Many legal scholars have critiqued the dominant law and economics paradigm. However, important work is all too often neglected because it is not popularized in an accessible form. This Article features experts who synthesize their key insights into memorable and concise vignettes. Our 11 Things project is inspired by the work of the Cambridge economist Ha-Joon Chang, who distilled many facets of his work into a book called 23 Things They Don’t Tell You About Capitalism. Scholars often complain that sellers use trademarks to manipulate consumer perception. This manipulation ostensibly harms consumers by limiting their ability to make informed choices. For example, holding other things constant, consumers spend more money on goods with a high-performance reputation. Critics characterize that result as wasteful, if not anticompetitive. But recent marketing research shows that trademarks with a high-performance reputation may sometimes influence perception to the benefit of the consumer.
A trademark with a high-performance reputation can deliver a performance-enhancing placebo effect. Research subjects perform better at physical and mental tasks when they prepare or play with a product bearing …

Over roughly the past four decades, government officials from around the world have been erecting a framework of economic governance with major – but under-appreciated – implications for intra-national inequality. The components of this framework are thousands of bilateral and multilateral treaties designed to protect international investment. In many jurisdictions, the treaties have been concluded without public awareness or scrutiny or even much discussion or analysis by government officials – including those officials responsible for negotiating the agreements(Poulsen 2015) – and without an adequate understanding of how these agreements could affect intra-national inequality. Securities Disclosure As Soundbite: The Case Of Ceo Pay Ratios, Steven A. Bank, George S. Georgiev

This Article analyzes the history, design, and effectiveness of the highly controversial CEO pay ratio disclosure rule, which went into effect in 2018. Based on a regulatory mandate contained in the Dodd-Frank Act of 2010, the rule requires public companies to disclose the ratio between CEO pay and median worker pay as part of their annual filings with the Securities and Exchange Commission (SEC). The seven-year rulemaking process was politically contentious and generated a level of public engagement that was virtually unprecedented in the long history of the SEC disclosure regime. The doctrine of contractual incapacity allows people with mental disabilities to avoid their contractual liability. Its underlying premise is that the law has an obligation to protect people with such disabilities both from themselves and from unscrupulous people who would take advantage of them; mental incapacity provides this protection by rendering certain contracts unenforceable. The Disability Rights Movement (“DRM”), however, has challenged such protective legal doctrines, as they rest on outmoded concepts about people with mental disabilities.

The Anonymity Heuristic: How Surnames Stop Identifying People When They Become Trademarks, Russell W. Jacobs

This Article explores the following question central to trademark law: if a homograph has both a surname and a trademark interpretation will consumers consider those interpretations as intrinsically overlapping or the surname and trademark as completely separate and unrelated words? While trademark jurisprudence typically has approached this question from a legal perspective or with assumptions about consumer behavior, this Article builds on the Law and Behavioral Science approach to legal scholarship by drawing from the fields of psychology, linguistics, economics, anthropology, sociology, and marketing.

The United States is currently confronting an access-to-healthcare crisis, which rural regions are experiencing at a disproportionate rate. Many commentators have touted telemedicine as a solution for the access-to-care issue. Telemedicine uses video and telecommunication technology to allow physicians to treat patients from distant locations and thus facilitates a more equal distribution of physicians throughout the United States.
Although the telemedicine industry is quickly growing, the corporate practice of medicine doctrine impedes the industry’s expansion and consequently obstructs a viable solution to the access-to-care crisis. Private Interests, Public Law, And Reconfigured Inequality In Modern Payment Card Networks, Stephen Wilks

This Article examines two phenomena contributing to the racial stratification of consumers in credit card markets. The first phenomenon pertains to the longstanding conflict between card issuers and merchants over payment processing cost allocation. If successful, First Amendment challenges to existing statutory surcharge bans will allow merchants to impose an additional fee when consumers use credit cards as a form of payment. The Article relies on the interplay between socioeconomic class and behavioral theory to suggest subsistence borrowers would be more likely to pay surcharge fees than wealthier consumers. Over the last forty years, legal theory and policy advice have come to draw heavily from an ‘evolutionary’ jurisprudence that explains legal transformation by drawing inspiration from the theoretical successes of Darwinian natural selection. This project seeks to enrich and critique this tradition using an analytical perspective that emphasizes the material consequences of concepts and ideas. Existing theories of legal evolution depend on a positivist epistemology that strictly distinguishes the objects of social life — interests, institutions, systems — from knowledge about those objects. The problems of American Indian poverty and reservation living conditions have inspired various explanations. One response advanced by some economists and commentators, which may be gaining traction within the Trump Administration, calls for the “privatization” of Indian lands. Proponents of this view contend that reservation poverty is rooted in the federal Indian trust arrangement, which preserves the tribal land base by limiting the marketability of lands within reservations. In order to maximize wealth on reservations, policymakers are advocating for measures that would promote the individuation and alienability of tribal lands, while diminishing federal and tribal oversight.

