The Right To Secede, Mortimer N.S. Sellers Jan 2003

The Right To Secede, Mortimer N.S. Sellers

Book Chapters

This paper will consider the right to secede, by which I mean the right of a group of the citizens or subjects of an existing state to remove themselves from its political jurisdiction, taking with them some portion of their former state's territory, to form a new political entity. Secession diminishes existing states by narrowing their territorial jurisdiction. The right to secede assumes the previous existence of states and depends for its own justification on the antecedent justifications for statehood. When the reasons for secession outweigh the reasons that justify statehood, or serve those ends better than would the continued …

Sorting Through The Soup: How Do Llcs, Llps And Lllps Fit Withing The Regulations And Legal Doctrines?, Daniel S. Kleinberger

In a children' book published in 1946, Ben Ross Berenberg described an imaginary amalgam called the churkendoose - "part chicken, turkey, duck and goose." In 1977, Wyoming invented a business law churkendoose: the limited liability company - part corporation, part general partnership, part limited partnership. That churkendoose has revolutionized the law of business organizations, becoming the vehicle of choice for tens of thousands of ventures every month and causing the IRS to radically overhaul its approach to taxing business entities. This article explores how preexisting regulatory and common law apply to LLCs and the related organizations known as limited liability …

Minnesota's Sex Offender Commitment Program: Would An Empirically-Based Prevention Policy By More Effective?, Eric S. Janus Jan 2003

Minnesota's Sex Offender Commitment Program: Would An Empirically-Based Prevention Policy By More Effective?, Eric S. Janus

Faculty Scholarship

Minnesota’s sex offender commitment scheme is not just a bad idea; it likely has bad consequences. It is a huge and disproportionate sink for resources that ight be put to more effective use in the fight against sexual violence. Worse, its demand for resources will continue to grow, thus predetermining to a large extent how prevention and treatment dollars are spent. It is very possible that a more rational allocation of these resources would actually prevent more violence than the allocation that is automatically produced by the sex offender commitment scheme. At the very least, the fight against sexual violence …

The Tension Between Textualism And Substance-Over-Form Doctrines In Tax Law, Allen Madison Jan 2003

The Tension Between Textualism And Substance-Over-Form Doctrines In Tax Law, Allen Madison

Faculty Publications

This article discusses the tension that exists between the recent textualist approach taken in the U.S. Supreme Court and the judicially developed substance-over-form doctrines that pervade tax law. It sets forth Justice Antonin Scalia’s textualist approach, provides an overview of the substance-over-form doctrines, and then analyzes whether the current Supreme Court would uphold a case that overrode the literal text of the Internal Revenue Code on the basis of one of the doctrines. The article concludes that the current Supreme Court would reject any of these doctrines if faced with the issue.

School Vouchers: Will They Undermine American Public Schools? Establishing A Context For Debate, Michael F. Dipaolo Jan 2003

School Vouchers: Will They Undermine American Public Schools? Establishing A Context For Debate, Michael F. Dipaolo

Richmond Public Interest Law Review

Available data from 1995 and 1996 shows that school districts with the largest concentrations of children living in poverty spent considerably less per student than districts with smaller concentrations. In 1995 and 1996, public school districts serving metropolitan areas spent more per student for instruction, support services, and capital outlay combined than did other districts. The recent rise of real personal income per capita has paralleled the increase in public revenue for education per elementary or secondary student. During the 1990s, however, revenue as a percentage of personal income, adjusted for the number of students and population size, decreased slightly, …

Aristotle On Animals, Agency, And Voluntariness, Nancy E. Schauber Jan 2003

Aristotle On Animals, Agency, And Voluntariness, Nancy E. Schauber

Richmond Public Interest Law Review

In this article, I propose a way of reading the text that has both interpretive and philosophical merits. It is a more straightforward and literal reading of the text, requiring less interpolation than alternative readings. It also attributes to Aristotle a theory of moral responsibility which is, if not correct, at least as worthy of attention as many of the contemporary theories under debate. My own view is that the objections raised miss their target not because they fail to voice legitimate concerns about an adequate theory of moral responsibility, but because what Aristotle offers in the text in question …
