The Main Characteristics Of State's Jurisdiction To Tax In International Dimension, Alfred Nizamiev May 2003

The Main Characteristics Of State's Jurisdiction To Tax In International Dimension, Alfred Nizamiev

LLM Theses and Essays

This thesis analyzes the general characteristics of a state’s fiscal jurisdiction and how they influence the process of interaction with other national tax jurisdictions. The paper figures out essential internal substance of fiscal jurisdiction and its reflection on the necessity of interstate fiscal cooperation. After considering this substance the thesis goes on to explore the limits beyond which national jurisdictions cannot go in collection of taxes. Absence of common bases of these limits leads to conflicts between national jurisdictions and calls for close international fiscal cooperation. The thesis argues that the process of cooperation becomes more evident. In summary the …

Insuring Against Terrorism And Crime, Saul Levmore, Kyle D. Logue May 2003

Insuring Against Terrorism And Crime, Saul Levmore, Kyle D. Logue

Law & Economics Working Papers Archive: 2003-2009

The attacks of September 11th produced staggering losses of life and property. They also brought forth substantial private insurance payouts, as well as federal relief for the City of New York and for the families of individuals who perished on that day. The losses suffered in and after the attacks, and the structure of the relief effort, have raised questions about the availability of insurance against terrorism, the role of government in providing for, subsidizing, or ensuring the presence of such insurance, and the interaction between relief and the incentives for future precaution taking. In response to such losses, and …

Nothing New Under The Sun-Plagiarism In Practice, K.K. Duvivier

Sturm College of Law: Faculty Scholarship

The word "plagiarism" comes from the Ltin word "plagiariius," meaning kidnapper, and has been defined as the "purloining of ideas or language from another source. Some law schools have strict tests: if students borrow a unique phrase of two or three words, a string of seven words or more, or a single idea, these students may be guilty of plagiarism.

The Forseeability Of Transference: Extending Employer Liability Under Washington Law For Therapist Sexual Exploitation Of Patients, Timothy E. Allen May 2003

The Forseeability Of Transference: Extending Employer Liability Under Washington Law For Therapist Sexual Exploitation Of Patients, Timothy E. Allen

Washington Law Review

Transference, or the idealization of therapists, is a phenomenon that is foreseeable in every relationship between a therapist and a patient, and makes patients uniquely vulnerable to sexual exploitation by therapists. Transference has been recognized as a basis for finding therapists directly liable for harm resulting from sexual relations with patients. However, limitations on damages directly available from therapists lead patients to seek redress from therapists' employers under theories of employer liability. Washington courts generally deny victimized patients relief from the employers of sexually exploitative therapists. This Comment argues that Washington courts should impose employer liability when therapists sexually exploit …

Does Free Exercise Mean Free State Funding? In Davey V. Locke, The Ninth Circuit Undervalued Washington's Vision Of Religious Liberty, Derek D. Green May 2003

Does Free Exercise Mean Free State Funding? In Davey V. Locke, The Ninth Circuit Undervalued Washington's Vision Of Religious Liberty, Derek D. Green

Washington Law Review

In Davey v. Locke, a panel of the United States Court of Appeals for the Ninth Circuit ruled that Washington violated the Free Exercise Clause by refusing to allow a scholarship recipient to use state funds to pursue a theology degree. The court held that the state's scholarship requirements facially discriminated against religion, and that the state's interest in not violating its constitution did not serve as a compelling reason for the discrimination. In so holding, the Davey court ignored Ninth Circuit precedent and embraced a theory of the Religion Clauses at odds with United States Supreme Court jurisprudence. …

A Is Not A: Washington's Unconstitutional Law Of Single-Count, Single-Defendant Inconsistent Verdicts In State V. Goins, Natasha Shekdar Black May 2003

A Is Not A: Washington's Unconstitutional Law Of Single-Count, Single-Defendant Inconsistent Verdicts In State V. Goins, Natasha Shekdar Black

Washington Law Review

In State v. Goins, Division I of the Washington State Court of Appeals upheld inconsistent general and special verdicts on the same charge, even though the special verdict finding negated an element of the crime. The Goins court reasoned that the United States Supreme Court and the Washington State Supreme Court had previously upheld inconsistent verdicts in various contexts because the verdicts could have been the result of jury lenity. Therefore, overruling existing precedent, the Goins court upheld the inconsistent verdicts on the ground that distinguishing the Goins context would be elevating form over substance. This Note argues that …

Optimizing A Law School’S Course Schedule, Shelley Saxer, Gary M. Thompson May 2003

Optimizing A Law School’S Course Schedule, Shelley Saxer, Gary M. Thompson

The University of New Hampshire Law Review

[Excerpt] “Just like other educational institutions, law schools must schedule courses by taking into consideration student needs, faculty resources, and logistical support such as classroom size and equipment needs. Course scheduling is an administrative function, typically handled by an Assistant Dean or an Associate Dean, who works with the faculty and the registrar to balance these considerations in advance of the registration process. Usually, the entire academic year is scheduled in advance, although the spring semester may be labeled tentative until registration begins for that semester. It’s hard to imagine, but some schools even publish a two-year schedule of upper-division …

Risk Perception Regarding Energy Production: Factor Structure In A French Sample, Etienne Mullet, Anne Bertrand, Cécilia Lazreg, Sheila Rivière Shafighi

The University of New Hampshire Law Review

[Excerpt] "Considering that energy production is a key factor in the development of nations, it is important to have detailed information on the risks attributed by lay people to the different types of energy as well as the different stages of energy production. This study reports on the structure of risk perception with regard to energy production found among French participants. There have already been many investigations of risk perception related to energy production. . . .

The present study is a direct extension of the Mullet study. A similar, although more complete, set of items was used. These items …