ปัจจุบันอุตสาหกรรมภาพยนตร์ถือเป็นอุตสาหกรรมขนาดใหญ่ที่สร้างรายได้และกระตุ้น เศรษฐกิจในระดับนานาชาติ ซึ่งประเทศไทยเองก็ได้รับผลกระทบจากขยายตัวอย่างต่อเนื่องของ อุตสาหกรรมภาพยนตร์เช่นกัน ดังนั้นการศึกษานี้ จึงมีวัตถุประสงค์เพื่อศึกษาด้านมาตรการส่งเสริม และสิทธิประโยชน์ของประเทศไทย ที่มอบให้กับภาพยนตร์ที่ได้รับอนุญาตให้เข้ามาถ่ายท าในประเทศ ไทยของกองถ่ายภาพยนตร์ต่างประเทศ ซึ่งส่งผลต่อการตัดสินใจเข้ามาลงทุนในระยะยาวของกองถ่าย ภาพยนตร์ต่างประเทศและนักลงทุน โดยเปรียบเทียบกับมาตรการส่งเสริมและสิทธิประโยชน์ของ ประเทศมาเลเซีย และประเทศสิงคโปร์ ในการศึกษาครั้งนี้ เป็นการรวบรวมข้อมูลและสรุปเกี่ยวกับ แนวทางปฏิบัติ ข้อก าหนด สิทธิที่ ได้รับ รวมทั้งประเด็นปัญหาที่ส าคัญ ได้แก่ ขั้นตอนที่ซับซ้อนและระยะเวลาที่ยาวนานในการติดต่อ ด าเนินการกับแต่ละหน่วยงาน นโยบายและมาตรการส่งเสริมที่มีในปัจจุบันไม่เพียงพอ นโยบายและ มาตรการส่งเสริมที่มีในปัจจุบันไม่ครอบคลุมอุตสาหกรรมภาพยนตร์และลิขสิทธิ์ในภาพยนตร์ที่ กระทบต่อการส่งเสริม ซึ่งปัญหาเหล่านี้ส่งผลต่อการตัดสินใจเข้ามาลงทุนถ่ายท าภาพยนตร์ ต่างประเทศเป็นอย่างมาก จากการศึกษาข้อมูลของประเทศมาเลเซียและประเทศสิงคโปร์ พบว่าทั้งสองประเทศมีมาตรการ ส่งเสริมฯ และสิทธิประโยชน์ที่มอบให้กับกองถ่ายภาพยนตร์ต่างประเทศและนักลงทุนหลายมาตรการ ซึ่งแต่ละมาตรการประสบความส าเร็จในการดึงดูดกองถ่ายภาพยนตร์ต่างประเทศและนักลงทุนเป็น อย่างมาก ดังนั้นประเทศไทยจึงน ามาตรการที่ประสบผลส าเร็จของทั้งสองประเทศ มาพัฒนาต่อยอด และปรับใช้เป็นแนวทางแก้ไขปัญหา ได้แก่ การปรับปรุงและจัดระเบียบโครงสร้างหน่วยงาน One Stop Service ให้มีประสิทธิภาพมากขึ้น การพิจารณาก าหนดมาตรการใหม่และเพิ่มเติมสิทธิ ประโยชน์ของมาตรการส่งเสริมฯ ที่มีอยู่ในปัจจุบัน การจัดตั้งกองทุนหรือให้การสนับสนุนเงินลงทุนใน การเข้ามาถ่ายท าภาพยนตร์และการพิจารณาลิขสิทธิ์ของภาพยนตร์ที่ส่งผลต่อการลงทุนถ่ายท าใน ประเทศไทย เพื่อเอื้อประโยชน์แก่กองถ่ายภาพยนตร์ต่างประเทศและนักลงทุน เป็นการดึงดูดการเข้า มาถ่ายท าภาพยนตร์ และป้องกันการเสียโอกาสที่กระทบต่อเศรษฐกิจของประเทศ นอกจากนี ้ควรเพิ่มความส าคัญด้านมาตรการส่งเสริมการถ่ายท าภาพยนตร์ต่างประเทศในประเทศไทย ทั ้งจาก หน่วยงานรัฐบาลและหน่วยงานเอกชน รัฐบาลควรให้ความสนับสนุนหน่วยงานเอกชนที่มีความเกี่ยวข้องกับการ เข้ามาถ่ายท าภาพยนตร์ของกองถ่ายภาพยนตร์ต่างประเทศและนักลงทุน และส่งเสริมการประชาสัมพันธ์ ภาพลักษณ์ของประเทศและข้อมูลที่ส าคัญแก่กองถ่ายภาพยนตร์ต่างประเทศ นักลงทุน และผู้ที่สนใจ เพื่อให้ ประเทศไทยเป็นประเทศแนวหน้าในการเป็นสถานที่ถ่ายท าและลงทุนด้านภาพยนตร์ซึ่งส่งผลต่อภาพลักษณ์ที่ดี และยังเป็นการกระตุ้นเศรษฐกิจของประเทศอีกด้วย

