Protecting The Family Pet: The New Face Of Maryland: Domestic Violence Protective Orders, Gary C. Norman Oct 2009

Protecting The Family Pet: The New Face Of Maryland: Domestic Violence Protective Orders, Gary C. Norman

Celebrating WCL Student Authors

Domestic violence is on the rise, and pets are increasingly becoming the victims of marital disputes. There is a demonstrated link between acts and offenses of domestic violence and animal abuse. Domestic abusers often do not think twice about beating or otherwise harming pets that have bonded with the other spouse in order to control, coerce, intimidate, or cause emotional harm to that spouse.

There is an emerging awareness that animals are more than just property. Several states have recognized, through the enactment of legislation fortifying their family law systems, that animals play an integral role in the lives of …

'A Literary Man & A Merchant': The Legal Career Of Sir William Young, William H. Laurence Oct 2009

'A Literary Man & A Merchant': The Legal Career Of Sir William Young, William H. Laurence

PhD Dissertations

Sir William Young (1799-1887) of Halifax was a leading lawyer, served as Attorney General, promoted legal reforms in the Assembly, sat as Chief Justice of the Nova Scotia Supreme Court, and promoted the establishment of Dalhousie University's Faculty of Law. He thereby fulfilled a variety of roles in his pursuit of two professional goals he had set at an early age, namely material success and intellectual interest. Nonetheless, his career in the law has been mostly ignored. By examining Young's legal career in detail, especially by paying attention to the duties he performed in his professional roles, this thesis seeks …

Restructuring A Green Grid: Legal Challenges To Accommodate New Renewable Energy Infrastructure, Steven Ferrey Oct 2009

Restructuring A Green Grid: Legal Challenges To Accommodate New Renewable Energy Infrastructure, Steven Ferrey

Suffolk University Law School Faculty Works

Things are never as simple as they might appear - and that is particularly true of understanding the demands on the new “smarter” grid. That “smarter” grid will include expanded renewable energy sources and new copper wire transmission to connect these new sources to load centers. Sounds simple, but there is much more to it to get it right. Electricity is our one form of energy that is not capable of efficient or low-cost storage; the grid must remain perfectly balanced second by second, or the power system collapses, as it did in California during its 2000–2001 electric system crisis, …

Retribution's Role, John Bronsteen Oct 2009

Retribution's Role, John Bronsteen

Indiana Law Journal

Two main types of principle, retributive and consequentialist, have long been identified as the main approaches to justifying criminal punishment. Retributivists deem punishment justified by the wrongdoing of the offender, whereas utilitarians deem it justified by its good consequences such as deterring future crime. Over the past fifty years, each has spent decades as the dominant theory, and many hybrid theories have also been advanced. But few, if any, of the hybrid approaches have valued heavily both retributive and consequentialist considerations while locating the particular justificatory role each category plays. This Article points in that direction by reframing the central …

The Future Of Shareholder Democracy, Lisa M. Fairfax Oct 2009

The Future Of Shareholder Democracy, Lisa M. Fairfax

Indiana Law Journal

In 2007, the Securities and Exchange Commission (SEC) considered, and ultimately rejected, a rule that would have required corporations to include shareholder-nominated candidates on the ballot. This Article seeks to ascertain the impact of this rejection. On the one hand, the SEC's rejection appears to be a stunning blow to the shareholders' rights campaign. This is because many shareholders' rights advocates have long considered access to the corporate ballot as the "holy grail" of their campaign for increased shareholder power. Such advocates believe that access to the corporate ballot is critical to ensuring that shareholders can participate legitimately in the …

Accounting For Differences Among Patients In The Fda Approval Process, Mark Van Der Laan, Anup Malani, Oliver Van Der Bembom

Public Law and Legal Theory Working Papers

The FDA employs an average-patient standard when reviewing drugs: it approves a drug only if the average patient (in clinical trials) does better on the drug than on control. It is common, however, for different patients to respond differently to a drug. Therefore, the average-patient standard can result in approval of a drug with significant negative effects for certain patient subgroups (false positives) and disapproval of drugs with significant positive effects for other patient subgroups (false negatives). Drug companies have a financial incentive to avoid false negatives. After their clinical trials reveal that their drug does not benefit the average …
