Cash Deposits - Burdens And Barriers In Access To Utility Services, John B. Kirkwood

The utilities are free from statutory limitations on their deposit rules, practices differ, but most utilities use very broad criteria of income and net worth to select those consumers from whom they will demand a deposit. Under these broad deposit rules it is not surprising that the poor pay virtually all deposits, or that often high income residential areas are exempted altogether from the impact of cash deposits. Such rules impose severe burdens on depositors without proportionately benefitting the utilities, for deposits usually save utilities insignificant amounts of money. SOME years ago, in a paper entitled "The Problem of Social Cost," Professor Ronald Coase asserted and argued for a proposition which has since acquired the convenient sobriquet "the Coase Theorem." The proposition is: That in a world of perfect competition, perfect information, and zero transaction costs, the allocation of resources in the economy will be efficient and will be unaffected by legal rules regarding the initial impact of costs resulting from externalities. In this thesis I begin by examining the causes of the crisis as expounded in the current economic literature. This examination has led me to the conclusion that regulatory practice and policy has suffered from not being sufficiently economic in its orientation. If this point is correct, there remains an important subsidiary question: "What role, if any, should be played by the lawyer?"

The Disability Insurance Benefits Program And Low Income Claimants In Appalachia, James B. Haviland, Michael B. Glomb

West Virginia Law Review

This article discusses the difficulty substantial numbers of low income West Virginians encounter in establishing their eligibility for Disability Insurance Benefits under section 233 (d) of the Social Security Act. These persons are characteristically middle-aged, unskilled workers who lose their employment as the result of a mental or physical condition of a non-traumatic, chronic origin. Because of their medical condition, combined with their advancing age and lack of skills, these persons are "disabled", yet they are denied Disability Insurance Benefits. Marginal Cost Pricing, Investment Theory And Catv, Victor P. Goldberg

In his article, Marginal Cost Pricing, Investment Theory and CATV, James Ohls makes a number of erroneous assertions concerning the optimum pricing of CATV. Most of his problems stem from a failure to properly define the environment in which the optimum price is to be set and the role that an optimum price should play. If one alters Ohls' implicit (and sometimes contradictory) assumptions and if one keeps in mind the purpose prices should serve in an economic system, a number of Ohls' conclusions are altered.