เอกัตศีกษาฉบับนี้มีวัตถุประสงค์เพื่อศึกษาหามาตรการทางกฎหมายที่เหมาะสมในการ ส่งเสริมเศรษฐกิจชุมชนในเขตเศรษฐกิจพิเศษของประเทศไทย ด้วยวิธีการศึกษาและวิจัยเชิงคุณภาพ โดยการรวบรวมข้อมูลเชิงเอกสารทั้งแบบปฐมภูมิและทุติยภูมิ เกี่ยวกับร่างพระราชบัญญัติเขต เศรษฐกิจพิเศษ พ.ศ. ... และประเด็นปัญหาเกี่ยวกับเศรษฐกิจชุมชน ความเป็นมา แนวคิด และ ตัวอย่างของเศรษฐกิจชุมชน มาตรการในการส่งเสริมเศรษฐกิจชุมชนในเขตเศรษฐกิจพิเศษของ สาธารณรัฐประชาชนจีน รวมทั้งปัญหาและผลกระทบของการไม่มีการส่งเสริมเศรษฐกิจชุมชนในเขต เศรษฐกิจพิเศษของไทย แล้วจึงได้น าข้อมูลที่ได้ศึกษามารวบรวม และวิเคราะห์ โดยการศึกษา มาตรการต่างๆ ในการส่งเสริมเศรษฐกิจชุมชนในเขตเศรษฐกิจพิเศษของสาธารณรัฐประชาชนจีน และน ามาตรการของสาธารณรัฐประชาชนจีนมาปรับใช้ให้เหมาะสมกับบริบทของประเทศไทย จากการศึกษาพบว่า “ร่างพระราชบัญญัติเขตเศรษฐกิจพิเศษ พ.ศ. ...” ที่รัฐบาลมีความ พยายามจะประกาศใช้ ถูกต่อต้านจากภาคประชาชนโดยเฉพาะคนในพื้นที่ สาเหตุมาจากการที่ ประชาชนในท้องถิ่นถูกริดรอนอำนาจและสิทธิในการจัดการทรัพยากรธรรมชาติและสิ่งแวดล้อม รวมถึงวิถีชีวิตความเป็นอยู่ของคนในชุมชน รวมถึงการที่ประชาชนไม่รู้สึกถึงการมีส่วนร่วมและการ เป็นเจ้าของ โดยมีประเด็นปัญหาที่สำคัญ 3 ประการคือ (1) ปัญหาจากการกำหนดนโยบายที่ไม่ได้ตั้ง ต้นจากชุมชน (2) ปัญหาจากการบริหารงานแบบรวมศูนย์อำนาจ ชุมชนไม่มีอำนาจการตัดสินใจ (3) ปัญหาจากการขาดการมีส่วนร่วมของประชาชนในพื้นที่ต่อการกำหนดนโยบายที่เป็นของตนเอง จากปัญหาที่กล่าวมานี้ทำให้กฎหมายเขตเศรษฐกิจพิเศษของประเทศไทยยังไม่ถูกประกาศใช้ โดยผลการศึกษาพบว่า สาธารณรัฐประชาชนจีนเป็นประเทศที่ประสบความสำเร็จในการ จัดตั้งเขตเศรษฐกิจพิเศษเป็นอย่างมาก โดยปัจจัยแห่งความสำเร็จ คือ (1) รัฐบาลมีนโยบายการ ดำเนินงานลักษณะจากล่างขึ้นบน (Top - Down) (2) มีรูปแบบการบริหารงานแบบกระจายอำนาจ (Decentalization) และ (3) มีนโยบายให้ชุมชนมีส่วนร่วมในการกำหนดนโยบายที่เป็นของตนเอง นอกจากนี้แล้ว ภายใต้กฎหมายเขตเศรษฐกิจพิเศษของสาธารณรัฐประชาชนจีนยังมีบทบัญญัติในการ คุ้มครองแรงงานในพื้นที่ รวมถึงมีมาตรการที่สามารถสร้างความเชื่อมโยงทางเศรษฐกิจระหว่าง เศรษฐกิจท้องถิ่นและเศรษฐกิจในประเทศได้เป็นอย่างดี จึงท าให้การส่งเสริมเศรษฐกิจชุมชนในเขต เศรษฐกิจพิเศษของสาธารณรัฐประชาชนจีนประสบความส าเร็จอย่างสวยงาม เมื่อเปรียบเทียบกับ ประเทศไทยแล้ว ผู้เขียนจึงได้เสนอแนวทางในการส่งเสริมเศรษฐกิจชุมชนในเขตเศรษฐกิจพิเศษของ ประเทศไทย โดยปรับเปลี่ยนมาตรการของรัฐ ดังนี้(1) กลไกในการกำหนดนโยบาย (2) กลไกในการ บริหารงาน (3) กลไกในการมีส่วนร่วมของชุมชน โดยรัฐบาลเป็นผู้ก ากับดูแล เพื่อช่วยลดการต่อต้าน จากภาคประชาชน และช่วยส่งเสริมให้เศรษฐกิจชุมชนในเขตเศรษฐกิจพิเศษประสบความส าเร็จ

