White Robes And Black Robes: The Nebraska Supreme Court’S Vacatur In State V. Henderson, Daniel J. Hassing
White Robes And Black Robes: The Nebraska Supreme Court’S Vacatur In State V. Henderson, Daniel J. Hassing
Nebraska Law Bulletin (Selected Issues)
This commentary argues that the Nebraska Supreme Court erred in applying the narrow public policy exception to the enforcement of arbitration awards. In doing so, the court relied on a crafty conceptualization and organization of supposed public policy. It was only by this judicial sleight of hand that the court could have argued that it was staying true to the Supreme Court’s case law on the exception. Unfortunately, this sleight of hand transforms what is supposedly a narrow exception into one that is potentially vast. This commentary argues that the solution to this problem can be found in Justice Scalia’s …

The U.S. Supreme Court will hear oral argument this fall in Salazar v. Buono, No. 08-472, a matter that involves a Latin cross located in the Mojave National Preserve located in Southeastern California and operated by the National Park Service. First placed there as a memorial to American’s who served in WWI, this Christian symbol is said to violated the Establishment Clause of the First Amendment. Before reaching the merits, however, the Court must first pass on the question of standing to sue. The plaintiff, Frank Buono, is a former employee of the National Park Service and objects to the …

Reconciliation Financing: An Innovative Approach To Poverty, Inequality, And Social Conflict, Daniel D. Bradlow
Reconciliation Financing: An Innovative Approach To Poverty, Inequality, And Social Conflict, Daniel D. Bradlow
Working Papers
This paper focuses on the problem of addressing historical injustices and raising finance for small scale revenue generating projects that benefit those victims of these past injustices who still lack access to jobs, services and opportunities. These projects always experience funding problems. They are considered both "too rich" for grant funding because they generate a stream of revenues but "too poor" for commercial funding because either they are too small or they generate an insufficient income stream to be attractive to commercial funders. In proposing a debt-based solution to these funding problems, the paper proposes 3 principles of "reconciliation financing".

Section 411(a) of the Copyright Act of 1976 provides that “no civil action for infringement of the copyright in any United States work shall be instituted until preregistration or registration of the copyright claim has been made.” In this case, a district court approved a class action settlement that purported to resolve both registered and unregistered copyright claims. The Supreme Court is being asked to decide whether that registration requirement is a limitation on federal court subject-matter jurisdiction.
A Human Rights-Oriented Approach To Military Operations, Federico Sperotto
A Human Rights-Oriented Approach To Military Operations, Federico Sperotto
Human Rights & Human Welfare
Counterinsurgency is the dominant aspect of US operations in Afghanistan, and since ISAF—the NATO-led security and assistance force—has assumed growing security responsibility throughout the country, it is also a mission for the Europeans.1 The frame in which military operations are conducted is irregular warfare, a form of conflict which differs from conventional operations in two main aspects. First, it is warfare among and within the people. Second, it is warfare in which insurgents avoid a direct military confrontation, using instead unconventional methods and terrorist tactics.

Repression And Punishment In North Korea: Survey Evidence Of Prison Camp Experiences, Stephan Haggard, Marcus Noland
Repression And Punishment In North Korea: Survey Evidence Of Prison Camp Experiences, Stephan Haggard, Marcus Noland
Human Rights & Human Welfare
The penal system has played a central role in the North Korean government’s response to the country’s profound economic and social changes. Two refugee surveys—one conducted in China, one in South Korea—document its changing role. The regime disproportionately targets politically suspect groups, particularly those involved in market-oriented economic activities. Levels of violence and deprivation do not appear to differ substantially between the infamous political prison camps, penitentiaries for felons, and labor camps used to incarcerate individuals for misdemeanors, including economic crimes. Substantial numbers of those incarcerated report experiencing deprivation with respect to food as well as public executions and other …

Waste No Land: Property, Dignity And Growth In Urbanizing China, Eva M. Pils
Waste No Land: Property, Dignity And Growth In Urbanizing China, Eva M. Pils
Cornell Law Faculty Working Papers
The Chinese state does not allow rural collectives to sell land, but takes land from them and makes it available on the urban property market. While rural land rights are thus easily obliterated, the newly created urban rights in what used to be rural land enjoy legal protection. The state justifies these land takings by the need for urbanization and economic growth. The takings have resulted in an impressive contribution of the construction and property sector to state revenue and GDP growth, but also in unfairness toward peasants evicted from their land and homes. The example discussed here shows that …
