Constructing Modern-Day U.S. Legal Education With Rhetoric: Langdell, Ames, And The Scholar Model Of The Law Professor Persona, Carlo A. Pedrioli
Constructing Modern-Day U.S. Legal Education With Rhetoric: Langdell, Ames, And The Scholar Model Of The Law Professor Persona, Carlo A. Pedrioli
Faculty Scholarship
This article explains how lawyers like Christopher Columbus Langdell and James Barr Ames, a disciple of Langdell, employed rhetoric between 1870, when Langdell assumed the deanship at Harvard Law School, and 1920, when law had emerged as a credible academic field in the United States, to construct a persona, that of a scholar, appropriate for the law professor situated within the university. To do so, the article contextualizes the rhetoric with historical background on the law professor and legal education, draws upon rhetorical theory to give an overview of persona theory and persona analysis as a means of conducting the …

Teaching For Tomorrow: Utilizing Technology To Implement The Reforms Of Maccrate, Carnegie, And Best Practices, Stephen M. Johnson
Articles
Part II of this article examines the development of the Langdellian method of instruction and the criticisms to the approach that have culminated in the calls for reform by the ABA, Carnegie Foundation, and Clinical Legal Education Association. Part II continues by focusing on the reasons why technology should play a central role in implementing the reforms petitioned by those organizations. The rest of the article provides examples of how technology can facilitate some of those reforms. Part III focuses on reforming assessment, the instructional models, and the instructional materials used in the classroom. Finally, Part IV explores the value …
Teaching Professional Identity In Law School, Martin J. Katz
Teaching Professional Identity In Law School, Martin J. Katz
Sturm College of Law: Faculty Scholarship
Law schools are in the business of teaching students legal doctrine. Since the introduction of the case method at Harvard Law School in the late 1800s, law schools regularly have taught students how to find doctrine (research); how to identify doctrine (reading cases and other legal texts); how to understand doctrine (exploring the limits of legal texts, and applying rules from old texts to new facts); and how to critique doctrine (discussing whether a particular rule is a good one, based on the goals the rule might seek to accomplish). In more recent times, law schools’ stakeholders—including clients, firms, judges, …

Seeking Integrity: Learning Integratively From Classroom Controversy (With Patti Alleva), Patti Alleva, Laura L. Rovner
Sturm College of Law: Faculty Scholarship
The Carnegie Report* makes a compelling case that preparation for legal practice should involve learning experiences that help to integrate the three basic apprenticeships or dimensions of professional work — thinking, performing, and valuing like a lawyer. This challenge has not been ignored by the legal academy. In recent years especially, many law schools have attempted to foster learning experiences that integrate legal doctrine, lawyering skills, and professional values. These efforts span the spectrum from broad-based curricular change to the addition or revision of individual courses. Not to be overlooked, however, are the immediate integrative learning opportunities presented by unexpected …
Without Precedent: Legal Analysis In The Age Of Non-Judicial Dispute Resolution, Mark Edwin Burge
Without Precedent: Legal Analysis In The Age Of Non-Judicial Dispute Resolution, Mark Edwin Burge
Cardozo Journal of Conflict Resolution
For more than a century, the American system of legal education has predominantly emphasized the role of cases and judgemade law, but with the understanding that the craft of the lawmaking judge is constrained by the doctrine of stare decisis. This case-oriented approach to teaching law extends to statutes: students learn of the role of courts in interpreting and explaining statutes, making judicial construction of statutes part-and-parcel of statutory law. Thus, pervading the formative first year of law school is the assumption that the role of lawyers is principally to analyze what courts have done in the past in …

Law School Marketing And Legal Ethics, Ben L. Trachtenberg
Law School Marketing And Legal Ethics, Ben L. Trachtenberg

Law schools have misled prospective students for years about the value of legal education. In some cases, law school officials have engaged in outright deceit, knowingly spreading false information about their schools. More commonly, they have presented statistics — especially those concerning the employment outcomes of law graduates — in ways nearly guaranteed to confuse readers. These deceptions and sharp practices violate the norms of the legal profession, a profession that scrupulously regulates the advertising of legal services. The deceptions also violate ethical rules prohibiting lawyers from engaging in dishonesty, misrepresentation, and deceit. This article exposes how pitches aimed at …

Teaching Legal History In The Age Of Practical Legal Education, Douglas E. Abrams

Historian Henry Steele Commager said, “History is useful in the sense that art is useful--or music or poetry or flowers; perhaps even in the sense that religion and philosophy is useful .... For without these things life would be poorer and meaner.” For law students who anticipate a career representing private and public clients and participating in public discussion, however, study of legal history carries rewards beyond intellectual stimulation and personal satisfaction. Law students contemplating client representation should ponder Justice Holmes's advice that “[h]istory must be a part of the study [of law], because without it we cannot know the …

In Defense Of Scholars' Briefs: A Response To Richard Fallon, Amanda Frost
In Defense Of Scholars' Briefs: A Response To Richard Fallon, Amanda Frost
Scholarly Articles in Law Reviews & Journals
In a thoughtful and provocative essay, Richard Fallon criticizes law professors for lightly signing onto 'scholars’ briefs,' that is, amicus briefs filed on behalf of a group of law professors claiming expertise in the subject area. Fallon argues that law professors are constrained by the moral and ethical obligations of their profession from joining scholars’ briefs without first satisfying standards similar to those governing the production of scholarship, and thus he believes that law professors should abstain from adding their names to such briefs more often than they do now.
This response begins by describing the benefits of scholars’ briefs …

Despite law firms’ demand for first year associates who can work collaboratively, teamwork is infrequently taught in legal education. Law professors unfamiliar with teamwork theory and practice are unlikely to use teams to engage students in their learning. As a result, law schools continue to graduate students who are unfamiliar and uncomfortable with the concept of working in teams, particularly interdisciplinary teams.
This article focuses on the teamwork teaching methods we use in the interdisciplinary courses we teach at California Western. We first provide a rationale for teaching teamwork and a brief description of what professional graduate schools are currently …
Remedies Reveals The Seamless Web, Candace Kovacic-Fleischer
Remedies Reveals The Seamless Web, Candace Kovacic-Fleischer
Scholarly Articles in Law Reviews & Journals
INTRODUCTION: Remedies is a course that consolidates many of the concepts learned in the first year of law school and some from the second. A typical Remedies course will reintroduce principles from constitutional law, compare and contrast torts and contracts, and apply criminal concepts in civil contexts. Teaching Remedies can be both challenging and rewarding. Challenging because it crosses a wide variety of subject areas. Rewarding because it weaves a variety of subject areas into the "seamless web" of the law, eliciting from students an occasional "aha." Early classes in law school tend to separate courses into discrete subject areas, …
