The Imperative Of Returning To The Fundamental Principles Of The "Three Gongs" [Openness, Fairness, And Justice], Daniel J. Mitterhoff
The Imperative Of Returning To The Fundamental Principles Of The "Three Gongs" [Openness, Fairness, And Justice], Daniel J. Mitterhoff
Faculty Scholarship
This commentary highlights the failure to set policy priorities under China’s near decade old government procurement system and bemoans the consequences of China's mixed policy signals. The author calls for China to return focus upon the guiding principles of the three “gongs”--“gongkai,” “gongping” and “gongzheng” (translated as “openness, fairness and justice) . Before China can rationally and successfully pursue secondary socio-economic policies through government procurement, or alternatively open its public procurement market to foreign suppliers, it must first master the art of maximizing competition for public contracting opportunities in its domestic public purchasing regime.

QUESTION PRESENTED Five major federal employment statutes, including in this case the Age Discrimination in Employment Act, exclude certain government workers "at the policymaking level" from the definition of employees protected by those laws. The question presented is: who is a worker "on the policymaking level"?

To Catch A Criminal, To Cleanse A Profession: Exposing Deceptive Practices By Attorneys To The Sunlight Of Public Debate And Creating An Express Investigation Deception Exception To The Aba Model Rules Of Professional Conduct, Tory L. Lucas
Faculty Publications and Presentations
“In undertaking the privilege to practice law, I do solemnly swear that I will lie, deceive, misrepresent, and engage in fraud in order to serve my client’s and my own personal interests.”
It is doubtful that any American attorney believes that he or she has sworn such an oath (or openly advocates the use of such an oath for newly sworn attorneys). But does every American attorney share the same understanding of whether attorneys may ethically engage in deception? The issue of attorney deception has not enjoyed a thorough, open discussion necessary for a consistently applied standard on that issue. …

How To Sever The Legs Of An Octopus: Tunisia’S Ongoing Revolution, Matthew Hammel
How To Sever The Legs Of An Octopus: Tunisia’S Ongoing Revolution, Matthew Hammel

The Kasbah square is large and covered in barbwire. Military men stand on the inside of the fence cradling automatic rifles, joking, chatting, texting on their cell phones. Coming out from the bustle of the souks the square feels tranquil. It is September, seven months since the square became a temporary home to thousands of protestors who demanded the end of oppressive government in Tunisia. It was here that the Tunisian people solidified their revolution, refusing to be appeased by the flight of a figurehead while the tentacles of his regime remained.
Ben Ali ruled Tunisia for twenty-three years. During …

Back To Basics: An Agenda For The Maryland General Assembly To Protect The Environment, Rena I. Steinzor, Lee Huang

Maryland has a long-held reputation as a regional and national leader in environmental protection. But in some areas, especially enforcement, that reputation warrants scrutiny. For example, Maryland charges less than Pennsylvania and Virginia for some pollutant discharge permits, and the state does not assess permit fees for municipalities despite the resources required to administer those permits. The penalties for violating the Clean Water Act have remained chronically below the level allowed under federal law. Maryland law does not require MDE to penalize polluters for the full amount of the economic gain they achieved by flouting the law, unlike laws in …

When It Comes To Poverty Reduction, Less May Be More, Knowledge@Smu
When It Comes To Poverty Reduction, Less May Be More, Knowledge@Smu
Knowledge@SMU
Most people expect strong economic growth to be closely linked to a decline in poverty. By the same token, fast-developing economies should experience fast-shrinking poverty rates. But, in reality, this link between growth and poverty is seldom consistent. In 'Small Works: Poverty and Economic Development in Southwest China', political scientist John A. Donaldson discusses an alternative take on mediating the effects of economic growth on the poor through a multi-method study of two Chinese provinces.

Watching The Clock: Challenges For The World's Fastest Growing Economies, Knowledge@Smu

Time seems to move a little faster in economies with greater wealth, higher education and more demanding jobs; sometimes driven by personal ambitions to achieve more, or perhaps because society demands it. Speaking at a Wee Kim Wee Centre Lunchtime Seminar, renowned China expert Wang Gungwu says that life on the fast lane has become so ingrained in our thinking of modern societies that it is no longer questioned but accepted as a condition of development: Speed up or get left behind.
