To Outgrow A Mockingbird: Confronting Our History—As Well As Our Fictions—About Indigent Defense In The Deep South, Sarah Gerwig-Moore

To Kill a Mockingbird occupies a beloved space in law school classrooms and curricula, especially in its portrayal of Atticus Finch. Frequently held up as the model or “hero-lawyer,” Atticus’s character is powerful in fiction, but problematic in practice. His work is lauded, rather than scrutinized, despite his questionable ability to represent his client in life-or-death circumstances—specifically, a racially charged sexual assault case in the Deep South. Through considering examples of historical lawyers and texts which explore similar themes without the lens of fiction, those engaged in legal education and legal practice can and should look to others to study …

Social activism, particularly law reform, has long been an accepted, even revered part of the lawyer’s identity. But modern developments such as nation-wide firms, the economic importance of client development, and aggressive attempts by clients to deploy attorneys as de facto, undisclosed lobbyists have put substantial pressure on the traditional vision of the attorney as a “lawyer-statesman” or someone who “checks clients at the door” when participating in law reform activities. Should Judges Have A Duty Of Tech Competence?, John G. Browning

In an era in which lawyers are increasingly held to a higher standard of “tech competence” in their representation of clients, shouldn’t we similarly require judges to be conversant in relevant technology? Using real world examples of judicial missteps with or refusal to use technology, and drawn from actual cases and judicial disciplinary proceedings, this Article argues that in today’s Digital Age, judicial technological competence is necessary. At a time when courts themselves have proven vulnerable to cyberattacks, and when courts routinely tackle technology related issues like data privacy and the admissibility of digital evidence, Luddite judges are relics that …

Brady v. Maryland imposes a disclosure obligation on the prosecutor and, for this
reason, is understood to burden the prosecutor. This Article asks whether Brady also
benefits the prosecutor, and if so, how and to what extent does it accomplish this?
This Article first considers Brady’s structural impact—how the case influenced
broader dynamics of litigation. Before Brady, legislative reform transformed civil
and criminal litigation by providing pretrial information to civil defendants but not
to criminal defendants. Did this disparate treatment comport with due process?

Complicity In The Perversion Of Justice: The Role Of Lawyers In Eroding The Rule Of Law In The Third Reich, Cynthia Fountaine

A fundamental tenet of the legal profession is that lawyers and judges are uniquely responsible—individually and collectively—for protecting the Rule of Law. This Article considers the failings of the legal profession in living up to that responsibility during Germany’s Third Reich. The incremental steps used by the Nazis to gain control of the German legal system—beginning as early as 1920 when the Nazi Party adopted a party platform that included a plan for a new legal system—turned the legal system on its head and destroyed the Rule of Law. Ethical Issues With Lawyers Openly Carrying Firearms, Dru Stevenson

Ethical concerns arise when lawyers openly carry firearms to adversarial meetings related to representation, such as depositions and settlement negotiations. Visible firearms introduce an element of intimidation, or at least the potential for misunderstandings and escalation of conflicts. The adverse effects of openly carried firearms can impact opposing parties, opposing counsel, the lawyer’s potential clients, witnesses, and even judges and jurors encountered outside the courtroom. The ABA’s Model Rules of Professional Conduct in their current form include provisions that could be applicable, such as rules against coercion and intimidation, but there is no explicit reference to firearms. The Emerging Legal Architecture For Social Justice, Luz E. Herrera, Louise G. Trubek

Lawyers advocating for social change are now front and center in newspapers and social media. This article discusses how a new breed of progressive lawyers envision social justice law practice today. These “critical lawyers” are diverse in background, gender, ethnicity and race. They see law as a complex, contradictory tool rather than a necessary and sufficient route to justice. Their practices differ from the traditional non-profit public interest firms of the earlier generation that assumed justice would result if law and lawyers were accessible. Penelitian membahas mengenai implikasi yuridis terhadap akta yang dibuat berdasarkan keputusan sirkuler yang cacat hukum dalam Studi Kasus Putusan Pengadilan Tata Usaha Negara DKI Jakarta Nomor 105/G/2019/PTUN-JKT. Harta benda dalam perkawinan dibagi menjadi dua bagian yaitu harta bersama dan harta pribadi. Harta bersama adalah harta yang diperoleh dalam masa perkawinan tanpa mempermasalahkan siapa yang memperoleh barang tersebut. Apabila terdapat pihak yang ingin melakukan tindakan hukum atas harta bersama tersebut, baik oleh suami maupun istri, maka ia haruslah mendapatkan persetujuan dari pasangannya sebagaimana diatur dalam Pasal 36 ayat (1) Undang-Undang Nomor 1 Tahun 1974 tentang Perkawinan (“UU 1/1974”). Namun, tidak terdapat ketentuan lebih rinci yang mengatur sejauh apa persetujuan pasangan harus disyaratkan. Jurnal ini membahas mengenai implikasi yuridis terhadap Pejabat Pembuat Akta Tanah (PPAT) yang lalai dalam menjalankan kewenangannya. PPAT saat pembuatan akta hibah tidak mengumpulkan dokumen identitas salah satu pihak dengan lengkap dan hal tersebut menyebabkan kebatalan akta hibah tanah Warga Negara Asing. Adapun permasalahan yang diangkat dalam penelitian ini meliputi akibat hukum atas kelalaian PPAT dalam membuat akta hibah tanah hak milik dari Warga Negara Indonesia kepada Warga Negara Asing. Penelitian ini membahas mengenai pemenuhan prinsip kehati-hatian terhadap tindakan penggunaan cip RFID yang terdapat pada KTP Elektronik sebagai tindakan untuk menanggulangi penggunaan identitas palsu pada saat pengenalan penghadap di Notaris, agar menjawab permasalahan tersebut digunakan metode penelitian hukum normatif dengan pendekatan kualitatif dimana peneliti bertujuan untuk mengerti dan memahami gejala yang ditelitinya yang mana data yang diperoleh akan dibaca/ditafsirkan sendiri oleh penelitinya.
