Cityland – Vol. 4, No. 5, Center For New York City Law
Cityland – Vol. 4, No. 5, Center For New York City Law
CityLand - 2007
The June 2007 issue of CityLand covers major land use, preservation, and development actions across New York City. The City Council approved two affordable housing projects in Harlem despite community opposition and added restrictions to the sale of four former firehouses, limiting them to community use. Solow Management’s proposed 37-story tower on York Avenue entered public review, and HPD’s Boricua Village proposal for a large mixed-use development in Melrose, Bronx was approved. City Planning increased CEQR and ULURP fees. BSA dismissed a contentious Breezy Point appeal and approved a Dumbo residential conversion. A catering hall in Boro Park was ordered …

Summary Of Schmidt V. Washoe County, 123 Nev. Adv. Op. No. 16, Matthew H. Engle
Nevada Supreme Court Summaries
Gary R. Schmidt raised six alleging violation of Nevada’s Open Meeting Law, NRS § 241 et seq. The first four stemmed from a Washoe County Board of Commissioners (“WCBC”) meeting on January 11, 2005. First, that the WCBC violated the Open Meeting Law by “pulling” a lobbying contract from its agenda. Second, that WCBC violated the law when it allegedly deliberated on whether to remove the lobbying contract item from its agenda. Third, that WCBC improperly reduced his allotment of time to speak on the lobbying contract. Fourth, that WCBC improperly refused to read into the record letters written by …

Summary Of Johnson V. State, 123 Nev. Adv. Op. No. 17, Michael J. Gayan
Nevada Supreme Court Summaries
Appellant Jeffrey Lee Johnson communicated via the Internet with several undercover law enforcement officers who he thought were 14-year-old girls. Based on the nature of the conversations, Johnson was charged under the attempt provision of NRS 201.560.2 Johnson pleaded guilty to one count of violating NRS 201.560 and failed to file a direct appeal. Johnson filed a post-conviction petition for a writ of habeas corpus in the district court, claiming ineffective assistance of counsel. Johnson argued that his counsel was ineffective for not arguing that it was impossible for Johnson to violate the attempt provision of NRS 201.560 because no …

This Town Ain’T Big Enough For The Both Of Us—Or Is It? Reflections On Copyright, The First Amendment And Google’S Use Of Others’ Content, David Kohler
Duke Law & Technology Review
Using a variety of technological innovations, Google became a multi-billion dollar content-delivery business without owning or licensing much of the content that it uses. Google’s principal justification for why this strategy does not contravene the intellectual property rights of the copyright owners is the doctrine of fair use. However, over the last several years, some copyright owners began to push back and challenge Google’s strategy. Much of this litigation presents the courts with something of a conundrum. On the one hand, it is beyond dispute that Google’s services have great social utility. By organizing and making accessible an enormous volume …
The Twenty-First Century Jury: Worst Of Times Or Best Of Times?, Valerie P. Hans
The Twenty-First Century Jury: Worst Of Times Or Best Of Times?, Valerie P. Hans
Cornell Law Faculty Publications
In thinking about legal developments, new research findings, and the continuing swirl of controversy over this venerable American institution, I observe the same paradoxical condition that Charles Dickens found in 18th Century London: "It was the best of times; it was the worst of times." There is evidence of both the expansion of jury trial rights, yet contraction of jury trials. Research evidence indicates that juries perform well, yet the 21st Century jury confronts more complex decision making tasks and continuing doubts about its fairness and competence.

This is a policy grievance brought by the Union because the Employer refused to allow employees, who were accepting an early retirement package, to include outstanding vacation time as time served. The Union wanted the remedy to include a recalculation of entitlement for the relevant employees, a declaration that the Employer had violated the Agreement and an order that eligible employees be allow to reconsider their choices based on this decision. The Employer's interpretation hinged on the fact that the departure date was subject to the Employer's approval.
