The Ethics Of Insider Trading, Miles Morgan
The Ethics Of Insider Trading, Miles Morgan
Global Tides
In business ethics, insider trading has gone untouched by scholars, as the consensus is that insider trading is morally indefensible, however, questions have emerged regarding the moral responsibility of insiders. This paper engages with Analyzing Insider Trading from the Perspectives of Utilitarian Ethics and Rights Theory by Robert McGee to evaluate the relationship between applied ethics and insider trading. A satisfactory anti-insider trading account must be able to economically or philosophically explain why insider trading is morally wrong. The assumption that this is impossible may be due to a misunderstanding of how we decide what morality is or how economic …
The Law Of Disqualification And Problems With The Supreme Court Code Of Conduct, Donald K. Sherman, Marco A. White, Virginia Canter
The Law Of Disqualification And Problems With The Supreme Court Code Of Conduct, Donald K. Sherman, Marco A. White, Virginia Canter
Fordham Law Voting Rights and Democracy Forum
In this Article, we analyze the federal disqualification statute applicable to federal judges, magistrates, and Justices of the Supreme Court as compared to the disqualification provisions of the United States Supreme Court Code of Conduct and detail the ways in which the standards contained within the Code are contrary to law and history. To provide proper context, we examine the history, case law, and statutory framework that have created the current standards of judicial disqualification for all Article III judges and Justices. We demonstrate that the Court is bound to apply disqualification procedures in accordance with the United States Constitution, …
Standardizing Space Technologies As Admissible Evidence: Legal And Ethical Frameworks For U.S. Courts And The International Criminal Court, Tuana Yazici
University of Miami International and Comparative Law Review
This paper explores the increasing role of satellite and other space technologies — such as optical satellite imagery, radar, and artificial intelligence (AI) — in legal proceedings both in the U.S. and internationally. It examines relevant Supreme Court and appellate cases, as well as key international rulings, to assess how courts are addressing the legal challenges posed by surveillance technologies. These cases reveal the tension between advancing technology and existing privacy protections, highlighting the need for updated legal frameworks. The analysis also covers federal laws, including the Electronic Communications Privacy Act, alongside proposed legislation like the American Privacy Rights Act …
Rps Coach Is Biased - And Proud Of It, John Lande
Rps Coach Is Biased - And Proud Of It, John Lande
Faculty Publications
This short essay explores the concept of bias in artificial intelligence tools used in dispute resolution. Biases are not necessarily flaws to be avoided, but inevitable and potentially constructive features of these tools. They reflect values and design choices that AI developers should disclose.
There are both market and ethical imperatives for AI tools to disclose their features and embedded values. As developers compete for users, people will want to know what they’re getting. Disclosure helps users understand the effects of assumptions, priorities, and frameworks built into a tool’s design, and thus should be treated as a core ethical principle. …
Christian Ethics And Business Leadership, Jon Armajani
Christian Ethics And Business Leadership, Jon Armajani
The Journal of Social Encounters
This essay discusses the ethical principles of listening, community, stewardship, and interreligious and intercultural understanding with respect to business leadership. It opens by discussing definitions of ethics and their relevance to businesses and business leaders. It continues by providing a description of the consulting company Accenture’s ethical principles and practices, as positive examples. The essay provides Arthur Andersen and its work with Enron and WorldCom, both of which went bankrupt in the early 2000s, as examples of the failures that occur when ethical principles are not practiced. Then, the essay states that Christianity and the Benedictine tradition constitute a basis …

