Harming Future Persons: Obligations To The Children Of Reproductive Technology, Philip G. Peters Jr.
Harming Future Persons: Obligations To The Children Of Reproductive Technology, Philip G. Peters Jr.
Faculty Publications
Two paradigms dominate contemporary ethical and legal debate about the risks posed to children who owe their lives to reproductive technology. One asks whether the children have lives so tragic that life itself is harmful. The other approach asks whether children so conceived are likely to enjoy a minimally decent existence. Although the two approaches have quite different analytic foundations, they share one crucial trait. Each concludes that children who owe their lives to reproductive technology are harmed only when that technology causes genuinely catastrophic injuries.Because these conventional paradigms define harmful conduct exclusively by reference to the magnitude of the …

Credit Opportunities, Race, And Presumptions: Does The Mcdonnell Douglas Framework Apply In Fair Lending Cases, Richard A. Hill
Missouri Law Review
Congress has recognized that "[i]n a credit oriented society such as ours, impediments to sources of credit based on extraneous factors such as race, color, religion, age, sex, marital status, and the like, have a deleterious effect on both the individual victims of discrimination, and on the economy as a whole."2 Minority borrowers feel the impact of credit discrimination. "They make me feel like I was wasting my time. Like I wasn't worthy of being a home owner."3 Lenders often do not realize what they have done. "The discrimination in mortgage lending with which I've become familiar is not necessarily …

Bifurcations Of Consciousness: The Elimination Of The Self-Induced Intoxication Excuse, Derrick Augustus Carter
Missouri Law Review
In early American and English common law, intoxication evidence did not excuse or mitigate criminal behavior.! Any person who destroyed his or her volition through intoxication was equally as culpable as a sober person for the legal consequences of a self-induced vice.2 Voluntary drunkenness aggravated, rather than reduced, criminal liability
Constructions Of Client Competence And Theories Of Practice, Robert Rubinson
Constructions Of Client Competence And Theories Of Practice, Robert Rubinson

An entrenched stereotype about the elderly is that they inevitably experience a progressive decline in cognitive function - what the Article calls the "idea of decrement." The vast majority of elderly, however, do not experience declining competence for most or all of their lives. Nevertheless, attorneys interpret much of what elderly clients say and do as the product of cognitive impairment, and sometimes even the elderly themselves construct stories about the world and their circumstances in line with the idea of decrement. These attitudes and social constructions, interacting in complex ways, can distort the ability of attorneys to represent elderly …
