Yada, Yada, Yada: Seinfeld, The Law And Mediation, Paul Devendorf
Cardozo Journal of Conflict Resolution
This Note will first explore the popularity of Seinfeld and discuss the influence of Seinfeld on legal culture. Part III details cultivation theory and explores the possible influences Seinfeld may have in shaping its viewers' impressions of formal law. Specific instances in-which Seinfeld has ridiculed formal legal practices and offered social criticisms of the legal profession are analyzed in Part IV. Part V describes a specific episode of Seinfeld and illustrates the consequences of parties' refusal to reach mutually satisfactory resolutions, the need for mediation to resolve highly contentious disputes, and the inadequacy of the legal system to provide an …

Judges Gone Wild: Why Breaking The Mediation Confidentiality Privilege For Acting In "Bad Faith" Should Be Reevaluated In Court-Ordered Mandatory Mediation, Samara Zimmerman
Cardozo Journal of Conflict Resolution
This Note focuses on the reasons why a good faith requirement or a bad faith exception for breaking mediation confidentiality is objectionable and offers an alternative for the Florida court system that, if implemented, could mitigate such disadvantages. I will discuss "the intersection between [a] court-ordered mediation, the confidentiality of which is mandated by law ... and the power of a court to control proceedings," and persons who appear before it by sanctioning conduct that taking place in mediation. Part II of this Note will begin by providing a background to the Doe v. Francis civil case. It will highlight …

Strength In Numbers: Setting Quantitative Criteria For Listing Species Under The Endangered Species Act, Kalyani Robbins
Strength In Numbers: Setting Quantitative Criteria For Listing Species Under The Endangered Species Act, Kalyani Robbins
Akron Law Faculty Publications
My primary thesis is that the Fish & Wildlife Service and the National Marine Fisheries Service need to set quantitative criteria for listing species under the Endangered Species Act in order to promote consistency, transparency, and efficiency. I suggest a model for doing so, the use of which would create an opportunity to move beyond the political quagmire surrounding the selection of vulnerable species for preservation. Like my other environmental scholarship, the article merges scientific research in the field of conservation biology with legal analysis. With the status quo, listing decisions often turn on wildly different factors, including some not …

Empathy And Pragmatism In The Choice Of Constitutional Norms For Religious Land Use Disputes, Elizabeth Reilly
Empathy And Pragmatism In The Choice Of Constitutional Norms For Religious Land Use Disputes, Elizabeth Reilly
Akron Law Faculty Publications
From the perspective of both religious entities and local governments, religious land use requests are best resolved quickly, locally and cooperatively. The traditional framework for addressing religious land use disputes, which the Religious Land Use and Institutionalized Persons Act (RLUIPA)1 adopted, is ill-suited to those goals. Legally, disputes have long been framed as denials of the free exercise of religion – the broadest of all claims and the one requiring the most intrusive and subjective determinations about a particular religious group and its proposed use (what religion is, what a particular sect requires and how religion qua religion is affected …
Riots And Cover-Ups: Counterproductive Control Of Local Agents In China, Carl F. Minzner
Riots And Cover-Ups: Counterproductive Control Of Local Agents In China, Carl F. Minzner
Faculty Scholarship
Chinese cadre responsibility systems are a core element of Chinese law and governance. These top-down personnel systems set concrete target goals linked to official salaries and career advancement. Judges and courts face annual targets for permissible numbers of mediated, reversed, and closed cases; Communist Party secretaries and government bureaus face similar targets for allowable numbers of protests, traffic accidents, and mine disasters. For many local Chinese officials, these targets have a much more direct impact on their behavior than do formal legal and regulatory norms.
This Article argues that Chinese authorities are dependent on responsibility systems, particularly their use of …

Switzerland has the traditional Austro-German representative association procedures. Debate on adoption of other models, given the opportunity of the introduction of a first federal Code of Civil Procedure, reveals considerable cautious conservatism toward reform.
39th Congress (1865-1867) And The 14th Amendment: Some Preliminary Perspectives, Richard Aynes
39th Congress (1865-1867) And The 14th Amendment: Some Preliminary Perspectives, Richard Aynes
Akron Law Faculty Publications
The 39th Congress (1865-1867) was one of the important Congresses in our history. It passed more legislation than any other Congress up to that time.
This preliminary examination of the 39th Congress begins with a look it composition. One of the critical factors was that while the 38th Congress contained a majority of unionists, the 39th Congress contained a super-majority which meant not only that they could override a Presidential veto, but also that they did not need to take the Democratic opposition seriously. This article also identifies the leadership of the 39th Congress. The 38th Congress was composed of …