Publications and Research
This article presents a paper developed by the AAG Organizing Committee on Locational Information and the Public Interest through a summit held in Santa Barbara, California in June 2022. The summit resulted in goals and ideas for addressing the issues that arise from the present environment for geodata, whereby public, private, and third-sector entities can tap into publicly available locational information with relatively little regulation on its access or use. The Committee articulates four goals: (1) develop a research agenda extending across disciplines, (2) outline educational resources and strategies to guide ethical practice, (3) devise a pathway to increase public …
When Anti-Fraud Laws Become A Barrier To Computer Science Research, Madelyne Xiao, Andrew Sellars, Sarah Scheffler
When Anti-Fraud Laws Become A Barrier To Computer Science Research, Madelyne Xiao, Andrew Sellars, Sarah Scheffler
Faculty Scholarship
Computer science research sometimes brushes with the law, from red-team exercises that probe the boundaries of authentication mechanisms, to AI research processing copyrighted material, to platform research measuring the behavior of algorithms and users. U.S.-based computer security research is no stranger to the Computer Fraud and Abuse Act (CFAA) and the Digital Millennium Copyright Act (DMCA) in a relationship that is still evolving through case law, research practices, changing policies, and legislation
Amid the landscape computer scientists, lawyers, and policymakers have learned to navigate, anti-fraud laws are a surprisingly under-examined challenge for computer science research. Fraud brings separate issues that …

The Law And Ethics Of Ai Creativity, Haochen Sun
St. John's Law Review
(Excerpt)
This Article comprises three parts. In Part I, after demonstrating that creativity is a social process, I explore the ethical principles of originality, attribution, and authenticity of creative activities. In Part II, I scrutinize the opacity of AI systems in the collection, utilization, and generation of works, highlighting the need for a greater focus on the legal and social problems arising from these black box processes. Lastly, in Part III, I explore why the ethical principles of originality, attribution, and authenticity should govern AI creativity, and how they would lead to the adoption by AI companies of filtering and …