Professor Sunstein (2017) discusses possible causes for and policy implications of the failure of nudges, with a special attention to defaults. Though he focuses on nudges that fail when they should succeed, Sunstein recognizes that some failures reveal that a nudge should not have been attempted to begin with. Nudges that fail, however, does not consider fully the relationship between the outcomes of nudging and their likely welfare effects, most notably neglecting the troubling case of nudges that succeed when they should fail. Canonical theories of law and economics predict that issuing firms in initial public offerings (IPOs) demand — and that competitive markets produce — a transaction structure that maximizes value to issuers. Yet, since 1980, corporate America has left approximately 19 cents of foregone proceeds on the table for every dollar it has raised in IPOs. Moreover, the standard IPO contract appears designed to exacerbate rather than resolve agency costs, information asymmetries, and other foreseeable causes of IPO underpricing. At less than a decade old, Bitcoin and other virtual currencies have had a major societal impact, and proven to be a unique payment systems challenge for law enforcement, financial regulatory authorities worldwide, and the investment community. Rapid introduction and diffusion of technological changes throughout society, such as the blockchain that serves as Bitcoin’s crypto-foundation, continue to exceed the ability of law and regulation to keep pace. การศึกษานี้มีจุดมุ่งหมายเพื่อศึกษาการแก้ไขปัญหาของประมวลรัษฎากรไทยในปัจจุบันที่ไม่มี ความยืดหยุ่นในหลักเกณฑ์ของการตัดจําหน่ายและการคํานวณค่าเสื่อมของสินทรัพย์ที่มีมูลค่าน้อย โดยศึกษาหลักเกณฑ์ในเรื่องดังกล่าวของกฎหมายของประเทศมาเลเซียและสิงคโปร์ ซึ่งมีการกําหนด ในกฎหมายอย่างชัดเจนและเป็นการช่วยลดภาระแก่ผู้ประกอบการในการปรับปรุงรายการเพื่อ คํานวณกําไรสุทธิในการเสียภาษีเงินได้นิติบุคคล อันสอดคล้องกับหลักการภาษีอากรที่ดีในเรื่อง