Making Effective Use Of Practitioners' Briefs In The Law School Curriculum, Anna P. Hemingway
St. Thomas Law Review
This article argues that practitioners' briefs do have a place in the law school classroom. Part II of this article discusses the pedagogy behind using practitioners' briefs in the legal writing classroom. It demonstrates how using practitioners' briefs enriches lesson plans, heightens interest in the classroom, and helps students gain a richer appreciation for lawyers' goals when they write as advocates. Part III presents some different ways of using practitioners' briefs to teach persuasive writing. It examines how the author has used practitioners' briefs to teach persuasive writing of the statement of facts, point headings and summary of the argument. …

On-Line Legal Research Workshops, Frederick B. Jonassen

Like riding a bicycle, playing tennis, or driving a car, legal research is a skill, and like any other skill, it is learned by doing, and not by listening to a lecture. However, lectures are indispensable for introducing the skill. The mental processes applied in electronic legal research may differ from those applied to book legal research. But because both electronic and book research are skills, a guided workshop in electronic legal research may be based on similar principles to those underlying a workshop in book legal research, with appropriate modifications. The Excitement Of Interdictory Ideas: A Response To Professor Anders Walker, Marc O. Degirolami

Having canvassed admirably the historical changes to the criminal law case book over the twentieth century, Professor Anders Walker's article suggests that criminal law ought to concern itself with the business of training future prosecutors and defense attorneys by eliminating, or at least greatly reducing, the place of moral and political reflection in the course, which was in any event the supercilious indulgence of elite law schools that disprized criminal practice. Lawyering Outside Lawsuits: Incorporating Negotiations, Settlements, And Mediations Into The Legal Writing Curriculum, Olivia Farrar, A.G. Harmon

Legal education is built around a core irony: almost no human disputes are resolved via trials, and yet we dedicate years to teaching law students how to resolve disputes via litigation. To remedy this incongruity between legal education and the reality of lawyering, the two of us have begun integrating negotiations, settlements, and mediation into our 1L legal writing curriculum. This article describes why and how we have introduced our students to these non-litigation skill sets, starting to train them in what we believe may be their most powerful dispute resolution skills when they enter the legal world.

The carefully crafted parenthetical illustration can be a powerful tool in persuasive legal analysis. It can also reflect five areas of a student’s practice-ready skills. These skills include research, use of mandatory and persuasive authorities, rule synthesis and application, clarity and conciseness in writing, and citation form. The student who achieves competency not only in formatting citations but also in drafting clear, concise, illustrative parentheticals demonstrates an understanding of rule permutations. This competency can open doors for opportunities both within and outside law school. This paper examines the goals of law schools in their primary role of educating students, and the implications of the changing conditions in the legal and business world for these goals. Hereafter, unless otherwise indicated, "school(s)" will be used instead of "faculty(ies)". I would argue that there is no uniformity among law schools with regard to the purposes for which they educate students. The definition of a school's goals and objectives is influenced by factors peculiar to its own circumstances. Furthermore, the goals of a law school are potentially dynamic. The changing dynamics in the field of land use and sustainable community development law demand that land use law professors rethink the way in which we prepare law students to practice law in this area. This needed paradigm shift converges with the growing momentum of the best practices movement which urges law schools to dramatically revise the curricular approach to legal education, arguing that traditional models are no longer effectively serving the goal of producing competent and fully prepared new lawyers.