The recent explosion of artificial intelligence and generative AI undeniably impacts our federal and state courts. Currently, ABA Model Rule 1.1 and its Comment include a broad requirement of technological competence for an ethical practice. This Article will identify the technical competence obligations embodied in Model Rule 1.1 and examine the implications of AI for technological competence standards. After reviewing the timeline of cases that invoke AI hallucinations and other issues and current scholarly literature, this Article will propose a more specific ethical standard for baseline knowledge of various AI technologies according to current practice and use of ever-expanding technologies …
Psychedelic Medicine Exceptionalism, Mason Marks, I. Glenn Cohen
Psychedelic Medicine Exceptionalism, Mason Marks, I. Glenn Cohen
Scholarly Publications
Research on psychedelic medicines is experiencing a revival. Some clinicians, scientists, and ethicists believe that psychedelics are so different from other treatments that they warrant special consideration in how they are researched, regulated, commercialized, and administered. Others argue that psychedelic medicines show clinical potential, but they should be treated like other medical interventions. In other words, identical standards should apply. This article analyzes whether psychedelic medicines warrant special consideration from a regulatory and ethical perspective.
Is Originalism Bullshit?, Michael L. Smith
Is Originalism Bullshit?, Michael L. Smith
Faculty Articles
It’s finally time to answer the big question. This Article draws on the surprisingly robust literature examining the definition, essence, and significance of bullshit and evaluates whether originalist constitutional interpretation fits the bill. I begin with Harry Frankfurt’s definition of bullshit as utterances made in pursuit of the speaker’s goals without regard for their truth value. I also rely on alternate formulations, including bullshit as unclarifiable nonsense as well as contextual and audience-centric variations of bullshit.
While not all instances of originalism are bullshit, I identify those instances which are, and go on to demonstrate that originalism is uniquely prone …
The Intersection Of Regulation, Quality Care Delivery, And Ethics And Compliance: Look Carefully Before Crossing!, David R. Hoffman, Ilene Warner-Maron
The Intersection Of Regulation, Quality Care Delivery, And Ethics And Compliance: Look Carefully Before Crossing!, David R. Hoffman, Ilene Warner-Maron
Saint Louis University Journal of Health Law & Policy
Quality and compliant care delivery in nursing homes remains elusive. Four main interests are currently misaligned, thereby putting nursing home residents at risk of harm. Without a clearly defined commitment to quality and compliant care and alignment of these interests, nursing home residents will remain vulnerable to severe harm.
The first key interest concerns nursing home ownership and management. Currently, over seventy percent of nursing homes are owned by for-profit entities. Previous ownership models, including non-profit, religious-based, and county-owned facilities, have largely closed or transitioned to for-profit entities. The shift in ownership significantly impacts quality and compliant care delivery. Unfortunately, …
Do Bankruptcy Judges Belong In Chambers? Rethinking Inherent Civil Contempt Power In Bankruptcy, Abigail B. Willie
Do Bankruptcy Judges Belong In Chambers? Rethinking Inherent Civil Contempt Power In Bankruptcy, Abigail B. Willie
Faculty Articles
The bankruptcy court is the face of the federal judiciary to much of the American public. Almost as many cases are filed in bankruptcy courts every year as are filed in the federal district courts and circuit courts combined. And in each bankruptcy case, there are often dozens or more affected parties. As such, it is critical that the public has confidence in the role of the bankruptcy court and its judges. Yet, since the creation of the Bankruptcy Code in 1978, the non-Article III bankruptcy system has faced seemingly never-ending challenges to subject matter jurisdiction in the bankruptcy context …
Ethics & Independence In Trump’S War On Big Law, Christopher D. Hampson, Elise Bernlohr Maizel
Ethics & Independence In Trump’S War On Big Law, Christopher D. Hampson, Elise Bernlohr Maizel
UF Law Faculty Publications
In his second term, President Donald Trump has launched an unprecedented assault on the nation's largest law firms. Through a series of executive orders and highly unusual EEOC (Equal Employment Opportunity Commission) actions, the Trump regime has sought to undermine the independence of the private bar. In response, targeted firms have been forced to make a choice: to appease the administration or to fight back. This Essay considers those choices the interrelated nature of parallel settlements and suits-and the choice that the majority of firms have made to stay silent. We argue that Big Law's independence is essential and that …
Ethical Issues In Pandemic Prevention, Preparedness, And Response, Govind Persad
Ethical Issues In Pandemic Prevention, Preparedness, And Response, Govind Persad
Publications
Pandemic policies raise complex ethical challenges, as well as scientific and technical ones. This chapter examines four critical areas where ethical analysis is essential for effective pandemic prevention, preparedness, and response: spending decisions, clinical research, restrictions on rights and freedoms, and fair allocation of scarce medical resources.
Spending on pandemic prevention, preparedness, and response often involves trade-offs with other societal priorities, such as education, infrastructure, and environment. Navigating these trade-offs requires careful consideration of opportunity costs and distributional impacts.
Rights and freedoms can likewise present difficult trade-offs when pandemic policies restrict individual liberties, requiring clear goals and proportionate responses that …

Command And Consequence: Reassessing King David’S Military Decisions In The Uriah Affair – A Legal And Ethical Analysis In The Context Of Modern Legal Theory, Jonathan Hasson, Oded Mudrik, Abraham Tennenbaum
Touro Law Review
This study critically reevaluates King David's command in 2 Samuel 11 and 12 to place Uriah the Hittite in the battle's frontlines, resulting in his death, through the contemporary lens of military law and ethics. By juxtaposing the ancient narrative with modern legal doctrines, it investigates the complexities of command responsibility and the intersection of personal motives in military orders. Focusing on the interplay between David's personal entanglements with Bathsheba and his official capacity as a military leader, the analysis navigates the ethical quandaries and legal ramifications of his decisions. This piece methodically dissects the Biblical text and contemporaneous legal …

