This report, dated May 17 1983, also known as United States (US) Senate Report 98-126, was submitted by the US Senate Select Committee on Indian Affairs to accompany Senate Bill 727, "to authorize the Secretary of the Interior to set aside certain judgment funds of the Three Affiliated Tribes of Fort Berthold Reservation in North Dakota, and for other purposes." In the report, the committee recommends passage of the bill, with three amendments that are detailed in the report.

Since the implementation of the Act's fish protection provisions will undoubtedly affect the scope of protection provided to Indian tribes, the Act's ambiguities must be interpreted in a way that honors and preserves these reserved tribal rights. This article examines the substantial body of case law applicable to these reserved tribal rights, with particular attention to the major fish protection issues that may arise under the Act.

This monograph examines critically the various ways in which Commonwealth and American judges have dealt with the issue of the land rights of Aboriginal peoples in the past. It devotes particular attention to the doctrine of Aboriginal title developed by Chief Justice Marshall of the United States Supreme Court. The nature and legal basis of that doctrine are reviewed in detail, and the relevance of the doctrine to Canadian and Commonwealth jurisdictions is explored.

This memorandum confirms the receipt of the January 1983 report of Ward Alan Minge. The report refers to issues and encroachments regarding the eastern boundary area of Sandia Pueblo. The basic conclusion of Dr. Minge's report is that the Sandia Pueblo Grant, as surveyed under the auspices of the United States in 1859, was of such a nature as to deviate from the Spanish grant documents.
