Fighting The Hypothetical: Why Law Firms Should Rethink The Billable Hour In The Generative Ai Era, Nancy B. Rapoport, Joseph R. Tiano, Jr. Apr 2025

Fighting The Hypothetical: Why Law Firms Should Rethink The Billable Hour In The Generative Ai Era, Nancy B. Rapoport, Joseph R. Tiano, Jr.

Washington Journal of Law, Technology & Arts

“Fighting the Hypothetical: Why Law Firms Should Rethink the Billable Hour in the Generative AI Era” analyzes how the emergence and adoption of generative artificial intelligence (GenAI) will fundamentally disrupt the traditional billable hour model that has dominated the industry since the 1960s. Professor Rapoport and Mr. Tiano contend that GenAI’s ability to perform routine legal tasks quickly and accurately will force law firms to shift away from billing structures based primarily on time spent (or inputs) and toward models that better reflect client value (or outputs).

The authors interviewed law firm leaders to gain an “in the trenches” view …

In Memoriam Donald Leroy Garbrecht, Edward S. Godfrey Apr 2025

In Memoriam Donald Leroy Garbrecht, Edward S. Godfrey

Maine Law Review

The faculty of the reestablished University of Maine law school held its first meeting in Washington in May 1962, during the annual session of the American Law Institute. The first order of business included an interview with one Donald L. Garbrecht, who had been recommended to serve as assistant to the librarian, Dr. Arthur Pulling. After Don had successfully undergone an interview and we had voted—unanimously, for once—Dr. Pulling looked at us in the earnest way he had when he was enthusiastic about something and said, "He'll be fine!" His prophecy proved to be correct. It should be counted as …

The Soulful Lawyer: Jungian Practices For Legal Professionals, Luis Chiesa Apr 2025

The Soulful Lawyer: Jungian Practices For Legal Professionals, Luis Chiesa

Buffalo Law Review

The legal profession faces a profound crisis of meaning, with lawyers experiencing some of the highest rates of depression, anxiety, and substance abuse of any profession. While techniques like mindfulness meditation have gained traction as tools to address lawyer well-being, they often fall short of fostering the deeper sense of purpose and fulfillment that so many legal professionals seek. This Article explores how Jungian depth psychology and contemplative practices can address the root causes of dissatisfaction, or “dukkha,” within the legal profession. Drawing from Carl Jung’s concepts of persona, shadow, and collective unconscious, it examines how lawyers can unmask their …

Biglaw's Race Problem, Angela Onwuachi-Willig, Anthony V. Alfieri

Articles

Ever since the 1970s when BigLaw firms began to hire Black lawyers into their associate ranks, these firms have wrestled with problems in both recruiting and retaining Black associates. During the ensuing decades, BigLaw firms have minimally increased the low numbers of Black attorneys who have become partners, particularly equity partners, within their organizations. Numerous scholars have explored how racial bias and discrimination, both within BigLaw firms and greater society, have contributed to such failures in the recruitment, retention, and promotion of Black lawyers. In his new book The Black Ceiling: How Race Still Matters in the Elite Workplace, Professor …

Jerome Hall Law Library Expanding Partnership With Gpo To Preserve Government Information, James Owsley Boyd

Keep Up With the Latest News from the Law School (blog)

The Jerome Hall Law Library at the Indiana University Maurer School of Law is expanding its preservation of U.S. government documents in print, one of several dozen Federal Depository Libraries across the country stepping up to ensure public access to vital records of American history.

Of the more than 1,100 FDLs nationwide, only 63 serve as Preservation Stewards, a national program launched by the U.S. Government Publishing Office (GPO) in 2016 to support the long-term preservation of federal government publications. The Jerome Hall Law Library is one of them.

“We were eager to contribute to preserving legacy print collections that …

Admissions And Outcomes: Evaluating The Predictive Power Of The Lsat And Ugpa, Lindsey Mcmonigal Apr 2025

Admissions And Outcomes: Evaluating The Predictive Power Of The Lsat And Ugpa, Lindsey Mcmonigal

Political Science Theses and Capstones

Law schools have long relied on Law School Admission Test (LSAT) scores and undergraduate GPAs to predict student success, but the effectiveness and fairness of these metrics remain debated. This study examines whether LSAT scores and UGPA accurately predict bar passage and employment outcomes, analyzing data from the American Bar Association’s Required Disclosures for 197 U.S. law schools. Using statistical methods, including correlation and regression analysis, findings reveal that LSAT scores are a stronger predictor of bar passage than UGPA, while financial aid significantly reduces first-year academic attrition. Additionally, law schools with lower acceptance rates tend to produce better employment …

Think, Reflect, Refine: Shaping The Modern Lawyer, Camesha Little

University of the District of Columbia Law Review

Modern law students are entering the profession during an era when our society is fraught with many atrocities. These societal challenges come at a time when students are increasingly engaged in more social advocacy. Modern law students are also coming into legal training with skills and resources different from those of generations in the past. Additionally, almost daily, our newsfeeds are littered with headlines about the benefits, challenges, and fears of integrating generative artificial intelligence (“AI”) into our world. The legal system is not immune to this conversation. There have been discussions about how generative AI, such as ChatGPT, will …

What follows are real-world experiences my fellow editors at Litigation journal shared with me. As much as misery loves company, we litigators love war stories more and, boy, do we have some! They show us that, when faced with unexpected catastrophes, we have only one option: Get to work. Do the math. Solve the problem. And then solve the next one.

Legal Market Decartelization, Milan Markovic, Nuno Garoupa Apr 2025

Legal Market Decartelization, Milan Markovic, Nuno Garoupa

Faculty Scholarship

American lawyers’ grip on the legal market is receding. Scholars and policymakers increasingly agree that the public has little to lose and potentially much to gain from legal market decartelization - the weakening of the lawyers’ monopoly over the legal services market. Harkening to deregulatory initiatives abroad and in Arizona and Utah, reformers contend that removing restrictions on the corporate delivery of legal services and unauthorized practice of law will slash costs and expand access to justice.

Drawing on economic theory and recent market developments, this Article offers a cautionary rejoinder. Understandable concerns about cartelization and lawyer rent-seeking have led …
