Percolation, Uniformity, And Coherent Adjudication: The Federal Circuit Experience, Rochelle C. Dreyfuss Jan 2013

Percolation, Uniformity, And Coherent Adjudication: The Federal Circuit Experience, Rochelle C. Dreyfuss

SMU Law Review

Two important lessons had been taught by the reactions to the Freund and Hruska Reports. One was that it was politically unacceptable to shut off any case in the lower federal courts from access to the Supreme Court by way of certiorari, however unavailing that might be in reality. . . . In addition, a widespread sentiment was evident among the bench and bar against having "specialized courts."'

Turnover Actions And The “Floating Check” Controversy, David R. Hague Jan 2013

Turnover Actions And The “Floating Check” Controversy, David R. Hague

Faculty Articles

When a debtor files for Chapter 7 bankruptcy, a Chapter 7 trustee is appointed and is charged with collecting and reducing to money the property of the bankruptcy estate. One of the most basic collection methods a trustee possesses is its turnover power under § 542(a) of the Bankruptcy Code. Pursuant to § 542(a), an entity in possession, custody, or control, during the bankruptcy case, of property that the trustee may use, sell, or lease, must deliver to the trustee, and account for, such property or the value of such property.

An interesting issue has arisen that is placing debtors …

Making Civility Mandatory: Moving From Aspired To Required, David A. Grenardo Jan 2013

Making Civility Mandatory: Moving From Aspired To Required, David A. Grenardo

Faculty Articles

Despite the rise of voluntary civility codes and calls for professionalism, incivility persists in the legal profession. The practice of law is a privilege, not a right, and attorneys must be held to a higher standard of conduct as a lawyer is a representative of clients, an officer of the legal system, and a public citizen having special responsibility for the quality of justice. The time for mandatory civility has long come, and all state bars should follow the lead of the few jurisdictions that have made civility mandatory.

This article examines what civility is, its importance, and the problem …

World’S Worst Game Of Telephone: Attempting To Understand The Conversation Between Texas’S Legislature And Courts On Groundwater, Amy Hardberger Jan 2013

World’S Worst Game Of Telephone: Attempting To Understand The Conversation Between Texas’S Legislature And Courts On Groundwater, Amy Hardberger

Faculty Articles

Texas has flourished in recent years, and its continued growth is predicated on access to groundwater resources. Texans have a long-standing dependence on groundwater, which accounts for 60% of all water withdrawn in the state. The State’s ability to provide sufficient groundwater resources depends on effective groundwater management.

Texas groundwater management has a long history of intertwined court decisions and legislation. The common law of groundwater was established by the Texas Supreme Court in accordance with the English common law right of capture. This rule was subsequently modified by the Legislature through the Conservation Amendment to the Texas Constitution, which …

Border Wars & The New Texas Navy: International Treaties, Waterways, And State Sovereignty After Arizona V. United States, Bill Piatt, Rachel Ambler

Faculty Articles

The Texas Department of Public Safety Tactical Marine Unit’s law enforcement authority does not extend to stopping people crossing the border. Whether the Tactical Marine Unit, colloquially known as the New Texas Navy, possesses sufficient legal authority to enforce federal law is questionable. Arizona v. United States affirmed the principles of federalism and the preemption doctrine. However, the Court suggested that State officers were legally permitted to “cooperate” with the U.S. Attorney General in the identification, apprehension, and detention of illegal aliens. But, this does not allow a State to unilaterally choose to enforce federal law, which the New Texas …

Teaching American Legal History Through Storytelling, Michael S. Ariens Jan 2013

Teaching American Legal History Through Storytelling, Michael S. Ariens

Faculty Articles

Distinct from facts and truths, the power of storytelling can serve as a method of teaching American Legal History. A course in American Legal History can facilitate discussion into whether the rule of law has been the rule or exception in the history of American law. Integral to this overarching story are three storylines that surface throughout the course: the development of law in American political history; the ideological underpinnings of legal doctrine development; and the rise and decline of different approaches to legal thought and their effect on legal education.

The course begins with a chronological overview of the …

The Military Justice Conundrum: Justice Or Discipline?, David A. Schlueter

Faculty Articles

This article focuses on the long-standing debate over the purpose and functions of the American military justice system and whether the system is intended to provide for good order and discipline or to provide justice. The author provides a summary of the current procedures and practices in that legal system and discusses the roles of commanders and armed forces attorneys. He addresses the various thematic approaches which have been used to describe the relationship between justice and discipline and applies a crime-control and due process model to various features of the military justice system. He concludes that the system was …

The Co-Author Prenup, David A. Schlueter Jan 2013

The Co-Author Prenup, David A. Schlueter

Faculty Articles

Producing a book or article with co-authors is not an easy task. There are six potential issues one might consider before deciding to co-author a book or article. First, do you really want to be a co-author? Second, how many co-authors are going to be involved in the project? Having more than one co-author can make the departure of a co-author less of an issue, but each co-author needs to have a clearly defined role. Third, what role will each member of the team perform and what are those roles? Fourth, what should the co-author “marriage” look like? Multiple scenarios …

Secured Transaction History: Protecting Holmes’ Notes Through The Conditional Sales Acts, George Lee Flint Jr Jan 2013

Secured Transaction History: Protecting Holmes’ Notes Through The Conditional Sales Acts, George Lee Flint Jr

