Letters Of Credit, Voidable Preferences, And The "Independence" Principle, David G. Carlson, William H. Widen
Letters Of Credit, Voidable Preferences, And The "Independence" Principle, David G. Carlson, William H. Widen
Articles
The article challenges the traditional application of the independence principle in letters of credit within bankruptcy law, arguing that courts have misapplied this principle, leading to rulings that unfairly protect creditors. The authors propose treating the issuance of a letter of credit as a transfer of the debtor's property, making it subject to voidable preference rules under federal bankruptcy law. They advocate for a reinterpretation of the earmarking doctrine and suggest legislative action to clarify the treatment of letters of credit in bankruptcy, ensuring fairness and consistency in the legal framework.

Facts: Chana Szenes, born in Budapest, Hungary in 1921, emigrated to Mandatory Palestine alone at the age of 18. In 1943, during World War II, she enlisted in the British army. In June 1944, Chana Szenes parachuted in Yugoslavia, and crossed the border into Hungary with the aid of partisan groups. The German army captured her almost immediately. Chana Szenes was executed by a German firing squad on November 8, 1944. The current petition concerns the play “The Kastner Trial,” written by respondent no. four. The play, based on the true story of the Kastner affair, was intended to be …

Book Reviews
Book Review of Bob Woodward, "Shadow: Five Presidents and the Legacy of Watergate" In the months after the impeachment of William Jefferson Clinton, the race was on, publish or perish, to make some sense of the events of the last year. Notwithstanding that Bob Woodward is the dean of inside-Beltway reporting, the journalist who had defined coverage of presidential implosions, from Richard Nixon onward he faced stiff competition from a wide range of Clintonia writers, both journalists and former aides, including Michael Isikoff, George Stephanopoulos and Christopher Hitchens. Woodward's entry, "Shadow," attempts to cut loose from the crowd by being …

Exotic Policy: An Ijc White Paper On Policies For The Prevention Of The Invasion Of The Great Lakes By Exotic Organisms, Eric Reeves
Water Law Documents
About ten years ago, the Great Lakes environmental community initiated the first action to counteract the worldwide spread of exotic organisms in ballast water. In 1988, in response to the discovery of the ruffe and the zebra mussel in the Great Lakes, the Great Lakes Fishery Commission and the International Joint Commission called upon the Canadian and United States Governments to act. In 1989, Canada issued the first voluntary ballast exchange guidelines. In 1990, the United States passed the first major piece of legislation on aquatic nuisance species, mandating consultations and studies on all pathways for aquatic invasions. And in …
