Taking Voluntariness Seriously, Ian Farrell, Justin Marceau Sep 2013

Taking Voluntariness Seriously, Ian Farrell, Justin Marceau

Sturm College of Law: Faculty Scholarship

Courts and commentators commonly claim that criminal law contains a voluntary act requirement. Despite the ubiquity of this assertion, there is remarkably little agreement on what the voluntary act requirement entails. This lack of uniformity is particularly problematic because, for some crimes, whether a defendant is guilty or innocent will turn on which conception of voluntariness is applied. In this Article, we critique the various conceptions of the voluntary act requirement, and propose an alternative set of principles for applying the notion that person is only criminally culpable for crimes committed voluntarily. First, culpability requires that the actus reus as …

8th Annual Colloquium on Current Scholarship in Labor & Employment Law

The Colloquium on Current Scholarship in Labor and Employment Law provides an opportunity for labor and employment law scholars to present works-in-progress and receive feedback from their colleagues in the field. This year, with the Colloquium set in Las Vegas, participants will have the opportunity to discuss developments in labor and employment law with the unique workplace law landscape of Las Vegas as the setting. Las Vegas is often thought of as a global playground, but this image obscures the hard work and difficult issues that exist "behind the curtain."

The Evolving Right To Counsel On State Post-Conviction Review, Marc D. Falkoff Sep 2013

The Evolving Right To Counsel On State Post-Conviction Review, Marc D. Falkoff

College of Law Faculty Publications

Fifty years after Gideon v. Wainwright announced that lawyers at state criminal trials are constitutional necessities and not luxuries, the metes and bounds of the right to counsel are still being hashed out in the courts. In particular, the law is evolving on the right to counsel during state post-conviction review, with the U.S. Supreme Court recently acknowledging, in Martinez v. Ryan, that sometimes lawyers are necessary (albeit not constitutionally compelled) during state collateral proceedings. 132 S.Ct. 1309, 1320 (2012). But the importance of Martinez has not yet been recognized by either the Illinois courts or its legislature. Of particular …

A View From Within The Fortune 500: An Empirical Study Of Negative Value Class Actions And Deterrence, Linda Sandstrom Simard Sep 2013

A View From Within The Fortune 500: An Empirical Study Of Negative Value Class Actions And Deterrence, Linda Sandstrom Simard

Suffolk University Law School Faculty Works

This paper takes a look inside the Fortune 500 to analyze the deterrent effect of negative value class actions. The study focuses on the relationship between litigation maturity and deterrence by testing three inter-related hypotheses: (1) Future liability is easier to anticipate when there is a well-developed record of the factual and legal issues from previous litigation than when there is no track record from previous litigation; (2) Corporations who have been held liable for particular conduct will successfully change their conduct to avoid future litigation regarding similar conduct; (3) Corporations who are informed about lawsuits filed against their competitors …

Innovation, Inequality, And The Commercialization Of Academic Research, Walter Valdivia Sep 2013

Innovation, Inequality, And The Commercialization Of Academic Research, Walter Valdivia

Brookings Scholar Lecture Series

Patent policy is rarely debated in relation to its distributive consequences. In particular, the Bayh-Dole Act has been discussed in terms of its effects on the pace of innovation or the organization of science. However, this lecture re-assesses this policy from the perspective of a fair distribution of resources, both those committed to and those created by research-based innovation. Specifically, examining the management of university’s intellectual property, Valdivia will identify the institutional arrangements that reinforce a very asymmetric distribution of political and economic resources among universities and then characterize subtle but important links between these inequalities and the social distribution …

Providing Outreach And Enrollment Assistance: Lessons Learned From Community Health Centers In Massachusetts, Julia Paradise, Sara J. Rosenbaum, Peter Shin, Jessica Sharac, Carmen Alvarez, Julia Zur, Leighton C. Ku

Health Policy and Management Faculty Publications

Six years ago, Massachusetts implemented a broad expansion of health coverage to the uninsured population in the state. Understanding that outreach and enrollment assistance would be essential to the success of the expansion, state policymakers provided for public education campaigns, but also for person-to-person, hands-on assistance, especially in communities with large numbers of uninsured people. Community health centers play a central role in this effort. As states and communities gear up to provide outreach and enrollment assistance under the ACA, the experience of the Massachusetts health centers offers lessons that can help inform current efforts to reach and enroll millions …

Brief Of Amici Curiae In Support Of Appellant, James Townsend V. Midland Funding, Llc, Stuart Robert Cohen, Peter A. Holland

Court Briefs

The Consumer Protection Clinic of the University of Maryland Francis King Carey School of Law, filed a Motion to Participate and an Amicus Brief in the case of Townsend v. Midland Funding, LLC. The case presents the question of whether documents created by third party predecessors in interest—usually a bank—may be admitted into evidence when a debt buyer plaintiff does not demonstrate personal knowledge regarding any of the foundational elements which would be required to admit the documents under the business records exception to the hearsay rule. Amici urge the Court to overturn the lower court, and hold that a …