Faculty Articles

The historical explanation for the adoption of the conditional sales acts is woefully lacking. How and why the first conditional sales acts arose are investigated. Grant Gilmore, when presenting his theory, confessed ignorance concerning the origins of the conditional sale transaction, first known as Holmes’ notes. The failure of traditional legal historians to explain the passage of the conditional sales acts encourages inquiry into their legislative history to find an explanation. Pre-Act American decisions provide clues regarding the ratification of the acts. The courts provided three explanations for their passage: to treat the conditional sale as a chattel mortgage, to …

The Rule Of Law In China And The Prosecution Of Li Zhuang, Vincent R. Johnson, Stephen C. Loomis Jan 2013

The Rule Of Law In China And The Prosecution Of Li Zhuang, Vincent R. Johnson, Stephen C. Loomis

Faculty Articles

The rule of law is a philosophical concept, an ideal against which any legal system can be measured. Whether China adheres to the rule of law is critical not only to people in China but also to other nations that look to China for leadership. Serious questions can be raised about whether the recent Chongqing da hei fell short of compliance with the rule of law in the criminal law field. This article considers the Li Zhuang case from a comparative perspective rooted in legal principles that resonate cross-culturally. The article recounts the recent development of a new Chinese legal …

Legal Malpractice In A Changing Profession: The Role Of Contract Principles, Vincent R. Johnson Jan 2013

Legal Malpractice In A Changing Profession: The Role Of Contract Principles, Vincent R. Johnson

Faculty Articles

American legal ethics are based upon a set of legal principles that ensure clients are protected from unnecessary harm and that the provision of legal services is consistent with the public interest. However, the fabric of American legal ethics is threatened by a looming transformation of the legal profession. Such changes, if they come to pass, will undercut the foundations upon which the principles and law of modern legal ethics is founded.

The current model of American legal ethics is animated by three important assumptions, each of which is now under attack. The first is that legal services are ordinarily …

Targeted Killing - Death By Drone, Jeffrey F. Addicott Jan 2013

Targeted Killing - Death By Drone, Jeffrey F. Addicott

Faculty Articles

Following the targeted killing of American born al-Qa’eda leader, Anwar al -Awlaki, targeted killings of American citizens has been a hotly contested issue. A targeted killing is defined as the “intentional, premeditated and deliberate use of lethal force, by states or their agents acting . . . against a specific individual who is not in the physical custody of the perpetrator.” The rule of law that justifies a state killing another human rests in either the law of war or the legal right of self-defense.

The term targeted killing is most often associated with the use of Unmanned Aerial Vehicles …

Databases Lie! Successfully Managing Structured Data, The Oft-Overlooked Esi, Conrad Jacoby, Jim Vint, Michael Simon

Richmond Journal of Law & Technology

Legal professionals regularly advise clients to ensure that the storage, retention, and accessibility of their Electronically-Stored Information (“ESI”) is in full compliance with all legal and regulatory requirements in the event this information becomes relevant in civil, criminal, or regulatory disputes. However, what many practitioners may not realize is that the ESI that clients are required to produce for e- discovery includes both “unstructured” and “structured” data. Searching and producing only one of these types of ESI may well not fully satisfy a client’s full discovery obligations. Even worse, it might not present a full understanding of the factual issues …

E-Discovery As Quantum Law: Clash Of Cultures-What The Future Portends, Michael Yager Jan 2013

E-Discovery As Quantum Law: Clash Of Cultures-What The Future Portends, Michael Yager

Richmond Journal of Law & Technology

Early in the twentieth century, the phenomenon that is the “quantum” stormed the fortress of classical physics, causing Albert Einstein, one of science's greatest thinkers, to opine, “[i]t was as if the ground had been pulled out from under one, with no firm foundation to be seen anywhere, upon which one could have built.” The theoretical laws associated with looking at reality on the quantum level violently collided with those related to looking at the same reality on the macro level. The application of quantum theory to the mathematically pure and proven classical laws of physics introduced a cultural clash …

Social Media Evidence In Government Investigations And Criminal Proceedings: A Frontier Of New Legal Issues, Justin P. Murphy, Adrian Fontecilla

Richmond Journal of Law & Technology

As the newest pillar of communication in today’s society, social media is revolutionizing how the world does business, discovers and shares news, and instantly engages with friends and family. Not surprisingly, because social media factors into the majority of cases in some respect, this exploding medium significantly affects government investigations and criminal litigation. Social media evidence includes, among other things, photographs, status updates, a person’s location at a certain time, and direct communications to or from a defendant’s social media account. This Article will examine the importance of social media in government investigations and criminal litigation, including access to and …

Ownership, Control, Sponsorship, And Trusteeship: Governance Relationships Within Private Catholic Religious-Sponsored Secondary Schools In The United States, David Louis Caretti Jan 2013

Ownership, Control, Sponsorship, And Trusteeship: Governance Relationships Within Private Catholic Religious-Sponsored Secondary Schools In The United States, David Louis Caretti

Doctoral Dissertations

The governance of private Catholic religious-sponsored secondary institutions in the United States is wholly unique, for many different influences distinguish these institutions from not only their public counterparts but also other Catholic schools operated by a diocese or parish. In the face of the changes of the post-Vatican II era, including the diminishing numbers of religious brothers, sisters, and priests available to minister within their respective apostolates, religious congregations have employed one particular governance construct, the board of limited-jurisdiction, originally created within the Catholic university and healthcare realms. Thus, while such boards hold the chief role in directing the progress …
