The court considered whether a judgment creditor in a domesticated foreign judgment may add a nonparty to a final judgment, under the alter ego doctrine, simply by moving to amend the judgment. The court held that such a procedure violates the due process rights of the nonparty whom the creditor seeks to add. To observe the requisite attributes of due process, a judgment creditor who wishes to assert an alter ego claim must do so in an independent action against the alleged alter ego.

In December 2000, Appellant Melinda Ellis (“Melinda”) and Respondent Roderic Carucci (“Roderic”) divorced. The divorce decree named both parties as joint legal custodians over their daughter, Geena. Further, the decree named Melinda as primary physical custodian with Roderic having liberal visitation rights. In 2004, after noticing a significant decline in Geena’s school performance, Roderic filed a motion with the district court requesting a custody modification. The district court considered the parties’ testimony and Geena’s elementary school teacher’s testimony. Further, the parties stipulated that a family evaluation would be conducted and a report submitted to the court. The evaluator recommended Geena …

Maintaining Competition In Copying: Narrowing The Scope Of Gene Patents, Oskar Liivak
Maintaining Competition In Copying: Narrowing The Scope Of Gene Patents, Oskar Liivak
Cornell Law Faculty Publications
In supporting gene patents, the patent office, the courts and other supporters have assumed that gene discoveries are identical to traditional inventions and therefore the patent system should treat them as identical. In other words, they have assumed that the relatively broad claims that are used for traditional inventions are also appropriate for encouraging gene discovery. This article examines this assumption and finds that gene discoveries are critically different from traditional inventions and concludes that the patent system cannot treat them as identical.
As a doctrinal matter, this article applies the generally overlooked constitutional requirements of inventorship and originality and …

Alex has a ten-year-old cassette of a favorite movie. Unfortunately, she does not have a video cassette player. She wants to copy the movie onto her iPod. To do this, she borrows a VCR from a friend, runs a cable to a video capture port on my computer, reformats the file into something the iPod can read, and sends the file to the iPod, which she will use to watch the movie in the future. After the file is securely on the iPod, she will delete all records of the movie from my computer. Destroy the original VHS copy seems …

A Gene × Gene Interaction Between Drd2 And Drd4 Is Associated With Conduct Disorder And Antisocial Behavior In Males, Kevin M. Beaver, John Paul Wright, Matt Delisi, Anthony Walsh, Michael G. Vaughn, Danielle Boisvert, Jamie Vaske
Criminal Justice Faculty Publications and Presentations
Background: Antisocial behaviors are complex polygenic phenotypes that are due to a multifactorial arrangement of genetic polymorphisms. Little empirical research, however, has been undertaken that examines gene × gene interactions in the etiology of conduct disorder and antisocial behavior. This study examined whether adolescent conduct disorder and adult antisocial behavior were related to the dopamine D2 receptor polymorphism (DRD2) and the dopamine D4 receptor polymorphism (DRD4).
Methods: A sample of 872 male participants from the National Longitudinal Study of Adolescent Health (Add Health) completed self-report questionnaires that tapped adolescent conduct disorder and adult antisocial behavior. DNA was genotyped for DRD2 …

Grounding Frequent Filers: The Trend Of Revoking The Special Status Of Overly Litigious Pro Se Litigants, Michael G. Langan
Court Review: Journal of the American Judges Association
Since the early 1990s, federal courts in the Second and Third Circuits have, with increasing frequency, revoked the special status of pro se civil litigants who have been overly litigious. This article discusses the reasons for this trend’s appearance in the Second and Third Circuits, the rationales for the trend, the fairness of the trend, and some practical advice for courts and practitioners wrestling with the issue of whether or not the special status of a particularly litigious pro se litigant should be revoked.

Recent Criminal Decisions Of The United States Supreme Court: The 2005-2006 Term, Charles Whitebread
Court Review: Journal of the American Judges Association
In this term, as in the previous one, the United States Supreme Court reasserted the rule of law in the context of the detainees in the war on terror. At the same time, however, the addition of two new justices shifted the Court’s ideological balance to the right. In terms of criminal cases, the Court handed down a mixed bag of decisions. It was a bad term for Fourth Amendment claimants with the government prevailing in four of five search-and-seizure cases. Outside the context of the Fourth Amendment, however, criminal defendants fared a little better. In this article, I review …

This column will seek to answer two questions: What does this mean? And how did it come about?

Public safety and criminal justice on Indian reservations are better served when Indian tribes play a central role in these functions. Most of the successes of law enforcement in Indian country have involved careful cooperation and coordination between law enforcement agencies of different sovereigns. Even informal cooperation can be highly effective in improving public safety. Lack of cooperation undermines public safety.
Evaluating Court Processes For Determining Indigency, Elizabeth Neeley, Alan J. Tomkins
Evaluating Court Processes For Determining Indigency, Elizabeth Neeley, Alan J. Tomkins
Court Review: Journal of the American Judges Association
The Sixth Amendment to the Constitution guarantees all people accused of a crime the right to legal counsel. In the landmark 1963 decision Gideon v. Wainright, 1 the United States Supreme Court affirmed the right of indigent defendants to have counsel provided. But Gideon did not end the Supreme Court’s discussion of the circumstances in which the state is required to provide defendants with an attorney when they claim not to have the means to pay for one. 2 Nor did it end the states’ examination of the requirement of any legal assistance paid for by taxpayers. 3 Moreover, …

Transit Orientation Reduces Car Dependency, John R. Nolon, Jessica A. Bacher
Transit Orientation Reduces Car Dependency, John R. Nolon, Jessica A. Bacher
Elisabeth Haub School of Law Faculty Publications
Urban dwellers emit less greenhouse gases per capita than their suburban or rural counterparts because urban environments are conducive to less automobile travel and require less energy to heat or cool their smaller urban living quarters. This article addresses the need for a more comprehensive transit oriented land use paradigm by taking the reader through a step-by-step approach to accomplishing this goal. The suggested model exemplifies the complexity of amending community planning and the importance of incorporating several different groups of people into the planning process. These groups include municipal, state, and federal governments, research groups, developers, and regional transportation …
