Dodd-Frank, Compensation Ratios, And The Expanding Role Of Shareholders In The Governance Process, J. Robert Brown Jr. Oct 2011

Dodd-Frank, Compensation Ratios, And The Expanding Role Of Shareholders In The Governance Process, J. Robert Brown Jr.

Sturm College of Law: Faculty Scholarship

The Dodd-Frank Act included a number of provisions designed to reform the executive compensation process. One of the provisions, Section 953(b), requires disclosure of a ratio that compares CEO compensation with the median income of employees. Although hardly noticed at the time of adoption, the provision has since generated opposition, with many of the concerns involving the logistics associated with implementation. Efforts to repeal Section 953(b) have surfaced in Congress.

Judge Not - Why Won’T Progressives Fight For Federal Judges?, Sonja R. West Oct 2011

Judge Not - Why Won’T Progressives Fight For Federal Judges?, Sonja R. West

Popular Media

Democrats have taken their eye off the ball on judicial appointments for far too long. It took decades for Republicans to build the court system now in place, and it may take many years to rebalance it. But the time to start is yesterday. Until Democrats start slapping “It’s the courts, stupid!” stickers on their rear bumpers, their elected officials aren’t going to change. Until progressives say, “I’m not going to stop writing my senator until Paul Watford gets a hearing,” Obama judges will be slow-walked through hearings and wait months for a floor vote that might never come. We …

Looking At Zoos, Irus Braverman Oct 2011

Looking At Zoos, Irus Braverman

Journal Articles

Looking at zoos from the perspective of zoo personnel, this article explores the importance of vision in the zoo’s presentation of its animals as well as the major technologies that the zoo uses to intensify such animal visions. On the one end of the spectrum, zoogeography and immersion design are used at the zoo exhibit to enable zoogoers to see animals in their naturalistic settings. On the opposite end of the spectrum, animals are caged and cared for in the highly artificial settings of the zoo’s holding area, with little or no exposure to the public gaze. In between these …

Why This Time Is Different: The Perfect Storm And The Future Of Legal Education, Martin J. Katz Oct 2011

Why This Time Is Different: The Perfect Storm And The Future Of Legal Education, Martin J. Katz

Sturm College of Law: Faculty Scholarship

When we discuss legal education reform, some of the more jaded members of our community often ask, “Why is this time any different?” They rattle off a list of dust-covered reports about proposed reforms for legal education, often dating back several decades, and wonder how we can be optimistic about the prospects for meaningful reform now.

The answer is that we are in the midst of a perfect storm; one in which several powerful forces are driving law schools toward reform.

Taxes, Free Expression, And Adult Entertainment, Steve R. Johnson

Scholarly Publications

The interaction of morality and money produces interesting results. One manifestation is legislation in some states and proposals in others to impose higher taxes on “gentlemen’s show lounges” (OK, I mean strip clubs) and other venues of adult entertainment.

In 2010 and 2011 two state supreme courts passed on the legality of different forms of those taxes, upholding them against challenges that they infringed on free speech/free expression rights protected by the First Amendment of the U.S. Constitution. This installment of the column considers those two decisions: the February 2010 Utah decision in Bushco v. Utah State Tax Commi …

Approaches To Open Data For Science In Spain, E Wulff-Barreiro

Copyright, Fair Use, Scholarly Communication, etc.

As observational data has attained new legal status, allowing their integration into open Internet systems, and experimental data continues to be assembled in common and free platforms, state of the art, easy to access data repositories have been designed in Spain. These repositories have removed many obstacles to re-utilization of GIS and other data. European legislation has also made advances in opening biodiversity data, including a European space in the Latin-American grid infrastructure. Open access biomedical repositories attract commercial attention while astronomical, meteorological, and oncological institutions promote data quality and access. This paper describes recent approaches to open access data …

Acta And Access To Medicines, Sean Flynn, Bijan Madhani

Joint PIJIP/TLS Research Paper Series

The Greens/EFA Internet Core Group in the European Parliament, and a collection of its individual members, commissioned this analysis of potential impacts of the Anti-Counterfeiting Trade Agreement (ACTA) on access to medicines in developing countries.” On the whole, ACTA negotiators created an agreement that shifts international “hard law” rules and “soft law” encouragements toward making enforcement of intellectual property rights in courts, at borders, by the government and by private parties easier, less costly, and more “deterrent” in the level of penalties. In doing so, it increases the risks and consequences of wrongful searches, seizures, lawsuits and other enforcement actions …

No Child Left Behind, or the Elementary and Secondary Education Act, is long overdue for reauthorization. In a somewhat surprising move last week, President Obama unilaterally created rules for NCLB waivers. This policy brief provides a brief background, followed by a discussion on the new NCLB flexibility and how these changes could affect schools in Arkansas.

An Industry-Specific Vat In Michigan - Objective Valuation In The Retail Gasoline Trade, Richard Thompson Ainsworth Oct 2011

An Industry-Specific Vat In Michigan - Objective Valuation In The Retail Gasoline Trade, Richard Thompson Ainsworth

Faculty Scholarship

New York adopted an industry-specific value added tax (VAT) to solve problems with virtual intermediaries (room remarketers) under its hotel accommodations tax. The New York VAT resembles the VAT used in the European Union (EU). It is a credit-invoice VAT that subjectively values supplies.

Michigan has also adopted an industry-specific credit-invoice VAT, however the targeted industry is the retail gasoline trade. The valuation method is objective, rather than subjective. In valuing supplies objectively rather than subjectively, the Michigan VAT resembles the exception provisions that are found in most VATs around the globe. Objective valuations are used in VATs when dealing …
