Henry Moore Bates, Herbert W. Clark
Henry Moore Bates, Herbert W. Clark
Michigan Law Review
There are people to whom any sense of fitness would assign a long life. Henry Moore Bates is one of these. In full vigor of mind until the end and before any physical deterioration had occurred to render his days uncomfortable to himself or his family, he died April 15th, on the sixteenth day following his 80th birthday. At eight o'clock in the evening before he died he was in bouyant spirits, his humor was keen and kindly, as always; his laughter was young. Eight hours later the end came. He was unafraid. "When it (was) time for him to …

Michigan Law Review
It has been my uniform practice never to read from a manuscript or use notes when I am speaking to an audience, but in speaking of so old and dear a friend I feel a certain inhibition of emotion that stands in the way of an adequate oral speech. Moreover, when I think of Dean Bates' unswerving adherence to exact, accurate statement, his abhorrence of all exaggeration, of all overstatement, I feel that he would not be satisfied with one who followed the relatively loose method of oral statement instead of adhering to a carefully and meticulously prepared manuscript for …

Michigan Law Review
Oversized enrollment again characterizes the student body of the University of Michigan Law School for the year 1948-49. Somewhat reduced from last year's record of 1107 prospective lawyers, this year the William W. Cook Law Quadrangle is accommodating 1057 future members of the bar. The beginning class of 426 students, together with 279 second year students, 339 seniors, 10 candidates for the graduate degrees, and 3 special students all add up to 1057 total. In the total are included 24 future Portias of the bar. These figures should be compared and contrasted with pre-war enrollments approximating 600-650 students. The demand …

This Issue Is Dedicated To The Late Professor Joseph Horace Drake, E. Blythe Stason
Michigan Law Review
To his colleagues on the law faculty, by whom Professor Drake was greatly beloved, he was known for his courteous and gentlemanly manners, his quiet but effective sense of humor, and his scholarly approach to all of the questions of the day. He never failed to see the bright and sunny side of the problems of the moment.

The academic year 1947-1948 opened with the largest student enrollment in the history of the University of Michigan Law School, overflowing the Law Quadrangle and making the year notable for large classes and keen competition. The 417 beginning students, 329 second-year students, 345 seniors, 10 candidates for advanced degrees in law, and 6 special students, all add up to a grand total of 1107 prospective lawyers. This figure compares with an enrollment of 956 at a corresponding time in the fall semester a year ago, and 641 in the pre-war year 1940-1941.

Model Probate Code And Monographs On Probate Law: A Review, Russell Denison Niles
Model Probate Code And Monographs On Probate Law: A Review, Russell Denison Niles
Michigan Law Review
The current volume in the Michigan Legal Studies, Problems in Probate Law: Model Probate Code, is an outstanding example of what can be achieved by the cooperation of a professional association and a well-financed and forward-looking law school. The Probate Division of the Section of Real Property, Probate and Trust Law of the American Bar Association initiated the project of preparing a model probate code and sponsored the project through to completion. The code is the Probate Division's proudest achievement. But the code would not have been possible without the Herculean labors of Professor Lewis M. Simes, Director of …

Corporations-Sale Of All Or Substantially All Of Corporate Assets-Effect Of Modern Statutes, P. F. Westbrook, Jr. S.Ed.
Michigan Law Review
Modern general corporation acts commonly provide that a sale of all or substantially all of the assets of a corporation organized thereunder may be authorized by the affirmative vote of a specified proportion of the outstanding shares and made upon such terms as the board of directors shall deem expedient and for the best interests of the corporation. Since this sale provision usually stands apart from the dissolution or winding-up process authorized in the same acts, a legislative intent to govern all voluntary sales, not actually incident to dissolution by the terms of the statute would seem to be clear. …