Palsgraf, Principles Of Tort Law, And The Persistent Need For Common-Law Judgment In Ip Infringement Cases, Jay Dratler Jr.
Akron Law Faculty Publications
As lawyers, judges and law professors reach retirement age, there is little that we remember of our first-year course in torts. The cases we studied, our professors’ personalities—even the psychological trauma of the first pointed Socratic question directed at us—all are lost in the mists of time.
Yet some things remain. Among them are the name and facts of Palsgraf v. Long Island Railroad Co., one of the most memorable cases in all of American common law. A great judge, Benjamin Cardozo, penned the majority opinion.
The facts of Palsgraf stick in our minds because Judge Cardozo helpfully outlined them …
Cross Burning A Hate Speech Under The First Amendment To The United States Constitution, Wilson Huhn
Cross Burning A Hate Speech Under The First Amendment To The United States Constitution, Wilson Huhn
Akron Law Faculty Publications
Under the First Amendment of the Constitution of the United States, ‘hate speech’ is constitutionally protected unless the circumstances of the case indicate that the speaker intended to threaten violence or provoke an immediate act of violence. While a person may be removed from a classroom or fired from employment for engaging in ‘hate speech’, under the First Amendment a person may be charged with a crime only if their statements constitute a threat or provocation of immediate violence. Moreover, even in cases where it is clear that a person is threatening violence or that violence is imminent, the person …

Reforming Eyewitness Identification Law And Practices To Protect The Innocent, Margery Koosed
Akron Law Faculty Publications
This article discusses varying eyewitness identification reform proposals that may help to finally achieve a greater level of reliability in this critical phase of the criminal justice process. The author concludes a comprehensive reform that includes tightening exclusionary rules, along with (minimally) corroboration requirements for death-sentencing, and more appropriately, for convictions in capital and non-capital cases, with a concomitant loosening of standards for relief on appeal, hold the most promise.
The article addresses adopting best practices; assuring compliance by means of exclusion; admitting expert testimony and educating juries; instructing on the vagaries of eyewitness identification; requiring corroboration with independent and …

Infinite Hope-- Introduction To The Symposium: The 140th Anniversary Of The Fourteenth Amendment, Elizabeth Reilly
Akron Law Faculty Publications
The Fourteenth Amendment embodies hope. This article introduces the Symposium celebrating the 140th anniversary of its ratification, held at the University of Akron. The symposium was a fruitful occasion to reflect upon the meaning of the Amendment to its Framers in Congress and as it was initially interpreted by the United States Supreme Court and the public, and to examine the lasting impacts of both conceptions. Our participants especially examined three of the Supreme Court's earliest forays into applying the Fourteenth Amendment: The Slaughter House Cases, Bradwell v. Illinois, and Cruikshank v. United States. Those forays succeeded in cramping the …
Where Are The Victims? The Credibility Gap In Human Trafficking Research, Johnny E. Mcgaha, Amanda Evans
Where Are The Victims? The Credibility Gap In Human Trafficking Research, Johnny E. Mcgaha, Amanda Evans
Intercultural Human Rights Law Review
Nothing drives the passion and stirs the emotion, especially in the U.S., more than the horrendous stories of modem-day human slavery. Whether sexual, domestic, or labor, the terror and horror that human trafficking victims have endured defies the scope of our sensitivities. Most who work in human service fields have heard many stories of these survivors. The dedication of the practitioners and law enforcement officers who are involved in the apprehending and prosecution of offenders, and advocate for victims in these very complex cases, is evident in this symposium alone. As a nation, the stain of slavery has tarnished the …

Post-Traumatic Stress Disorder And Victims Of Human Sex Trafficking: A Perpetuation Of Chronic Indignity, Angela A. Jones
Intercultural Human Rights Law Review
As a child, my parents taught me that Communism was the great threat to the world. They told me that people who lived under a Communist government could not travel outside their country, and they had to obey the government's decisions about their life- where they lived, what jobs they could work, and even what they could and could not believe in spiritually. My mother showed me where the U.S.S.R. was located on the globe, and all of the countries around it that were also Communist. Visually, I saw that Communism encompassed what looked like half of the globe, and …

