Dewasa ini masih banyak yayasan yang telah ada sebelum berakunya Undang-Undang Yayasan melakukan kegiatan usahanya tanpa melakukan penyesuaian anggaran dasar dengan Undang-Undang Yayasan, sedangkan Pasal 71 Undang-Undang Yayasan mengamanatkan agar yayasan-yayasan tersebut melakukan penyesuaian Anggaran Dasar untuk dapat menggunakan kata “Yayasan” di depan namanya dengan batas waktu yang telah ditentukan. Permasalahan yang akan dibahas adalah mengenai keabsahan akta sewa menyewa, dimana sewa menyewa tersebut dilakukan oleh indivisu sebagai pihak yang menyewakan objek sewa dan Yayasan yang telah ada sebelum diberlakukannya Undang-Undang Yayasan namun belum melakukan penyesuaian Anggaran Dasar sebagai pihak penyewa. Tesis ini membahas mengenai perjanjian sewa menyewa gudang yang dilaksanakan secara lisan yang terjadi di Kota Mempawah. Melakukan perjanjian secara lisan merupakan kebiasaan masyarakat di daerah tersebut dikarenakan mereka mengutamakan kepercayaan terhadap sesamanya. Permasalahan yang diangkat dalam tesis ini adalah legalitas dan pembuktian dari perjanjian sewa menyewa gudang yang dilakukan secara lisan, implikasi hukum terhadap status keberadaan barang milik tergugat yang masih berada di gudang meskipun telah melakukan wanprestasi dengan tidak membayar uang sewa, dan perlindungan hukum seperti apa yang dapat diberikan kepada para pihak. Setiap orang mempunyai kebebasan dalam membuat wasiat karena hal tersebut merupakan kehendak terakhirnya yang terjadi terhadap harta peninggalan miliknya setelah ia meninggal dunia. Pada prakteknya, masih ditemukan akta wasiat yang isinya melanggar bagian mutlak (legitieme portie) ahli waris legitimaris. Tesis ini membahas mengenai akibat hukum dan pertanggungjawaban Notaris yang berkaitan dengan pembuatan akta yang melangfar bagian mutlak (legitieme portie) dalam Putusan Mahkamah Agung Republik Indonesia Nomor: 3445/K/Pdt/2018. Limited Scope Lottery: Playing The Odds On Your Ability To Withdraw, Lianne S. Pinchuk

Limited scope representation, also called unbundled representation, has become widespread and widely used over the past three decades. While the American Bar Association has amended its model rules to expressly permit such representation, it failed to amend its model rules governing withdrawal. Some states have been more proactive than others in confronting potential withdrawal issues in limited scope representation. Those states that have attempted to remedy the withdrawal/termination issues have created specific rules governing limited scope engagements allowing for easier withdrawal by attorneys in such matters. Throughout U.S. legal education’s history, a small number of elite law schools have produced the vast majority of law professors. Although law professor hiring is now more inclusive in certain respects, the law school an aspiring professor attended continues to serve as a powerful predictor of hiring market success. Some scholars have maintained that this preference for graduates of elite law schools infects legal education with class bias and distorts legal pedagogy, but the absence of reliable data on socioeconomic diversity within law schools has muted these criticisms.

A law firm that enters into a contingency arrangement provides the client with more than just its attorneys' labor. It also provides a form of financing, because the firm will be paid (if at all) only after the litigation ends; and insurance, because if the litigation results in a low recovery (or no recovery at all), the firm will absorb the direct and indirect costs of the litigation. Courts and markets routinely pay for these types of risk-bearing services through a range of mechanisms, including state fee shifting statutes, contingent percentage fees, common-fund awards, alternative fee arrangements, and third-party litigation …

The Boston University Center for Antiracist Research (the “Center”) is a nonpartisan, nonprofit university-based research institution that convenes researchers, scholars, and policy experts across disciplines to find novel and practical ways to understand, explain, and solve seemingly intractable problems of racial injustice and inequity. The Center’s interest in this case arises from its expertise in researching and understanding the harms of policies, practices, and actions that produce and sustain racial inequities, and in advancing antiracist alternatives that promote racial equity.

Rules Versus Standards: A Moral Inquiry Into Washington's Character & Fitness Hearing Process, Jennifer Aronson

Historically, moral character inquiries within the state bar admission process have led to the exclusion of diverse and important voices from the legal profession, both consequentially and at times by design. Washington does not keep statistics on the race, ethnicity, gender, or economic class of bar applicants who are referred to character and fitness hearings, nor on the outcomes of those hearings. Examining how implicit bias and disparate outcomes interact in other areas of discretionary adjudicative decision-making illustrates the potential impact that the character and fitness process has on underrepresented communities in the legal profession.

In 2009, Korea implemented a law school educational system, which not only changed the legal education system, but the legal landscape as a whole. This has led to rapid growth in the number of attorneys. Although the increased number of attorneys has resulted in lower barriers to accessing justice, it has also brought the unintended consequence of cut-throat competition. The field of compliance has exploded in interest, attention, and growth over recent years. It has emerged as a popular career path for those trained in the law, giving rise to an influx of job opportunities for new law school graduates and seasoned attorneys alike. President Trump’s administration has persistently challenged the legitimacy of the Department of Justice (“DOJ”). In the past, DOJ, like other governmental institutions, has been fairly resilient. Informal norms and practices have served to preserve its proper functioning, even under pressure. The strain of the past three years, however, has been different in kind and scale. This Article offers a typology of different roles for DOJ lawyers and argues that over time the institution has evolved by allocating different functions and responsibilities to different positions within DOJ. Kosovo's Controversial 100 Percent Tariff: An Analysis Of Its Imposition And The Issues Bleeding Into The Conflict Between Kosovo And Serbia, Ernira Mehmetaj

On November 6, 2018, Kosovo imposed a 10 percent tariff on products imported from Serbia and Bosnia and Herzegovina. Later that month, on November 28, 2018, after Kosovo was denied membership in the International Criminal Police Organization, Kosovo increased the custom tariffs on Serbian and Bosnian goods from 10 to 100 percent. These actions resulted in a standstill of the European Union–mandated Belgrade-Pristina dialogue—a dialogue seeking to normalize the relations between the two states. Having the tumultuous history shared by Kosovo and Serbia as a backdrop, this Note analyzes the international agreements Kosovo is party to, specifically the Central European …

The leading edge of legal scholarship and practice in recent decades has evinced a commitment to progressive politics at the expense of constitutional governance, the rule of law, and justice understood as vindication of the reasonable expectations of both the public and the parties to any given case or controversy. This article argues that renewed understanding of the virtue of humility, rooted in a genuine concern to do good according to one’s abilities, rights, and duties, is essential to the maintenance of decency in the legal profession and society as a whole.