Clovis Bevilaqua And The Brazilian Civil Code, Anyda Marchant
Clovis Bevilaqua And The Brazilian Civil Code, Anyda Marchant
Michigan Law Review
Clovis Bevilaqua is a monument in the history of Brazilian law. His death on July 26, 1944, closed the door on an epoch. When he began his career in the eighties, Brazilian law, with the exception of the commercial code, was uncoordinated and outmoded. Now. Brazil is in a period of very active work on the recodification of its laws and their adaptation to the needs of modern life. Not all of this change is the work of one man, but Bevilaqua was the principal lingering representative, among the lawyers, of the intellectual movement that accompanied the setting up of …

Research In Inter-American Law At The University Of Michigan, Hessel E. Yntema
Michigan Law Review
In the Americas, the historic trade routes have run east and west, more than north and south. Geographic necessity has decreed that, subject to possible reorientation with the future development of aviation, the dominant factor influencing the course of commerce with this hemisphere should be the open sea. Westward across the Atlantic, came the explorers, the conquistadors, the pioneers, succeeded by wave after wave of immigration to the New World, seaborne on argosies that, laden with the fabulous spoils and profits of empire, returned to the homelands the tribute of the New to the Old World. Achievement in the Nineteenth …

Law Books Of The Year (1943-44), Hobart R. Coffey
Michigan Law Review
Contrary to my inclination and somewhat against my better judgment I have been prevailed upon by the editor to repeat the experiment begun last year, viz., to produce a sort of running account of some of the more important legal publications which have appeared in the last twelve months. It goes almost without saying that a competent review of a single serious work requires both considerable time and space. An adequate critical review of fifty or sixty works would be quite out of the question for anyone who had anything else to do. In my comments on the books which …
Civil Justice In Germany, Burke Shartel, Hans Julius Wolff
Civil Justice In Germany, Burke Shartel, Hans Julius Wolff
Michigan Law Review
Our aim in preparing this paper is to develop for American lawyers a picture of the functioning of German civil justice. This aim, as well as the paper itself, is an outgrowth of a series of lectures on the German legal system delivered by the authors as background in the law of military occupation for the Judge Advocate General's School of the United States Army in Ann Arbor. That part of these lectures which concerns the operation of German civil justice seems to us of sufficient intrinsic interest to warrant publication.
German Lawyers-Training And Functions, Burke Shartel, Hans Julius Wolff
German Lawyers-Training And Functions, Burke Shartel, Hans Julius Wolff
Michigan Law Review
Before Hitler, Germany took justifiable pride in the quality of its judiciary, its bar and its legally trained officials. Germany was a country where special training for civil, military, business, and professional functions was highly developed and where special qualifications were highly esteemed. The solid quality of all legal personnel was merely a consequence and manifestation in one sphere of a general stress on expertness which characterized all aspects of German life. The high standards of bench, bar and other legal personnel have, however, been largely broken down by the Hitler regime. This result has not ensued from an open …
The Law Books Of The Year, Hobart R. Coffey
The Law Books Of The Year, Hobart R. Coffey
Michigan Law Review
The war has had its effects on the law publishing business, with the result that the output has declined in both quantity and quality. Authors are doubtless turning their minds to other things, and publishers, quite understandably; may be reluctant to launch a new work. Whatever the reason may be, the law book crop for the academic year 1942-43 is rather meagre.
The Story Of A County Prosecutor: A Review, Henry M. Bates
The Story Of A County Prosecutor: A Review, Henry M. Bates
Michigan Law Review
During the later years of the last century the writing about law began to undergo a profound change. Generally speaking, prior to the period indicated it had been largely a statement of what the law was supposed to be as found in legislation and, in Anglo-American countries particularly, in the decisions and opinions of courts. Relatively, it was dogmatic, technical, often too general to be of much use in particular cases and gave a very imperfect picture of the law as actually administered.

Edwin C. Goddard, a professor emeritus of the University of Michigan Law School, died in Ann Arbor, after a brief illness, on Friday, August 14, 1942.
