Abstract
The wakalah bil ujrah and qard contract are contracts that often cause difficulties in implementing the purchase of goods in everyday life, both in safekeeping for purchasing goods and for buying and selling in general. Where if it is wrong in its application, it can cause income in a sale and purchase to be haraam due to an error in understanding the contract used and not describing benefit as the core of maqashid al-sharia which has an important role in determining Islamic law. The purpose of this paper is to find out how the solution to the application of …

Even though Indonesia already has laws and regulations governing the Industrial Designs, there are still some things in the Law that still need to be clarified in order …

The privileges of the Special Region of Yogyakarta which are affirmed in Law Number 13 of 2012 directly give authority over land matters. The problem that occurs is that it is not possible for Indonesian citizens of non-indigenous descent to obtain land ownership rights based on the Instruction of the Head of the DIY Region Number K.898/I/A/1975 regarding the Uniform Policy on the Granting of Land Rights to a non-Indigenous Indonesian citizen. This study aims to determine the ownership of land rights in Yogyakarta in terms of history, then to examine the concept of justice related to land ownership rights …

"I'M Concerned About This Post": Combatting Fake News On Social Media, Jake Latimer
Seattle Journal of Technology, Environmental, & Innovation Law
The public concern over the spread of “fake news” on social media has increased over the last decade. Large social networking platforms like Facebook and Twitter have attempted to address fake news by flagging it as misleading. Even former President Trump has seemingly exhibited a sense of paranoia over its spread. While the term “fake news” is often used as a political weapon to discredit unfavorable information and opinions, fake news refers to factually false or grossly misleading content likely designed to sway or entrench one’s opinion on a particular topic. The pervasiveness of this type of fake news on …

The Rules Of The Malpractice Game: Affidavit Of Merit Statutes, Erie, And The Cautionary Tale Of An Overbroad Application Of Rule 11, Deanna Arpi Youssoufian
Brooklyn Law Review
In an effort to combat the rise in potentially frivolous lawsuits against professionals, including physicians, attorneys, and journalists, states have passed malpractice legislation requiring plaintiffs to file an affidavit of merit (AOM) attesting to the validity of their claims. However, these AOM statutes may conflict with Federal Rule of Civil Procedure 11, which provides that “a pleading need not be verified or accompanied by an affidavit” unless a rule or statute states otherwise. This is a classic Erie/choice-of-law problem for federal courts sitting in diversity, which are tasked with applying federal procedural law and state substantive law, and now must …

Intercountry Adoption In Taiwan, Hua Kai Tsai
Intercountry Adoption In Taiwan, Hua Kai Tsai
Indonesia Law Review
Under the current choice-of-law rule concerning the intercountry adoption in the Taiwanese Private International Law Act, the adopter and the child should be governed by their national law respectively. The application of this rule is known as a distributive approach and the rule was made by reference to the old Japanese private international law. However, in 1989, Japanese law revised the choice-of-law rule on intercountry adoption and abandoned the distributive approach, due to the reason that such an approach tended to be construed as a cumulative approach by Japanese courts. Consequently, the formation of intercountry adoption in Japan turned out …

Journal of Civil Rights and Economic Development

Imagine that you are a small business owner. Rather than opening a new coffee shop, craft brewery, or chic clothing store, you decide to enter one of the fastest-growing industries in the country: marijuana (also referred to herein as “cannabis”). Your state, Washington, has recently legalized recreational use of marijuana, and your new marijuana-related business (MRB), Plantworks, has joined thousands of other licensed producers to supply the new growing market.
You and your business partner lease 2,500 square feet of industrial workspace in Seattle’s North End and produce several pounds of high-quality “craft” cannabis for distribution to local dispensaries. …

State Spoliation Claims In Federal District Courts, Jeffrey A. Parness
State Spoliation Claims In Federal District Courts, Jeffrey A. Parness
Catholic University Law Review
The increasing amounts of electronically stored information (ESI) relevant to civil litigation, and the ease of their loss, caused federal lawmakers explicitly to address the possible consequences of certain pre-suit or post-suit ESI losses. These lawmakers acted in both 2006 and 2015 through Federal Civil Procedure (FRCP) 37(e). But they acted only on certain ESI. Their actions have prompted increasing attention to the significant risks of pre-suit and post-suit losses of all ESI, and of non-ESI, otherwise discoverable in civil actions. In addition, their actions have spurred increasing attention to the availability of substantive law claims involving spoliation of information …

The first Malaysian judgment of precedential value relating to the recovery of mistakenly transferred cryptocurrency, Robert Ong Thien Cheng v LUNO Pte Ltd and BitX Malaysia Sdn Bhd, is uncharacteristically short but raises important issues in the law of unjust enrichment. Recognition And Enforcement Of Foreign Judgments In American Courts And The Limits Of The Law Market Model, Michael E. Solimine
Recognition And Enforcement Of Foreign Judgments In American Courts And The Limits Of The Law Market Model, Michael E. Solimine
Faculty Articles and Other Publications
The law market model posits that the most appropriate resolution of choice of law disputes in private international law is to permit individuals to choose ex ante the law that applies to them. This is contrasted to the public law model where courts choose law based on the perceived interests of, or the parties’ connections with, the states or nations involved. The law market model envisions that consumer choice will lead to a healthy competition among jurisdictions to supply the most efficient law. This model has been followed in several areas, most notably in the widespread enforcement, at least within …
