Conflict Of Laws-Jurisdiction-Foreign Corporation Not Doing Business In The State
Conflict Of Laws-Jurisdiction-Foreign Corporation Not Doing Business In The State
Michigan Law Review
A summons addressed to the defendant corporation was served upon one of its officers at his private residence in Minnesota. The defendant, appearing specially, moved to set aside the service on the ground that it was a foreign corporation not transacting business in the state and that it had empowered no one to accept service of process there in its behalf. The plaintiff contended that the acquisition and ownership of property in Minnesota brought the defendant into the state and under the jurisdiction of its courts. Held, jurisdiction over the corporate property did not give jurisdiction over the corporate …

Conflict Of Laws-Claim Under Compensation Act-Suit In State Other Than That Of Injury
Conflict Of Laws-Claim Under Compensation Act-Suit In State Other Than That Of Injury
Michigan Law Review
Plaintiffs brought suit in the federal court for the southern district of Texas on grounds of diversity of citizenship under the Louisiana Employers Liability Act to recover for the death of their father who had been killed by falling from defendant's dredge upon which he was employed. The contract of employment was made, and the death occurred in Louisiana. The Act is of the "optional" type. It provides that the employer shall, upon the accidental death of an employee in the course of his employment, pay compensation to the employee's dependents. Payment is to be made at periodical intervals for …

Judicial Precedent In Mexican Law
Judicial Precedent In Mexican Law
Michigan Law Review
It is well known that precedent in the modern legal systems based upon the Roman law does not play the important role that it performs in the United States and Great Britain. A decision in an Anglo-American supreme court not only determines the point at issue but establishes a rule under which decisions may be made in the future. A decision in a Latin-American, or in a Continental supreme court has only the value of a judgment on the particular point in question. The body of decisions rendered upon the same point of law is not considered in the countries …

Inheritance Problems In The Conflict Of Laws, Herbert F. Goodrich
Inheritance Problems In The Conflict Of Laws, Herbert F. Goodrich
Michigan Law Review
A man, domiciled in Michigan, dies. He leaves real and personal property in Michigan, and in addition a farm in Ohio, with the usual stock of animals, agricultural implements and other farm property upon it; he leaves a mercantile business in Wisconsin, and shares of stock in several corporations chartered in as many different states. What law or laws will determine the devolution of his estate?
Conflict Of Laws-Adoption-Jurisdiction
Conflict Of Laws-Adoption-Jurisdiction
Michigan Law Review
Sociologists treat of the subject of adoption very sparsely. It is but a desired end in their work, and having its foundation in law, yields but slightly to sociological supervision. However, there exist many reports and treatises in the field of child placement and the effect thereof on the child. The most cursory examination of these works reveals that from the social point of view, at least, the work is conducted with but one end in view, i. e., the welfare of the child. Adoption, as a means to this end, has the same reason for its foundation. To this …

Treatment Of Capacity To Contract In Conflict Of Laws Cases, Raymond J. Heilman
Treatment Of Capacity To Contract In Conflict Of Laws Cases, Raymond J. Heilman
West Virginia Law Review
The decision of a ease often depends upon the conception which is held of the fundamental nature of the problem presented in the controversy. Perhaps in no field is this more true than in that of the "conflict of laws." And it may be ventured that in no other has resulted more confusion and inconsistency in adjudications a result of failure to analyze the legal problems in particular cases down to their foundations and even their sub-structures, or as a result of failure to agree upon such analysis. Because of the additional complexity which the "conflict of laws" phase gives …
The Power Of The Written Assertion, Gustavus Ohlinger
The Power Of The Written Assertion, Gustavus Ohlinger
Michigan Law Review
In his Outline of History Mr. Wells comments on the exaggerated estimate which people generally, through reading the Old Testament account, have come to entertain of the wisdom of Solomon and of the glory and prestige of the Israelitish Kingdom during his reign. By way of contrast, the facts, which are readily available and discernable even in the scriptural narrative, reveal this much advertised monarch as a rather insignificant chieftain and his kingdom as a pawn in the policies of his powerful neighbors-a striking example, according to Mr. Wells, of the power of the written assertion over realities in men's …
