Other firms have expressed their opposition to the admiration’s policy in various ways. After more than half a year, what lessons, if any, can be drawn from the bar's response to the Law Firm Intimidation Policy? Were predictions that the Administration's efforts would cause significant harm to the …

Is The Game Rigged? Why Sports Betting Is Becoming A Legal Time Bomb, Lawrence Kirzhner

Cardozo Arts & Entertainment Law Journal (AELJ) Blog

The International Olympic Committee defines “competition manipulation” as “when the result of a tournament or competition is partially or completely decided in advance and the match is played to ensure the pre-determined outcome.” Considering the Olympics hosts 43 sports, this definition can probably be applied to many, if not all, sports around the globe. While it is against the rules of sportsmanship as well as against the law, athletes “who bet on their sport might be tempted to fully or partially manipulate their competition in order to receive financial gain.” The sports world has experienced many scandals of manipulated competition …

As the Federal Arbitration Act (FAA) enters its second century, arbitration remains one of the most contested areas of modern dispute resolution. Praised for efficiency and accessibility, it is also challenged for issues of fairness, transparency, and equity. This year’s Melnick Symposium will explore how arbitration must evolve to meet the demands of justice in the decades ahead.

By addressing this theme, the Symposium seeks to imagine what the FAA’s next century should look like and how arbitration can become a more equitable, inclusive, and effective system of justice.

Administrative Variability & The Price Of Title Ix Compliance On Minority-Serving Institutions, Jacob Wall Nov 2025

Administrative Variability & The Price Of Title Ix Compliance On Minority-Serving Institutions, Jacob Wall

Cardozo Journal of Equal Rights and Social Justice (ERSJ) Blog

The Department of Education (“ED”) enforces civil rights in education through Title IX. Title IX prohibits sex-based discrimination in federally funded educational programs, and promotes inclusion in higher education.  Significantly, Title IX enforcement depends on the executive branch controlling the ED, as this power rests with both the Department of Justice and the ED’s Office for Civil Rights (OCR). Historically, judicial enforcement of statutes like Title IX relied on agency interpretation under Chevron U.S.A., Inc. v. Natural Resources Defense Council, Inc., which required judicial deference to executive agencies when statutes are ambiguous.  However, the Supreme Court’s 2024 decision in …

The Splintering Of “Catalyst Theory” In New York, Nancy Larcher

Cardozo Journal of Equal Rights and Social Justice (ERSJ) Blog

Some of the New York Supreme Court, Appellate Divisions are now recognizing “catalyst theory” as a part of the New York State Equal Access to Justice Act (“EAJA”). To preserve the intent of the EAJA, it is time for the Court of Appeals to decide in favor of catalyst theory for litigants. Recently, the New York Supreme Court, Appellate Division, Third Department ruled in favor of Peter Markey, a disabled Navy veteran who sued New York State after they denied him rental assistance. The EAJA allows for plaintiffs to obtain attorneys’ fees when they prevail in certain actions against New …
