THE Federal Courts have no common law criminal jurisdiction. The question was raised in the United States Circuit Court for the District of Pennsylvania, in 1798, in United States v. Worrall, 2 Dallas, 384, and the Court was equally divided in opinion. Iii 1818, Mr. Justice STORY, in United States v. Coolidge, 1 Gallison, 488, decided that there were common law offences against the United States. But this, as we shall see, was overruled by the Supreme Court. Handwritten draft letter written by Judge David McDonald to President Andrew Johnson, dated May 10, 1865. The letter discusses the treason case against William Bowles, Lambdin P. Milligan, and Stephen Horsey. McDonald urges President Johnson to set aside the scheduled execution of the three men until the United States Supreme Court had a chance to review the case. The Supreme Court ultimately set aside the convictions in the case titled Ex parte Milligan.

This is a modern account of the trial of Anne Hutchinson. Hutchinson was a midwife and healer, as well as a spiritual advisor in the Boston colony. She became embroiled in the Antinomian controversy, a religious schism that threatened to tear the colony apart. Hutchinson was arrested and charged with "transducing the ministers" and heresy. She was convicted and her family was banished from the colony in 1638. She and six members of her family were killed during Kieft's War several years later.
