Kewenangan yang diberikan kepada seseorang notaris berdasarkan Pasal 15 Undang-Undang Jabatan Notaris (UUJN) dengan memperhatikan kewajibannya sebagai notaris berdasarkan Pasal 16 UUJN. Kewenangan notaris salah satunya pembuatan Akta Pelepasan Hak Atas Tanah (APH). Salah satu peristiwa yang terjadi dalam pembuatan APH ditemukan ketidaktelitian atas penghadap yang dituangkan dalam akta. Terdapat 2 (dua) permasalahan yaitu akibat hukum terhadap akta pelepasan hak atas tanah berdasarkan putusan nomor 1249 K/PID.SUS/2018 dan tanggung jawab hukum notaris terhadap akta pelepasan hak atas tanah. Perjanjian sewa menyewa yang dibuat oleh dan dihadapan Notaris berlaku sebagai akta autentik yang memiliki kekuatan pembuktian sempurna. Seorang Notaris dalam pembuatan aktanya harus mengikuti proses yang benar sesuai dengan peraturan perundang-undangan yang berlaku. Kelalaian yang dapat terjadi pada proses pembuatan akta autentik dapat menyebabkan kekuatan pembuktian akta tersebut terdegradasi menjadi akta dibawah tangan ataupun batal demi hukum. Selanjutnya, terhadap Notaris yang melakukan kesalahan pada pembuatan aktanya dapat dinyatakan sebagai pelaku atas Perbuatan Melawan Hukum. Greening The Desert, Pamela R. Metzger, Kristin Meeks, Jessica Pishko

Deason Center Reports

Greening the Desert brings a criminal justice lens to the phenomenon of legal deserts in small, tribal, and rural (STAR) communities—vast areas with few, if any, practicing attorneys. The report explores STAR criminal justice communities and describes strategies and initiatives to green these criminal law deserts. Using case studies, the report offers concrete examples of successful innovations. It also includes cautionary notes about risks that may arise with the implementation of strategies to recruit, train, and retain STAR practitioners.

Reimagining The Philosophy Of Evaluation, Assistance, And Certification (Eac) Project: The Ials Model Reform In Legal Education, Sreejith S.G.

In 2017, the International Association of Law Schools (IALS) launched its Evaluation Assistance and Certification (EAC) Project. The Project, essentially meant to enable law schools to raise themselves to international standards in legal education, has not only advanced the work of IALS but also broadened its mandate, giving IALS a new philosophy and outlook. The renewed philosophy of IALS is a philosophy of ambition, solidarity, self-becoming, and the pursuit of excellence. As part of the symposium on Jack Balkin and Sandy Levinson’s Democracy and Dysfunction, this Article documents another source of the dysfunction that the authors observe—elite lawyers’ unwillingness to break ranks with other elite lawyers who participate in the destruction of various norms that are integral to a well-functioning democracy. These network effects eliminate the possibility of “soft” sanctions on norm violators such as withholding future professional advancement. Thus, rather than enforcing norms and deterring norm violations, the networks serve to insulate norm violators from any meaningful accountability.

Scandalizing The Judiciary: An Analysis Of The Uneven Response Of The Supreme Court Of India To Sexual Harassment Allegations Against Judges, Sanjay Jain, Saranya Mishra

The Supreme Court of India (SC) pronounced a momentous judgment in Vishaka v. State of Rajasthan in 1997, categorically recognizing the menace of sexual harassment (SH) at workplace and constitutionally rendering it as being in violation of fundamental rights guaranteed by Articles 15, 19, and 21 of the Constitution of India 1950. The Court also provided a mechanism for redressal against SH, which was ultimately reinforced by Parliament with the enactment of Sexual Harassment at Workplace (Prevention, Prohibition and Redressal) Act 2013 (POSH Act). In business and in competition, value exists in striking first. Accountants, the so-called hawks of the professional world, have made the first move. In September 2017, the global accounting giant PwC opened a law firm in Washington, D.C. called ILC Legal. ILC Legal not only provides legal services on non-domestic matters, but also acts as a multidisciplinary provider (MDP) and offers other professional services, such as tax-planning, business consulting, and marketing, throughout its ninety-country network. Money For Justice: Plaintiffs' Lawyers And Social Justice Tort Litigation, Gilat J. Bachar

Tort lawsuits brought in response to social injustice occasionally generate incentives for entrepreneurial plaintiffs' lawyers to get involved in the litigation. What ethical responsibilities do such lawyers navigate in this space? And to what extent are they interested in, and well-positioned to produce, social change? The Article addresses these questions using a previously uncharted case study on civil actions for damages filed by Palestinians against the Israeli government. Through fifty-five in-depth, semi structured interviews with the various types of lawyers involved in the litigation, alongside quantitative analysis of an original dataset of 300 judicial opinions, the Article reveals how fee-for-service …
