Gideon v. Wainwright, which was decided in 1963, held that the Sixth Amendment guarantees the right to counsel for poor people charged with crimes in state court.1 Over the six decades since Gideon was decided, states have grappled with how to provide public defense services.

Students who began law school in the fall of 2023 could be among the first to encounter the NextGen Bar Exam. Examinees will now be required to demonstrate proficiency in legal research to become practicing attorneys. This change provides an opportunity to evaluate the pedagogy employed to prepare students for the bar exam and beyond. Incorporating critical information literacy into the legal research curriculum will enable students to master the analytic and metacognitive skills that will be tested on the NextGen Bar Exam. Law librarians can incorporate these skills into legal research instruction by implementing the Framework for Information Literacy …

The Female Judge “Hunch” In Family Court; Does Female Judgment Differ From Male Judgment?, Kareem M. Rashed

The Undergraduate Research Journal

This paper offers an in-depth theoretical review of the differences in moral judgments between genders, particularly emphasizing their manifestation in the context of family court. Based on Carol Gilligan's critique of Lawrence Kohlberg's theory about moral development, there are distinct differences in moral reasoning approaches between men and women. Gilligan's work challenged the universality of Kohlberg's framework and instead suggested that gendered perspectives on moral reasoning commonly prioritize care and relationships over abstract principles. Complementing this theoretical foundation, the paper incorporates findings from a number of practical studies and surveys, providing non-theoretical evidence of these differences in real-world contexts. Reforming The Rules: A Proposal For Modifying The Model Rules Of Professional Conduct To Permit Partnerships Between Lawyers And Nonlawyers In The Practice Of Law, Sholom Zeitlin

The Model Rules of Professional Conduct prohibit partnerships between lawyers and nonlawyers in the practice of law, a ban that purportedly exists to protect lawyers’ professional independence of judgment. Despite this noble sentiment, the prohibition ultimately hurts the legal market, to the expense of potential clients, by limiting the professional options available at the lawyer’s disposal. The existence of lawyer-nonlawyer partnerships, recently espoused by two states, both decreases the costs and barriers involved in obtaining justice and encourages much-needed legal innovation. While other scholars have proposed schemes that would permit such partnerships without compromising the lawyer’s professional responsibility, their methods …

Prospective theories of cybersecurity liability have traveled over some well-worn paths over the past three decades, resulting in some successes, but also in at least as many cul-de-sacs and dead ends. Part of this problem can be found in the difficulty and complexity of the subject itself. Courts, legislators, and regulators all face comprehension difficulties when they attempt to fit our existing legal system around cybersecurity, often resulting in half-measures and generalized solutions that are challenging to apply to the widely different technical details behind each case. Attorney-client jail phone calls, video calls, and emails are all routinely recorded and monitored by jails, with numerous examples of jails and private telecommunications providers giving those recordings and emails to law enforcement and prosecutors. This widespread failure to protect the confidentiality of attorney-client communications prevents lawyers from being able to enjoy easy, quick, and regular communications with their clients. In practice, and despite the ever-expanding communication methods in the outside world, those held in jails in this country while their criminal cases are pending are effectively stuck in the nineteenth century when the only way to communicate was in …

Lawyers do not know as much about Black English as they should, and people’s freedom hangs in the balance. Differences between language varieties in sounds and grammar can change and have changed the outcome of cases: “He at work” and “He be at work” mean two completely different things. To reduce misinterpretation and therefore wrongful outcomes, this Article provides a primer on the sounds, words, grammar, and social context of Black English targeted directly at legal practitioners.
