Externships And New Lawyer Mentoring: The Practicing Lawyer's Role In Educating New Lawyers, James Backman May 2009

Externships And New Lawyer Mentoring: The Practicing Lawyer's Role In Educating New Lawyers, James Backman

Brigham Young University Journal of Public Law

Law schools and bar associations have begun successful and sustainable programs to assist law students and new lawyers in making the transition from law school to the first year of legal practice. The key to the universal availability of these proven approaches is the willingness of experienced lawyers to become supervising mentors for law school externship programs and for bar association mentoring programs for new lawyers. The traditional roadblocks to implementation of these programs have disappeared by eliminating the heavy costs involved in traditional law school clinical programs and by adding quality controls to bar association programs to assure that …

Land Virtues, Eduardo Peñalver May 2009

Land Virtues, Eduardo Peñalver

Articles

This Article has two goals. First, I explore some of the descriptive and normative limitations of certain law-and-economics discussions of the ownership and use of land. These market-centered approaches struggle in different ways with features of land that distinguish it from other "commodities." The complexity of land-its intrinsic complexity, but even more importantly the complex ways in which human beings interact with it-undermines the positive claim that owners will focus on a single value, such as market value, in making decisions about their land. Adding to the equation land's "memory," by which I mean the combined impact of the durability …

Is Sharif's Castle Deductible? Islam And The Tax Treatment Of Mortgage Debt, Roberta Mann May 2009

Is Sharif's Castle Deductible? Islam And The Tax Treatment Of Mortgage Debt, Roberta Mann

William & Mary Bill of Rights Journal

This Article examines the tax treatment of Islamic mortgage alternatives and considers the cultural and constitutional implications of the tax treatment of mortgage debt. Islamic law cannot be separated from the religion of Islam, and one of the primary tenets of Islamic law is the prohibition of riba, which is defined by some Islamic jurists as the payment of interest on any loan. Financing institutions, working with Muslim religious leaders, have developed a number of financing instruments that do not violate the prohibition against riba, thus facilitating home ownership for those Muslims who do not feel comfortable with a traditional …

The International Criminal Court, Mark Gibney May 2009

The International Criminal Court, Mark Gibney

Human Rights & Human Welfare

I believe I speak for many when I say that the International Criminal Court (ICC) has not been anywhere near the institution that it was anticipated as being, and the latest manifestation of the ICC’s shortcomings is the humanitarian disaster that has ensued after the Court issued an arrest warrant against Sudanese President Bashir. Since no other UN action is anticipated, all that remains is to count the ever-growing number of Sudanese deaths that will result from what now appears to be a purely symbolic act that was all-too predictable.

Adjudication For The Adjudicators?, Rebecca Otis May 2009

Adjudication For The Adjudicators?, Rebecca Otis

Human Rights & Human Welfare

Coming from the perspective of one who roundly agrees with Kofi Annan that the creation of the International Criminal Court was “a gift of hope to future generations, and a giant step forward in the march towards universal human rights and the rule of law,” it is deeply troubling to read reports of corruption within the body of the UN. Julie Flint and Alex de Waal’s piece this month judiciously exposes yet another facet of questionable activities, namely at the heart of the ICC. Flint and de Waal’s piece quickly deepens into a long list of allegations against the personal …

Character Assassination In The Court Of Public Opinion, Tyler Moselle May 2009

Character Assassination In The Court Of Public Opinion, Tyler Moselle

Human Rights & Human Welfare

Alex de Waal and Julie Flint employ character assassination on Luis Moreno Ocampo in their World Affairs article “Case Closed: A Prosecutor Without Borders.” Ironically, they are guilty of the same crime they accuse Ocampo of: being overly occupied with the court of public opinion. Or perhaps, that is the only court they as Sudan specialists, and Ocampo as the ICC’s first Prosecutor, have recourse to when attempting to right the wrongs of injustice.

Law Library Newsletter, Volume 1, Issue 1 - May/June 2009, Kresge Law Library

Law Library Newsletter

You either have in your hands a printed page or are reading from a screen a copy of volume 1, number 1, of Law Library News and that is entirely appropriate. As the Kresge Law Library continues its physical transformation into the wonderful space that will become its home in Biolchini Hall, those of us who toil here and those of you who benefit from our work on your behalf are also continuing to experience a dramatic transformation in the delivery of legal information. During the 18 months of renovation, two-thirds of the library’s physical collection is located offsite. Yet, …
