Scholar, Father, And Friend: A Tribute To Professor Justice T. Modibo Ocran, Edward L. Gilbert
Scholar, Father, And Friend: A Tribute To Professor Justice T. Modibo Ocran, Edward L. Gilbert
Akron Law Review
Last November, the Akron community lost a dear friend. For twenty years, he was a faculty member at the University of Akron School of Law, teaching students the intricacies of international and corporate law. His name was Tawia Modibo Ocran, and he was one of the smartest men I have ever met. Born and educated in Ghana, Professor Ocran brought to the classroom a unique perspective; he inspired generations of students with his real-life experiences and understanding of international global issues. He had an impressive, detailed knowledge of international issues and never ceased to amaze me with his ability to …
Professional Responsibility In An Uncertain Profession: Legal Ethics In China, Judith A. Mcmorrow
Professional Responsibility In An Uncertain Profession: Legal Ethics In China, Judith A. Mcmorrow
Akron Law Review
This essay starts with two simple questions: Why do law schools in China have so little discussion of legal ethics? Why do students not press or seek more discussion of this topic? The essay then looks at the creation of norms of legal ethics from a topdown perspective and the inadequacy of that approach. Both a bottomup and top-down examination identify the tremendous challenges facing the Chinese emerging legal culture in building a coherent model of lawyering that can serve as the foundation for a system of legal ethics. This essay is intended as a contribution to the growing English …

The Akron Law School: The Early History Of The University Of Akron School Of Law: 1921-1959, Margaret E. Matejkovic, Richard L. Aynes
Akron Law Review
This short sketch is designed to tell the history of the school with special attention to those aspects which will preserve its rich history and help its faculty, students, and alumni understand its traditions and mission. What follows is a history of the school from its founding in 1921 until its merger with The University of Akron in 1959. An online inventory lists all the graduates during that time period along with as much biographical data as we were able to find. The vignettes in the materials below are based upon the individuals for whom we could find data. We …
The Need For Prompt Action To Revise American Law Schools, Richard A. Westin
The Need For Prompt Action To Revise American Law Schools, Richard A. Westin
Akron Law Review
American law students are in a crisis. The ghost fishing crisis was cured when the law required that the lobster trap’s door eventually open, thanks to biodegradable metal hinges or gates. Unfortunately, there is no such relief for the glut of law students. The ABA Journal reports that 85% of graduates from accredited law schools in 2010 were burdened with debts averaging $98,500, but they are graduating into a weak economy where their prospects for employment have narrowed greatly. Students in previous classes have far from been absorbed into the legal industry and classes behind them promise a continuing flow …

What It Means To Be A Lawyer In These Uncertain Times: Some Thoughts On Ethical Participation In The Legal Education Industry, Susan Carle
Akron Law Review
I will first take a quick look in Part II at the basic data regarding employment statistics for recent law school graduates. This is the primary source of concern cited by those who argue that legal education is in profound crisis. What those statistics show, in a nutshell, is that large law firm hiring is down, but that small firm hiring is up by even more significant amounts, and that salaries for employed graduates continue to rise. What also continues to rise is the new law graduate unemployment rate, though not by the exaggerated dimensions some reports imply. New lawyers …
Law Schools And The Legal Profession: A Way Forward, Peter A. Joy
Law Schools And The Legal Profession: A Way Forward, Peter A. Joy
Akron Law Review
This essay proceeds in four parts. Part II briefly examines the disengagement of law schools from the legal profession both in much of the scholarship produced and through courses required for graduation. Part III analyzes why some state bar regulators are imposing admission requirements in response to law schools failing to prepare students better for the practice of law. Part IV discusses the types of bar admission requirements being considered. Finally, in Part V, I argue that rather than being reactive and resistant to change, law schools should be forward looking and incorporate changes that will not only better prepare …

Peacemaking And Provocation: A Response To Professor Tracey Jean Boisseau, Dan Subotnik
Akron Law Review
I will show in this response a psychological link between what the academics did in the Duke Lacrosse case and the very circumstances they and Professor Boisseau decry.

