Two Paths Of Criminal Law Reform: From Shared Colonial Legacies To Divergent Legal Trajectories In Indonesia And Malaysia, Ade Adhari, Charisse Evania Tansir

Despite sharing colonial legacies in the development of their criminal law systems, Indonesia and Malaysia have pursued markedly different paths of criminal law reform, reflecting their distinct legal traditions and legislative philosophies. This article examines how these divergent reform trajectories are manifested through a comparative analysis of Indonesia's Law Number 1 of 2023 on the Criminal Code and Malaysia's Penal Code (Act 574). Focusing on three analytical dimensions—the principle of legality, criminal responsibility, and sentencing policy—the study adopts a normative legal research method supported by statutory, conceptual, and comparative approaches. Revenge porn, which is the distribution of pornographic material without the victim's consent, is a serious and growing problem online. This practice is usually carried out by ex-partners in revenge, by distributing intimate images or videos of the victim to the internet. This research aims to identify the impact of revenge porn on victims, as well as assess the effectiveness of existing legal protection. The method used is a qualitative approach through literature study. Abstract. The increasing incidence of violence against children in daycare institutions reflects a structural crisis in contemporary child protection systems. This study examines the violence case at Little Aresha Daycare in Yogyakarta to identify the criminogenic factors underlying abuse in institutional childcare settings. The research applies a normative-empirical qualitative method through media-based case studies, legal analysis, and criminological interpretation. The findings demonstrate that violence emerged from the convergence of three major factors: structural strain experienced by caregivers, weak capable guardianship within daycare institutions, and the normalization of abusive disciplinary practices. Methamphetamine trafficking represents one of the most significant forms of transnational organised crime affecting Indonesia and appears to be facilitated by Indonesia’s strategic position within global maritime trade networks. This article examines how extractive development in Indonesia contributes to the criminalization of environmental defenders from a green criminology perspective. The study departs from the growing trend of intimidation, criminalization, violence, and legal retaliation experienced by communities resisting environmentally destructive projects in mining, coastal reclamation, plantation expansion, and National Strategic Projects (PSN). Under Article 1457 of the Indonesian Civil Code, a sale and purchase agreement creates reciprocal rights and obligations between the parties. In Indonesian land law practice, however, transactions involving customary land (tanah ulayat) present legal complexities due to its communal nature and governance by indigenous law communities, coupled with the absence of explicit regulation in the Civil Code and the plurality of customary law systems. The construction of sea barriers in several coastal waters has revealed the issuance of land titles within certain areas designated for such development, which were subsequently annulled due to procedural and substantive defects in their issuance. This phenomenon reflects administrative disorder in the management of coastal areas and poses a potential risk of state losses. This paper examines whether the Indonesian government's non-judicial settlement for addressing past gross human rights violations (PGHRV) offers redress for the victims of sexual violence of past human rights violations. Indonesia has grappled to address past human rights violations through formal justice mechanisms. There are about 12 unresolved cases, more than half of which concerning sexual violence during conflict. This paper combined a socio-legal approach with mixed methods to gather data on the issue PGHRV: desk research and interviews with key persons involved in the non-judicial mechanism. Rehabilitation Or Retribution? A Socio-Legal Comparison Of Criminal Sanctions And Social Reintegration In Indonesia And Spain, Ridwan Arifin, Izan Mateo Cassandro
The Indonesian Journal of Socio-Legal Studies
This study examines the legal, institutional, and socio-cultural mechanisms influencing the social reintegration of ex-offenders in Indonesia and Spain. Despite a global trend toward rehabilitative approaches, practical implementation reveals significant divergence due to structural, cultural, and economic factors. Indonesia’s penal system, guided by Law No. 22 of 2022 and the new Criminal Code (KUHP), emphasizes statutory rehabilitation and vocational and spiritual programs. However, challenges such as prison overcrowding, limited post-release support, and societal stigma constrain effectiveness. Judicial decisions indicate cautious application of restorative provisions, reflecting both public expectations and institutional limitations.