AI technologies promise many benefits, but they can also have significant negative impacts on human health, safety, well-being, and fundamental rights. This chapter explores the different governance tools that have been considered for guiding developments in AI in socially beneficial ways, examining the relevance of ethics, law, and policy. Each of these approaches offer tools to address these concerns; however, each has limitations, and none provides a complete solution in itself. Statements of ethical principles can articulate high-level values and goals to guide behavior but are usually quite vague and difficult to operationalize. They also lack any enforcement mechanism. In …
Being There: Perils Of Disembodied Mediation, Robert Mcniff
Being There: Perils Of Disembodied Mediation, Robert Mcniff
Scholarly Works
The article examines the rise of online mediation, particularly accelerated by the COVID-19 pandemic, and critiques its limitations compared to in-person mediation. Drawing on 20th-century philosophical, psychological, and sociological thought, the analysis argues that online mediation diminishes the embodied, emotional, and intersubjective dimensions of human interaction, which are critical for empathy, moral agency, and meaningful dispute resolution. While online mediation offers convenience, it risks dehumanizing the process by reducing participants to disembodied images, thereby undermining the unique strengths of mediation as a holistic and empathetic alternative to legal adjudication.

Ethical Considerations In Qualitative Research After Dobbs, Sabrina Singh
Ethical Considerations In Qualitative Research After Dobbs, Sabrina Singh
Pace Law Review
The verdict in the Dobbs case will undoubtedly have an impact on the United States research enterprise for years to come. Since the landmark decision was handed down by the high court, researchers have warned of the impacts that the decision will have on clinical research. However, there is less discussion about how qualitative researchers will be impacted by this decision. Oftentimes, qualitative researchers are asking their participants to be vulnerable and to let researchers be privy to intimate and/or confidential details about their lives. In exchange for such access, researchers need to ensure the protection of their participants and …

When To Save The Baby: A Fundamental Conditions Approach, S. Matthew Liao, Jordan Liebman, Corine Astroth
When To Save The Baby: A Fundamental Conditions Approach, S. Matthew Liao, Jordan Liebman, Corine Astroth
Pace Law Review
Parents and physicians often grapple with the agonizing decision of whether to continue life-sustaining treatment for critically ill infants. In this paper, we introduce a novel framework called the Fundamental Conditions Approach (FCA) to guide these difficult choices. Building on S. Matthew Liao’s work, the FCA evaluates whether an infant possesses or can develop the fundamental capacities necessary for engaging in basic activities that constitute a good life. These capacities include the ability to think, respond to facts, develop interpersonal relationships, and interact with one’ environment. We argue that if an infant lacks nearly all of these fundamental capacities and …

The proliferation of satellites in Earth’s orbit has significantly enhanced capabilities in communication, Earth observation, and scientific research. However, this rapid expansion presents considerable legal and ethical challenges, particularly regarding the preservation of dark and quiet skies. As low Earth orbit becomes increasingly congested, the implications for astronomical observation, environmental integrity, and cultural heritage require critical examination.
This presentation provides an interdisciplinary perspective on the legal, practical and ethical considerations essential for preserving dark and quiet skies. It begins by exploring the legal frameworks governing the use of space, highlighting relevant international treaties, national responsibilities, and emerging issues aimed at …

A Field Guide To Teaching Agency And Ethics: The West Wing And American Foreign Policy, Kayce Mobley, Sarah Fisher
Dialogue: The Interdisciplinary Journal of Popular Culture and Pedagogy
Though political science undergraduate courses reflect a rich theoretical tradition, they typically lack opportunities for students to express intangible concepts through the interpretation of creative works, a standard exercise of critical analysis. Educators can address this dearth in many ways, such as through utilization of popular culture texts. We employ the television series The West Wing to ground debates in American politics, specifically American foreign policy. Although this show has been on air since 2006, Netflix and Amazon have recently released the entire series for streaming, significantly reducing the hassle and monetary cost of using this source in the classroom. …

This article discusses the use of social media among arbitration actors. Social media have evolved since its inception. In the beginning, social networks were used to stay in touch with friends and family. Now the trend is to follow influencers. The boundaries between personal and professional use have become blurry. Social media are more regulated and supervised now, especially due to privacy and national security concerns. The social media adoption landscape has matured with increasing adoption by all generations. The use of social media can give rise to questions about ethical conduct or even the integrity of the arbitration proceedings. …