The Duke Rape Case Five Years Later: Lessons For The Academy, The Media, And The Criminal Justice System, Dan Subotnik
Akron Law Review
The time that has since passed allows for a more comprehensive evaluation of the cultural meaning of the Duke Rape case. This is the goal of the newly released “Institutional Failures,” which constitutes a point of departure for this review. The aim of this article is first to clarify the contribution this book makes to an understanding of the case. I will describe and analyze the content of the nine essays that make up the book; I will make reference to related works, and I will offer a concluding evaluation of the book’s likely impact.
The Changing Face Of Legal Education: Its Impact On What It Means To Be A Lawyer, Thomas D. Morgan
The Changing Face Of Legal Education: Its Impact On What It Means To Be A Lawyer, Thomas D. Morgan
Akron Law Review
I have written a book called The Vanishing American Lawyer. My premise is not that too few people have a legal education. I say, instead, that what people now do with legal training is changing rapidly and likely will continue to become more diverse. That leaves me suggesting that there is little left to the general concept of being a lawyer. Yet people still talk about lawyers, and the question of what it means to be a lawyer is especially timely in light of current American Bar Association efforts to revise the standards by which American law schools are accredited. …

Ferguson, The Rebellious Law Professor, And The Neoliberal University, Harold A. Mcdougall Iii
Ferguson, The Rebellious Law Professor, And The Neoliberal University, Harold A. Mcdougall Iii
School of Law Faculty Publications
Neoliberalism, a business-oriented ideology promoting corporatism, profit-seeking, and elite management, has found its way into the modern American university. As neoliberal ideology envelops university campuses, the idea of law professors as learned academicians and advisors to students as citizens in training, has given way to the concept of professors as brokers of marketable skills with students as consumers. In a legal setting, this concept pushes law students to view their education not as a means to contribute to society and the professional field, but rather as a means to make money. These developments are especially problematic for minority students and …
School Bullying Litigation: An Empirical Analysis Of The Case Law, Diane M. Holben, Perry A. Zirkel
School Bullying Litigation: An Empirical Analysis Of The Case Law, Diane M. Holben, Perry A. Zirkel
Akron Law Review
This study will analyze the case law specific to bullying in the public school context during a recent twenty-year period. More specifically, its scope will include the frequency and the outcomes of the liability and “free and appropriate public education” (“FAPE”) claims on a longitudinal basis. Part I of the article provides the context in terms of (a) the definition of bullying, and (b) the literature concerning the rate and effects of bullying as well as the extent of anti-bullying policies and practices at the school district and state levels. Part II provides the methodological information, including the scope of …

Promoting Clinical Legal Education And Democracy In India, Sital Kalantry
Promoting Clinical Legal Education And Democracy In India, Sital Kalantry
Cornell Law Faculty Publications
Clinical legal education emerged in the United States in the 1960s to give valuable skill-based instructions to law students while providing legal services to people who could not otherwise afford them. This essay proposes another reason why both Indian and American law schools should support the development of law clinics. Drawing on the works of John Dewey and Martha Nussbaum, I argue that clinical legal education promotes democracy. Both elite American and Indian universities are largely unrepresentative of the respective population demographics of their countries. In clinics, law students bridge this divide by undertaking representation for people from different racial, …

Is The Albert H Kritzer Database Telling Us More Than We Know?, Thomas Neumann
Pace International Law Review
This article is the first in a series of articles attempting to provide a geographical and temporal overview of the application practice of the United Nations Convention on Contracts for the International Sale of Goods (CISG). In this first article, the success of CISG is explored. The article develops the idea of using the Albert H. Kritzer Database to achieve an overview of the success of the Convention in practice. It is argued that the success of the Convention is useful to measure by its uniformity in practice, and therefore a set of criteria relating to the Convention’s application by …
