. International treaties should modernize and reflect the world’s innovation in space and governance needs. One must look back to 1967 for the inaugural “Outer Space Treaty,” the first and only binding multilateral agreement for peaceful space use and exploration. In 50 years, technologies and space capabilities have evolved; an updated global treaty and agreement should be developed and evaluated. Both China and Russia have demonstrated their capability to degrade and/or destroy adversaries’ satellites in space. Space wars are no longer a hypothetical. The future once discussed and anxiously anticipated after Sputnik …
A New Chapter In Veterans Law, The Honorable Margaret Bartley
A New Chapter In Veterans Law, The Honorable Margaret Bartley
American University Law Review
Chief Judge Bartley delivered these remarks on October 2, 2020 at the American University Law Review’s thirty-fifth annual Federal Circuit Symposium. The remarks have been minimally edited based on the event transcript.
Review Of Veterans Law Decisions Of The Federal Circuit, 2020 Edition, Angela K. Drake, Yelena Duterte, Stacey-Rae Simcox
Review Of Veterans Law Decisions Of The Federal Circuit, 2020 Edition, Angela K. Drake, Yelena Duterte, Stacey-Rae Simcox
American University Law Review
This Article continues last year’s in-depth review of veterans law cases decided by the Federal Circuit, published by the American University Law Review. In the year 2020, the Federal Circuit further clarified the law applicable to veterans cases, including the parameters of the class action device and the need for robust analysis in cases challenging agency delay and inaction. The court significantly expanded veterans’ ability to challenge regulations and manual provisions directly in the Federal Circuit. It created new law with regard to the presumption of competency applicable to Department of Veterans Affairs (VA) examiners and explored the parameters of …
The 2020 Trump-Taliban "Peace Agreement" - Time To End The War On Terror, Jeffrey F. Addicott
The 2020 Trump-Taliban "Peace Agreement" - Time To End The War On Terror, Jeffrey F. Addicott
Faculty Articles
By far and away the "War on Terror" is the longest war in American history. In Afghanistan, the primary center of gravity for the conflict, it has gone on for almost two decades and has cost the United States somewhere north of one trillion dollars and thousands of casualties. But it may soon be over. Given that the Trump Administration entered into a conditional "peace deal" with the Taliban in February 2020, which purports to culminate with a complete drawdown of the then 13,000 American forces in Afghanistan by May of 2021, it is certainly worthwhile to examine the chronology …

Grounding Suicide Terrorism In Death Anxiety And Consumer Capitalism, James M. Donovan
Grounding Suicide Terrorism In Death Anxiety And Consumer Capitalism, James M. Donovan
Law Faculty Scholarly Articles
This article examines an influential theory on suicide attacker motivations, the Significance Quest Theory, and suggests that this death anxiety approach can be improved by shifting its focus toward the related, but more comprehensive, Terror Management Theory. The theoretical productivity of this realignment is tested by examining the relationship between suicide attacks and one of the variables thought to trigger the underlying anxieties: the local pressures from global consumer capitalism. After describing the relationship between death anxiety and suicide terrorism generally, this article concludes by applying these insights to the ethnographic context of Egypt.

The Effects Of National Security On Supreme Court Case Decisions Involving Civil Liberties, Callie Gerzanics
The Effects Of National Security On Supreme Court Case Decisions Involving Civil Liberties, Callie Gerzanics
Williams Honors College, Honors Research Projects
This research project will analyze the effects that national security laws and tensions have on civil liberties and Supreme Court case decisions. National security has been a primary objective for the United States of America for as long as wars have been fought and enemies have been made. National security continues to be a concern for the U.S. government, especially with the prominence of technology that has made the U.S. more vulnerable to breaches in security, such as cybernetic attacks. The motivations behind this project stem from a concern of how national security can influence Supreme Court decisions, police arrests, …

A Case For Diversionary Restorative Justice In Cases Involving The Embezzlement Of Funds From Small Businesses, Amanda Cooper
A Case For Diversionary Restorative Justice In Cases Involving The Embezzlement Of Funds From Small Businesses, Amanda Cooper
Cardozo Journal of Conflict Resolution
In 2015, John Tschol, the owner of a small advising business in Bloomington, Minnesota, thought that he had a wonderful work life. His business was successful-enough to make a modest profit-and his employees were loyal, hard workers, who had been with him for years. Then he found out that his bookkeeper, Laura Scholz, had been embezzling funds, stealing more than $317,000 over two years.

