Federal Legislation: Title III, Congressional Findings of A 1982 Act To authorize the Secretary of the Interior to construct, operate, and maintain modifications of the existing Buffalo Bill Dam and Reservoir, Shoshone project, Pick-Sloan Missouri Basin program, Wyoming, and for other purposes, PL 97-293, 96 Stat. 1261, 1274 (Oct. 12, 1982). The Bureau of Reclamation shall deliver 27,000 acre feet annually of agricultural water to the San Xavier Reservation and improve and expand the existing irrigation system. The Bureau shall deliver 10,800 acre feet annually of agricultural water to the Schuk Toak District and design and construct an irrigation system …

Plaintiff bank, a Montana corporation doing business within the boundaries of the Blackfeet Reservation, sought possession of the collateral used to secure a loan on which defendants had defaulted. Basing its jurisdiction on the fact that all transactions at issue "arose upon and were to be performed within" the reservation, the court orders that plaintiff is entitled to recover the collateral but is not entitled to a deficiency judgment in excess of the collateral's value because the bank continued to loan money to the defendants despite knowledge of defendants' "financial disarray."

Enforcing The Federal-Indian Trust Relationship After Mitchell, Nell Jessup Newton

The Mitchell decision has been criticized appropriately as breaking with precedent on both Court of Claims jurisdiction and Indian trust law. Assuming this break with tradition was intentional, however, this article will focus on Mitchell's effects on breach of trust litigation in the Court of Claims and the federal district courts. To provide an understanding of the state of the law at the time Mitchell was decided, the article begins with a discussion of the influential breach of trust cases decided before Mitchell. Next, Justice Marshall's analysis in the majority opinion will be examined in fuller detail. The article will …

The final step in the evolution of Canada from colony to sovereign and independent state was taken on April 17, 1982, with the signing of the Constitution Act, 1982. I While the consequences for Canadian society generally of patriation of the Constitution and inclusion of a Charter of Rights and Freedoms are not to be underestimated, the effect on the aboriginal peoples of Canada could be much greater.