Embargo Or Blockade - The Legal And Moral Dimensions Of The U.S. Economic Sanctions On Cuba, Berta Esperanza Hernandez-Truyol
Intercultural Human Rights Law Review
This essay will evaluate the embargo and its consequences in three parts. First, it briefly sets out the Human Rights framework within which this work scrutinizes the embargo. Following it presents a brief history of Cuba-U.S. relations including the creation and progression of the economic sanctions the U.S. has imposed on the neighboring island. Next, the essay evaluates the legality of the sanctions and concludes with a critical analysis of the impact of the sanctions.
The Legal Nature Of Trafficking In Human Beings, Ryszard Piotrowicz
The Legal Nature Of Trafficking In Human Beings, Ryszard Piotrowicz
Intercultural Human Rights Law Review
It is incorrect to say that people trafficking is a breach of human rights for the same reason that it is incorrect to say that 2+2=5: because it is wrong and there is an inherent good in getting things right. This article assesses what, legally, is actually happening when trafficking in human beings (THB) takes place, and considers the practical ramifications arising from that assessment. What actually is THB? The most widely accepted definition is contained in the Palermo Protocol (the Protocol) to the United Nations Convention on Transnational Organised Crime (UNCTOC), which entered into force in December 2003. Article …
Human Trafficking In The Balkans: An Inside Report, Jasna Vujin
Human Trafficking In The Balkans: An Inside Report, Jasna Vujin
Intercultural Human Rights Law Review
Human trafficking is not a myth or something that is part of our volatile past. It is not a problem that is targeting isolated parts of the world making only a small number of people its victims. It is our menace today and part of the cruel reality that we are raising our children in. It is a plague that endangers the world community, for no part of the globe is immune. How is it possible then that in this day and age, when the safeguarding of human rights is considered such a priority by many nations, human slavery continues …

Doctrine And Fairness In The Law Of Contract, Andrew B.L. Phang
Research Collection Yong Pung How School Of Law
This paper explores, through illustrations from the law of contract, the important centraltheme to the effect that the rules and principles, which constitute thedoctrineof the law,are not ends in themselves but are, rather, the means through which the courts arrive atsubstantively fairoutcomes in the cases before them. The paper focuses on the concept of‘radicalism’, which relates to the point at which the courts decide that it is legallypermissible to hold that a contract should come to an end because a radical or funda-mental ‘legal tipping point’ has not only been arrived at but has, in fact, been crossed. Itexplores the …

The Andean Tribunal Of Justice And Its Interlocutors: Understanding Preliminary Reference Patterns In The Andean Community, Laurence R. Helfer, Karen J. Alter
Faculty Scholarship
In the European Union, national courts have been key intermediaries in helping to bolster and expand the authority of the European Court of Justice through its preliminary reference mechanism. This article analyzes the role of national judges in the Andean Community, a regional legal system whose judicial institution - the Andean Tribunal of Justice (ATJ) - was modeled directly on its European predecessor. Our analysis is based on an original coding of every publically available national court referral to the ATJ from 1987 to 2007 and interviews with over forty participants in the Andean legal system. We find that the …

Stories Of Crime, Trials, And Appeals In Civil War Era Missouri, Frank O. Bowman Iii
Faculty Publications
This paper explores criminal appellate practice in Missouri from the time of statehood in 1821 until the 1870s, with particular focus on the decades before and after the Civil War. The article uses the stories of three trials in and around Columbia, Missouri - an attempted rape case against a slave that resulted in a lynching, a murder case against a white farmer that ended in his execution, and another murder case successfully appealed - to explore the legal culture of the period. All three trials involved two prominent central Missouri lawyers, James S. Rollins and Odon Guitar, who were …

Jicarilla Apache Nation Tribal Court Handbook (2009), Tribal Law Journal Staff
Tribal Law Journal
This handbook helps take some of the mystery out of practicing in tribal courts. Without the necessary information to learn new rules and protocols many attorneys are understandably reluctant to practice in a new jurisdiction. As a result, tribal courts are underused or misused. This handbook is intended to help attorneys and advocates become more aware of the various individual tribal court systems and to learn their rules and protocol.
