The Legal Rights Of Nonsmokers In The Workplace, Raymond L. Paolella

Seattle University Law Review

This Article examines the legal rights of nonsmokers based upon the common law right to a safe workplace, federal and state laws protecting handicapped persons, other tort theories, various federal and state statutory provisions, administrative regulations, and local ordinances. Although strong emphasis is placed on the legal rights of nonsmokers in the workplace, the rights of nonsmokers in public places will also be discussed. The main focus is on Washington law; however, the common law and federal law theories discussed in this Article should be viable in many other jurisdictions throughout the United States.

Drug Testing: The Union Perspective, Susan L. Gragel

Journal of Law and Health

The rapid increase in employer-mandated drug testing for workers raises significant questions concerning individual privacy and liberty. Yet, drug testing questions are not limited to individual claims by affected employees. The sweeping move to test workers through urinalysis also presents serious issues for labor unions in the public and private sectors. The developing concerns and issues for labor organizations are outlined in this presentation.

For almost a quarter century following the great tide of New Deal social legislation, the federal government largely refrained from further efforts at direct regulation of the workplace. But certain intractable problems, like job safety, pension fund abuses, and race and sex discrimination in employment, kindled interest in additional federal controls. The result was a second wave of federal laws governing the employer-employee relationship - Title VII of the Civil Rights Act of 1964, the Occupational Safety and Health Act (OSHA) of 1970, and the Employee Retirement Income Security Act (ERISA) of 1974. Comments: Drug Testing Of Private Employees, Dean S. Landis

University of Baltimore Law Review

Many private employers have begun testing job applicants and employees for illegal drug use. This comment considers the reliability of the tests used, as well as the issues of privacy raised by their use. The author suggests that public policy disfavors the use of drug testing in the private public sector because of these reliability and privacy concerns. The author concludes with a discussion of common law causes of action that may be available to a private employee subjected to drug testing, including tortious invasion of privacy, defamation, and wrongful discharge.

A half century after the passage of the Wagner Act the right to bargain collectively remains a glowing but imperfectly realized promise for American workers. In recent years even the theoretical dimensions of the right have been markedly compressed. Yet collective bargaining was conceived in the widespread belief that both the cause of industrial peace and the welfare of the individual employee would be promoted if workers were given a genuine voice in determining their employment conditions. Why has the process apparently lost so much appeal? Does it still hold hope for the future?
