Reports of burn-out, disillusionment, and stress abound in modern literature as the legal profession faces a period of rapid change and sobering self-reflection on the ways in which it should operate as an honorable and noble profession.
In a seemingly unrelated development, there is a steadily growing interest in the spirituality of modern professional life. As those in other fields have also grappled with both outward critique and inward self-reflection, the past several years have seen a renewed interest in the spiritual aspects of worldly occupations. As time goes on and interest in spirituality and professional life increases, the legal …

At a March 1999 Colloquium on Clinical Legal Education,1 a group of about 20 people, including a number of law faculty already teaching or planning to teach legal clinics in Central and Eastern Europe and the former Soviet Union , were asked, "What are the goals that you think are most important for a legal clinic?" The most common answers were teaching about ethics and improving the ethical standards of law practice in participants' respective countries through this focus in legal education.

Memorial: Nicholas Triffin (1942-2000), Marie Stefanini Newman
Elisabeth Haub School of Law Faculty Publications
Professor Nicholas Triffin, Director of the Pace University School of Law Library from 1984 until 1998, died on April 8, 2000, after a long and valiant battle against amyotrophic lateral sclerosis (Lou Gehrig's disease). During the eight years Nick fought this cruel disease, his body became increasingly frail, but his will to survive, his dedication to his students, and his love of the study of the law were undiminished. Nick continued to fulfill his personal and professional obligations with grace and dignity, and taught his last class just a few days before his death. It never occurred to him to …

Uncoupling The Law Of Takings, Michael A. Heller, James E. Krier
Law Quadrangle (formerly Law Quad Notes)
The following article is based on "Deterrence and Distribution in the Law of Takings," 112 Harvard Law Review 997-1025 (March 1999), © 1999 by the Harvard Law Review Association, and appears here by permission. A complete version, with citations, is available from the authors or the editor of Law Quadrangle Notes.
The law of takings couples together matters that should be treated independently. Whatever the boundaries of the the Takings Clause, we think there is much to be gained by analyzing takings in terms of the clause's underlying purposes, and by understanding that efficiency and justice are best served by …

Dna As Evidence: Viewing Science Through The Prism Of The Law, Peter Donnelly, Richard D. Friedman
Law Quadrangle (formerly Law Quad Notes)
DNA evidence has transformed the proof of identity in criminal litigation, but it has also introduced daunting problems of statistical analysis into the process. In this article, we analyze a problem related to DNA evidence that is likely to be of great and increasing significance in the near future. This is the problem of whether, and how, to present evidence that the suspect has been identified through a DNA database search. The following article is adapted from "DNA Database Searches and the Legal Consumption of Scientific Evidence," 97.4 Michigan Law Review 931-984 (1999), and appears here with permission of the …

"Johnny's In The Basement/Mixing Up His Medicine": Therapeutic Jurisprudence And Clinical Teaching, Keri K. Gould, Michael L. Perlin
Seattle University Law Review
Therapeutic jurisprudence (TJ) provides a new and exciting approach to clinical teaching. By incorporating TJ principles in both the classroom and out-of-classroom components of clinic courses, law professors can give students new and important insights into some of the most difficult problems regularly raised in clinical classes and practice settings. This Article will proceed in three sections. The first section briefly provides some background about TJ and how it has been employed to investigate other areas of the law. Then, the Article discusses some of the important new theoretical developments in clinical legal education, mostly from the "critical lawyering" perspective. …

The year 2000 marks the tenth anniversary of the 1990 passage of the Americans with Disabilities Act (“ADA”). It also marks a quarter century since the passage of the Education for All Handicapped Children Act (“EAHCA”). The EAHCA opened the doors for disabled children to receive a free and appropriate education. As a result of this special education law, many disabled young people were able to succeed and are now knocking at law schools' doors seeking admission.
On July 26, 1990, Congress enacted the ADA, a landmark civil rights bill designed to open up all aspects of American life to …

The MacCrate Report was published in 1992 and detailed the findings of a task force established by the American Bar Association. The purpose of the task force was to examine a perceived “gap” between legal education and law practice. The Report concluded that law schools needed to affirm their commitment to train students to practice effectively in the legal profession. This article analyzes the results of several surveys, each seeking to determine to what extent law schools provided Minnesota lawyers consistent training in the practice skills areas identified in the MacCrate Report. The findings discussed in this article were gleaned …

Working with citations is a fact of life on law journals. Because citation work is detail-oriented, requires great concentration, and is sometimes perceived as "drudge work,"' it often generates a high level of frustration among law review staff, editors, and authors.
This Article will address the primary frustrations suffered by each group and will propose solutions for alleviating those frustrations.
