If Men Were Angels: A Review, E. Blythe Stason Oct 1942

If Men Were Angels: A Review, E. Blythe Stason

Michigan Law Review

Occasionally one encounters a new book that is genuinely interesting because of the refreshing vigor with which it attacks an important and timely problem. Such a book is Jerome Frank's new volume, If Men Were Angels. Indeed in some of its chapters its vigor approaches violence, a fact which adds spice to the reading.

Michigan Legal Studies: A Review, Max Rheinstein Aug 1942

Michigan Legal Studies: A Review, Max Rheinstein

Michigan Law Review

To the knowledge of this reviewer, the relation between printers' wages and the development of the law has not yet been investigated. This problem is by no means so absurd as it may sound. The very principle of stare decisis presupposes the existence of the printing press, a high development of the art of indexing, a well-organized book trade and a price level under which reports and search books are accessible to the members of the legal profession. Treatises and other learned discussions cannot influence legal developments where printing costs are prohibitive. Yet, the extent to which a legal system …

Developments In The Conflict Of Laws, 1902-1942, Ernest G. Lorenzen

Michigan Law Review

The writer's interest in the conflict of laws coextends substantially with the life of the Michigan Law Review. This may be some excuse for attempting to trace some of the developments in this field in the intervening years. Let us consider first what has happened in this country and thereupon what has occurred in the rest of the world.

Wigmore On Evidence-A Review, John E. Tracy Dec 1940

Wigmore On Evidence-A Review, John E. Tracy

Michigan Law Review

In 1887 John Henry Wigmore graduated from Harvard Law School. Only four years later, in 1891, there came from his pen an article in the Harvard Law Review entitled "Nemo Tenetur Seipsum Prodere," which showed to the profession that there had arrived at the bar a writer who was not only a deep student of legal history and knew his law of evidence, but who had no hesitation in smashing images, regardless of how sacredly they had theretofore been worshiped.

The Proposed Four-Year Law Curriculum: A Dissenting Opinion, Philip Mechem May 1940

The Proposed Four-Year Law Curriculum: A Dissenting Opinion, Philip Mechem

Michigan Law Review

A conspicuous and very wholesome manifestation today in legal education is dissatisfaction with legal education. With education in general for that matter. Doubtless the dissatisfaction begins with the general and extends to the particular. The law teacher, that is, observes that the college graduate who comes to him can barely read and write the English language, is scarcely aware that there are any other languages, is wholly devoid of intellectual curiosity, wholly untrained in hard thinking, wholly uninformed about and uninterested in the ideas which make for or against civilization. It makes the law teacher think there must be something …

Dean Bates And The Michigan Law School, Edwin C. Goddard

Michigan Law Review

From its opening in October, 1859, the Law School of the University of Michigan has been fortunate in the continuity of the service of the members of its faculty. The original faculty consisted of that remarkable trio, James V. Campbell, Charles I. Walker and Thomas M. Cooley. Instruction was given by lecture, and almost continuously for twenty-five years those three continued to expound the principles of the law to the students who flocked to the school.

A Generation Of Law Teaching, Roscoe Pound

Michigan Law Review

Thirty-six years ago (September, 1903) as Dean Bates was taking up law teaching as Tappan Professor of Law at Michigan, I was delivering an inaugural lecture as Dean of the Law School of the University of Nebraska. In this generation of law teaching we have seen the academic law school rise to a commanding position in professional education, the law teacher gain a position among the leaders of the profession, the growth of co-operation between bar associations and the association of law teachers, the development of co-operation between bar examiners and the law schools, and general adoption by the profession …

A Comparison Of Continental And American Legal Education, Stefan Riesenfeld Nov 1937

A Comparison Of Continental And American Legal Education, Stefan Riesenfeld

Michigan Law Review

Legal education in the United States has become more and more a part of university education and the activity of the American university law school is a matter which invites comparison with the law schools of foreign universities. This is true particularly because the system of university legal education has recently also become a "problem" in this country. In 1930 Abraham Flexner published his instructive, but possibly not altogether unbiased, book on universities in which he pictured American, English and German universities. The author gave all his attention to the teaching of science, however, and did not discuss law schools, …