Self-Defense To Cyber Force: Combatting The Notion Of 'Scale And Effect', Thomas Eaton
Self-Defense To Cyber Force: Combatting The Notion Of 'Scale And Effect', Thomas Eaton
Scholarly Works
The ability to reach out, with a few keystrokes or a couple lines of code, through the interconnected world of cyberspace and create militarily advantageous effects 10,000 miles away has changed warfare as previously conceived, perhaps more than any other advancement in any other domain of war. Cyber weapons are weapons, and whatever law applies to conventional weapons equally applies to cyber weapons. Long before cyber operations were even science fiction, there was much debate over what constituted a use of force that would justify force in response. In many ways, the debate over what constitutes cyber-attacks has been pasted …
The Islamic State's Pattern Of Sexual Violence: Ideology And Institutions, Policies And Practices, Mara Redlich Revkin, Elisabeth Jean Wood
The Islamic State's Pattern Of Sexual Violence: Ideology And Institutions, Policies And Practices, Mara Redlich Revkin, Elisabeth Jean Wood
Faculty Scholarship
The Islamic State (IS), which controlled significant territory in Iraq and Syria between 2014 and 2017, engaged in a wide repertoire of violence against civilians living in these areas. Despite extensive media coverage and scholarly attention, the determinants of this pattern of violence remain poorly understood. We argue that, contrary to a widespread assumption that the IS wielded violence indiscriminately, it systematically targeted different social groups with distinct forms of violence, including sexual violence. Our theory focuses on ideology, suggesting it is a necessary element of explanations of patterns of violence on the part of many armed actors. Ideologies, to …
Competitive Governance And Displacement Decisions Under Rebel Rule: Evidence From The Islamic State In Iraq, Mara Redlich Revkin
Competitive Governance And Displacement Decisions Under Rebel Rule: Evidence From The Islamic State In Iraq, Mara Redlich Revkin
Faculty Scholarship
When rebel groups with state-building ambitions capture territory, who stays and why? Through semi-structured interviews and an original household survey in the Iraqi city of Mosul, which was controlled by the Islamic State for more than three years, I conduct a multi-method descriptive comparison of the characteristics of “stayers” against “leavers.” I test and find some quantitative and qualitative support for a theory of competitive governance: Civilians who perceived improvements in the quality of governance under IS rule—relative to the Iraqi state—were more likely to stay under IS rule than those who perceived no change or a deterioration, but displacement …

Satellite Communications Law: The Nexus Of Space And Telecom Law, Frans Von Der Dunk
Satellite Communications Law: The Nexus Of Space And Telecom Law, Frans Von Der Dunk
Space, Cyber, and Telecommunications Law Program: Faculty Publications
Given the complexity of satellite communications as a global business sector involving many private as well as public operators, many national and international regulators and a constantly evolving suite of services offered to an ever-increasing number of users and consumers, it should not come as a surprise that the legal environment—the sets of rules, rights, and obligations applicable to anyone operating in the field—is highly complex as well. This is already true even if merely focusing at the international level, where the myriad domestic regimes play varying roles—largely neglected in this particular article—in implementing, interpreting, refining, enforcing, or even changing …
Environmental Protection, The Military, And Preserving The Balance: “Why It Matters, In War And Peace”, Kurt Smith
Environmental Protection, The Military, And Preserving The Balance: “Why It Matters, In War And Peace”, Kurt Smith
Seattle Journal of Technology, Environmental, & Innovation Law
International military operations around the world are major actors on the world stage of global pollution. The United States military remains subject to federal, state, and local environmental laws. However, many exemptions exist to assist the military despite its status as a global polluter. Many environmental policies have incrementally developed over the last one-hundred years largely as a reaction to the most extreme circumstances. Scientific knowledge continues to increase our awareness of the lasting impacts of policy decisions relating to the environment, giving rise to the precautionary principle, that notion that we should do no lasting harm, in our care …
Functional Statehood In Contemporary International Law, William Thomas Worster
Functional Statehood In Contemporary International Law, William Thomas Worster
Brooklyn Journal of International Law
The international community lacks a form of territorial-based, international legal personality distinct from statehood, and yet, non-state, territorial entities of varying degrees of autonomy or independence need to function within the international community in some form. Some of these entities cannot be recognized as states because their creation violates jus cogens norms, though others are not recognized based on an assessment that they may not fully qualify as a state or that there are political reasons to refuse recognition. However, existing states still need to engage with these territorial quasi-states through the only paradigm the international community has—statehood. For example, …
