What's Race Got To Do With It? Press Coverage Of The Latino Electorate In The 2008 Presidential Primary Season, Laura Gomez

Faculty Scholarship

This article presents a critical analysis of press coverage of Latinos and the presidential election during the Democratic Primary, from January through June 2008. The foundation of this article is a content analysis of 408 articles published in four newspapers about Latinos and the presidential election during the primary season. The four newspapers -- The Los Angeles Times, The New York Times, The Chicago Tribune and The Dallas Morning News -- were selected because they are well respected as newspapers of record and because they represent diverse regions of the country (two from the northeast, two from the southwest). Each …

The Fog Of Certainty, Robert B. Ahdieh Sep 2009

The Fog Of Certainty, Robert B. Ahdieh

Faculty Scholarship

In a recent essay in the Yale Law Journal, constitutional law scholar Michael Stokes Paulsen argues that “[t]he force of international law, as a body of law, upon the United States is . . . largely an illusion.” Rather than law, he suggests, international law is mere “policy and politics.”

For all the certainty with which this argument is advanced, it cannot survive close scrutiny. At its foundation, Professor Paulsen’s essay rests on a pair of fundamental misconceptions of the nature of law. Law is not reduced to mere policy, to begin, simply because it can be undone. Were that …

Thoughts On The Churn Law, Michael Halley Sep 2009

Thoughts On The Churn Law, Michael Halley

NULR Online

A grand alliance is forming, and new trenches are being dug on the old and hallowed battleground of the Constitution. Waving the stars and stripes of “constitutional design,” and richly equipping themselves with the weaponry of reason, scholars like Richard Fallon, Sanford Levinson, and Jack Balkin have taken the field to determine “what provisions for judicial review (if any) ought to exist in constitutions for all societies whose people and legislatures are seriously committed to respecting rights,” and to avoiding “constitutional crises” by “careful planning.” Fallon, a self-proclaimed “system-designer,” applauds himself for having “plowed rich ground.” Levinson and Balkin claim …

Testimony Before Congress

We are long past the point when our laws should permit discrimination against any individual because of their sexual orientation. Just as we do not tolerate behavior that discriminates based on race, gender, national origin or religion, so should we be clear about discrimination based on the characteristic of being gay or lesbian. For many of America’s faith traditions, this is a religious value. It is a moral value. And for all of us, it is of great social and economic value, as evidenced by the nearly 90% of Fortune 500 companies that already have policies consistent with ENDA. They …

Strengthening Security And Oversight At Biological Research Laboratories, Michael Greenberger Sep 2009

Strengthening Security And Oversight At Biological Research Laboratories, Michael Greenberger

Congressional Testimony

With the advent of the Anthrax attacks in the fall of 2001, this Nation has been confronted with a serious policy conundrum. On the one hand, we have strengthened programs that encourage the use of our best scientific resources to develop countermeasures to the weaponization of highly dangerous biopathogens. On the other hand, research on those countermeasures requires the use of the very biopathogens we seek to defeat. There have been many mishaps in the handling of those pathogens, which raises the frightening prospect that the research may be as (or more) dangerous than the potential bioterrorist acts themselves. Indeed, …

Does Current Antitrust Regulation Provide Free Parking For Ebay And Paypal In The Monopoly Game Of Online Auction Sites And Person-To-Person Online Payment Systems?, David S. Shevitz

Loyola of Los Angeles Entertainment Law Review

EBay currently dominates the online auction market with a market share exceeding 90% in several prominent European countries. Until recently, eBay sellers were permitted to accept a wide array of payment options from buyers including wire transfers, money orders, and checks, as well as credit card payments through PayPal and other merchant accounts. However, pursuant to eBay's paperless payment policy enacted on November 11, 2008, sellers may no longer accept personal checks, cashier's checks, money orders, or wire transfers except in limited circumstances. In response to that policy as well as other alleged anticompetitive acts, a class action consolidated lawsuit …

Why Can't We Be Friends? It's War!, William Henslee

Loyola of Los Angeles Entertainment Law Review

The original WAR wrote and performed the classic songs: "Lowrider," "Cisco Kid," "Slippin' Into Darkness," "The World is a Ghetto," "All Day Music," and "Why Can't We Be Friends," among others. "Why Can't We Be Friends" is not only one of the bands largest hits, but a mantra for the relationships within the band and their production company/managers. Shortly after forming, the band and its production company started suing each other. In 2001, the original members of WAR lost their name in federal court to their production company/manager. The current state of the litigation has the production company as the …

Experimenting With Territoriality: Pan-European Music License And The Persistence Of Old Paradigms, Ana Eduarda Santos Sep 2009

Experimenting With Territoriality: Pan-European Music License And The Persistence Of Old Paradigms, Ana Eduarda Santos

Duke Law & Technology Review

This article tells the story of what could have been an interesting and important shift in our approach to territoriality in the digitalized world. Europe had the chance to be the cradle of an unprecedented copyright experience – the creation of a quasi pan- continental license in the music field – but it might have lost that opportunity in the midst of non-binding recommendations and resolutions. This article argues this loss is due to the overreaching persistence of old paradigms, namely the principle of territoriality.

Popping Britney's Personal Safety Bubble: Why Proposed Anti-Paparazzi Ordinances In Los Angeles Cannot Withstand First Amendment Scrutiny, Gary Wax

Loyola of Los Angeles Entertainment Law Review

Lawmakers in Los Angeles and in surrounding cities recently proposed the creation of personal safety zones around celebrities to curtail the activities of overly aggressive paparazzi. Nevertheless, First Amendment jurisprudence has generally protected photographers from civil invasion of privacy claims in public, assuming the photographer did not commit any independent crime or tort, especially where the subject matter of the photograph is a matter of public concern. Celebrities are "public figures," and are thus subject to news coverage protected by the First Amendment absent false malicious speech. Furthermore, celebrities who choose to live in celebrity-enclaves in the Los Angeles area …