ความ ยืดหยุ่นและหลักการบริหารที่ดี จากการศึกษาพบว่า ประมวลรัษฎากรไทยยึดถือในหลักกรรมสิทธิ์และหลักประโยชน์ใช้สอย เท่านั้น โดยยังไม่มีบทบัญญัติใดอนุโลมให้ปฏิบัติตามหลักการบัญชีที่รับรองทั่วไปในหลักความมี นัยสําคัญ จึงทําให้ยังมีประเด็นปัญหาที่สําคัญในการตัดจําหน่ายและคํานวณค่าเสื่อมราคาของ สินทรัพย์ที่มีมูลค่าน้อยอยู่ 3 ประการ คือ (1) ประมวลรัษฎากรไม่มีหลักเกณฑ์ข้อผ่อนปรนสําหรับ สินทรัพย์ที่มีมูลค่าน้อยเฉกเช่นเดียวกับหลักการบัญชีที่รับรองทั่วไป (2) แนวปฏิบัติของกรมสรรพากร ไม่สะท้อนความเป็นจริงของการมีอยู่ของทรัพย์สิน และ (3) ต้นทุนในการปรับปรุงรายการในการ คํานวณกําไรสุทธิเพื่อเสียภาษีตามเงื่อนไขการคํานวณกําไรสุทธิตามมาตรา 65 ตรี(รายจ่ายต้องห้าม) เกี่ยวกับรายจ่ายอันมีลักษณะเป็นการลงทุน อาจจะสูงเกินกว่าประโยชน์ที่จะได้รับจากการปฏิบัติให้ ถูกต้องตามประมวลรัษฎากร ซึ่งปัญหาทั้ง 3 ประการนี้ ถือเป็นการสร้างภาระเกินจําเป็นแก่ ผู้ประกอบการและยังไม่สอดคล้องกับหลักการภาษีอากรที่ดีอีกด้วย เมื่อเปรียบเทียบกับหลักการเกณฑ์การตัดจําหน่ายและการคํานวณค่าเสื่อมราคาของ สินทรัพย์ที่มีมูลค่าน้อยของประเทศมาเลเซียและสิงคโปร์ พบว่ากฎหมายของทั้ง 2 ประเทศมีการ กําหนดหลักเกณฑ์ในเรื่องดังกล่าวอย่างชัดเจน รวมทั้งมีตัวอย่างการคํานวณและใช้สิทธิอย่างละเอียด ซึ่งเป็นการช่วยอํานวยความสะดวกและเป็นทางเลือกให้แก่ผู้ประกอบการในการคํานวณและตัด จําหน่ายค่าเสื่อมราคาเป็นค่าใช้จ่ายทางภาษี ดังนั้น ประเทศไทยจึงควรนําแนวทางดังกล่าวมาปรับใช้ เพื่อเป็นการพัฒนาหลักเกณฑ์ในประมวลรัษฎากรไทยให้สอดคล้องกับหลักการภาษีอากรที่ดีและ อํานวยความสะดวกแก่ผู้ประกอบการ ผู้เขียนได้เสนอแนะแนวทางในการนําหลักเกณฑ์ของต่างประเทศมาปรับใช้ในประเทศไทย เพื่อแก้ปัญหาทั้ง 3 ประการที่กล่าวมาข้างต้น โดยผู้เขียนเห็นว่าวิธีการดังกล่าวมีความเหมาะสมและ ควรปรับปรุง สามารถประยุกต์ใช้กับประเทศไทยได้ ซึ่งจะทําให้เกิดความชัดเจนในประมวลรัษฎากร ไทย และเป็นการช่วยบรรเทาภาระภาษีแก่ผู้ประกอบการ อีกทั้งยังเป็นการส่งเสริมให้เกิดการลงทุนใน สินทรัพย์ใหม่ของกิจการ และช่วยให้กระแสเงินสดมีความคล่องตัวมากขึ้น

เอกัตศึกษานี้มีวัตถุประสงค์เพื่อศึกษามาตรการคุ้มครองผู้บริโภคในการใช้บริการธุรกิจรับส่ง พัสดุภัณฑ์โดยเอกชน เนื่องจากมาตรการคุ้มครองผู้บริโภคในการใช้บริการธุรกิจรับส่งพัสดุภัณฑ์ใน ปัจจุบันยังไม่มีกฎหมายใดเป็นการเฉพาะในการก ากับดูแลหรือควบคุมท าให้ผู้บริโภคเสียเปรียบและ ไม่ได้รับความเป็นธรรม จึงสมควรกำหนดแนวทางหรือบทบัญญัติของกฎหมายในการคุ้มครอง ผู้บริโภคในการใช้บริการธุรกิจรับส่งพัสดุภัณฑ์ การเปลี่ยนแปลงของพฤติกรรมผู้บริโภคจากในยุคดิจิทัล มีแนวโน้มการซื้อขายสินค้าและ บริการเปลี่ยนรูปแบบจากเดิมที่เป็นการซื้อขายแบบหน้าร้าน สู่ยุคการตลาดแบบออนไลน์ โดยการซื้อ สินค้าผ่าน แพลตฟอร์มออนไลน์ การขยายตัวของธุรกิจ e-Commerce ส่งผลให้ความต้องการ บริการ E-Logistics เพิ่มขึ้น มูลค่าการประกอบธุรกิจแบบการขายสินค้าหรือบริการไปยังผู้บริโภค โดยตรงมีมากขึ้น ส่งผลให้การจัดตั้งธุรกิจรับส่งพัสดุภัณฑ์มีการเติบโตเพิ่มขึ้นอย่างต่อเนื่อง แม้ว่าใน ปัจจุบัน ผู้ประกอบการแต่ละรายมีการแข่งขันกันในด้านราคาเพื่อดึงดูดผู้บริโภค ซึ่งอัตราค่าบริการ ขนส่งพัสดุโดยเฉลี่ยมีการปรับลดลงในแต่ละปี รวมถึงการแข่งขันกันด้านบริการและความรวดเร็วใน การจัดส่งพัสดุภัณฑ์ แต่ก็ยังปรากฏปัญหาของผู้บริโภคซึ่งมีการร้องทุกข์เกี่ยวกับการใช้บริการรับส่ง พัสดุภัณฑ์ต่อส านักงานคุ้มครองผู้บริโภคเพิ่มขึ้นในทุกปี และปัญหาอื่นๆขึ้นตามที่ปรากฏเป็นข่าวทาง สื่อต่างๆ จากผลการศึกษาพบว่าธุรกิจบริการรับส่งพัสดุภัณฑ์โดยเอกชนนั้น กฎหมายที่มีผลบังคับใช้ ในปัจจุบันไม่ได้ครอบคลุมถึงการกำกับดูแลกิจการซึ่งก าลังเติบโตขึ้นอย่างรวดเร็ว ผู้เขียนจึงศึกษา กฎหมายภายในประเทศเกี่ยวกับมาตรฐานการคุ้มครองผู้บริโภคเพื่อหาแนวทางที่เหมาะสม เพื่อกำหนดมาตรการทางกฎหมายที่เหมาะสมในการคุ้มครองผู้บริโภคในการใช้บริการรับส่ง พัสดุภัณฑ์โดยเอกชน ในลักษณะเป็นการป้องกันปัญหาและลดความเสี่ยงที่อาจถูกเอาเปรียบจาก ผู้ประกอบการ ผู้เขียนเสนอให้ การประกอบธุรกิจรับส่งพัสดุภัณฑ์โดยเอกชน อยู่ในการกำกับดูแลของ กระทรวงดิจิทัลเพื่อเศรษฐกิจและสังคมเป็นหน่วยงานหลัก และเสนอให้มีการแก้ไขเพิ่มเติม พระราชบัญญัติไปรษณีย์พ.ศ. 2477 ให้มีการก าหนดบทบัญญัติทางกฎหมายที่จะก ากับดูแลการ ดำเนินธุรกิจของผู้ประกอบการทั้งของรัฐเอกชนให้เป็นไปในแนวทางเดียวกัน

After Jeffrey Epstein committed suicide in jail, two judges allowed his accusers to speak in court. This article argues that the proceedings were inappropriate because the criminal case ends when the defendant dies. If the conviction and appeal are not final, there is no finding of guilt, and the defendant is still presumed innocent. Allowing accusers to speak at this time violates the principle of due process and threatens to undermine faith in judges and the criminal justice system in general. สังคมผู้สูงอายุเป็นหนึ่งในปัญหาที่ทุกประเทศทั่วโลกก าลังประสบปัญหาและต้องเตรียมมาตรการ เพื่อรองรับสถานการณ์ที่จะเกิดขึ้นกับสังคมผู้สูงอายุในอนาคต ประเทศไทยก็เป็นประเทศหนึ่งที่มีอัตราการ เพิ่มขึ้นของผู้สูงอายุอย่างต่อเนื่อง คาดการณ์กันว่าอีกประมาณ 20 ปีผู้สูงอายุของประเทศไทยจะมีอัตราส่วน ประมาณ 40 ท าให้ธุรกิจให้บริการดูแลผู้สูงอายุมีการเติบโตอย่างต่อเนื่อง อย่างไรก็ตามจากการศึกษาวิจัย พบว่ามาตรการทางกฎหมายในการควบคุมดูแลสถานประกอบการที่ให้บริการดูแลผู้สูงอายุยังไม่มีมาตรการ ทางกฎหมายที่มีความชัดเจนเพื่อให้ธุรกิจบริการดูแลผู้สูงอายุมีมาตรฐานและมีความปลอดภัยต่อผู้สูงอายุ เมื่อพิจารณาบทบัญญัติตามรัฐธรรมนูญแห่งราชอาณาจักรไทย พ.ศ. 2560 ได้ก าหนดมาตรการ ในการดูแลคุณภาพชีวิตของผู้สูงอายุไว้อย่างชัดเจน แต่เมื่อพิจารณาในการออกกฎหมาย หรือกฎระเบียบ ที่เกี่ยวข้องกับการควบคุมดูแลกิจการดูแลผู้สูงอายุของประเทศไทยยังพบว่าประเทศไทยยังต้องมีการบัญญัติ กฎหมายที่มีความเฉพาะเจาะจงในการควบคุมดูแลสถานประกอบการที่ให้บริการดูแลผู้สูงอายุดังนั้นงานวิจัย ฉบับนี้จึงเสนอให้มีการก าหนดนโยบายที่ชัดเจนในการควบคุมกิจการที่เกี่ยวข้องกับดูแลผู้สูงอายุทั้งในส่วน ของภาครัฐและภาคเอกชนโดยการก าหนดมาตรฐานกลางที่เกี่ยวข้องกับการดูแลผู้สูงอายุให้สถานประกอบการ ที่ประกอบธุรกิจต้องปฏิบัติตามและเป็นเงื่อนไขที่ส าคัญในการขออนุญาตประกอบธุรกิจรายการต่อใบอนุญาต โดยมุ่งเน้นที่การคุ้มครองสิทธิของผู้สูงอายุและการดูแลผู้สูงอายุให้มีความปลอดภัยและได้รับการดูแลในระดับ ที่มีมาตรฐานสากล รวมไปถึงการน ามาตรการที่ส่งเสริมธุรกิจการดูแลผู้สูงอายุให้ได้รับการรับรองและ สร้างความเชื่อมั่นส าหรับผู้ใช้บริการทั้งคนไทยและชาวต่างชาติเพื่อให้กิจการดูแลผู้สูงอายุในประเทศไทย มีประสิทธิภาพในการแบ่งเบาภาระกิจในการดูแลผู้สูงอายุและน ารายได้เข้าสู่ประเทศไทย เพื่อใช้ใน การแบ่งเบาภาระของรัฐในการดูแลผู้สูงอายุและพัฒนาระบบเศรษฐกิจไทยต่อไป

International investment disputes involving African states before the International Centre for Settlement of Investment Disputes (ICSID) have generated significant critical inquiry. Yet, accounts of their contribution to the development of international investment law as a result of these dispute are limited. This article addresses this gap. It examines the contribution of some of the high-profile ICSID disputes involving African states to the development of international investment law. Notwithstanding the charges against African States in ICSID, I contend that the involvement of African States in ICSID Disputes has contributed to the development of international investment law.
