Patent Exhaustion And Implied Patent License In Connection With Free And Open Source Software, Anna Haapanen Jan 2009

Patent Exhaustion And Implied Patent License In Connection With Free And Open Source Software, Anna Haapanen

LL.M. Essays & Theses

This study examines the patent law doctrines of patent exhaustion and implied patent license, and their application to the commercial use of free and open source software (FOSS), an area not thoroughly examined despite the doctrines' otherwise well-established preconditions. The analysis first clarifies the preconditions, scope and key differences of the two doctrines, then applies them to the sale and licensing of FOSS components under the BSD, MIT and GPLv2 licenses. The study addresses the risk that technology companies distributing patented FOSS components may inadvertently dilute their own patent portfolios through exhaustion or implied licensing. It concludes that the patent-related …

A Literature Review And Analysis Of Prison Offences And Punishments In England And Wales In 2007 By Gender, Catharine Phillips Jan 2009

A Literature Review And Analysis Of Prison Offences And Punishments In England And Wales In 2007 By Gender, Catharine Phillips

Theses : Honours

It is commonly agreed by scholars, members of the criminal justice system and the general public that court imposed sentences at times differ depending on the gender of the offender. However, there has been little empirical research conducted in regards to gender differences related to offending and discipline within prisons. The few published studies have reported contradictory results. Prison discipline is an essential part of upholding the good order and security of prisons along with maintaining the safety of prison staff, visitors, prisoners and the general public. The proposed research will identify any discrepancies between the punishments handed to male …

The Politics And Economics Of Software Intellectual Property Rights : Interacting Policies Of The United States, United Kingdom, Romania, Turkey, And International Organizations, Ersan Ozkan

Legacy Theses & Dissertations (2009 - 2024)

The Intellectual Property Rights is one of the key issues of the global economy as knowledge has become a key element in international trade. As the process of digitalization spreads, Software Intellectual Property Rights (SIPR) have become essential to the development of computer software industry. However, some developing governments do not fulfill the requirements of protecting SIPR; as a result, western entrepreneurs lose huge amounts of money. In order to prevent losses, developed countries established various organizations to watch and guide developing countries on SIPR issue.

Varieties Of Marketization In China : The Impact Of Private Entrepreneurs, Local Governments, And State-Owned Enterprises, Ji-Yong Lee

Legacy Theses & Dissertations (2009 - 2024)

The dissertation examines roles and effects of local government and private entrepreneurial class focusing on three localities in China in the course of marketization, based on the assumption that, at the local level in post-Maoist China, transitional paths toward a market-based economy from the planned economy are significantly affected by leading actors such as local governments, private entrepreneurs, or state-owned enterprises; economic development and formation of vibrant local market economy tend to be strongest when led by private entrepreneurs and weakest when led by state-owned enterprises. It especially focuses on formation of private entrepreneurial class and its roles in constructing …

Nepa And The Dynamics Of Public Participation In The Environmental Review Process: An Analysis Of The Northmet (Polymet) Mining Project Near Hoyt Lakes Minnesota, Amber Neumann

Political Science Theses and Capstones

Hypothesis: That comments collected from agency “experts” during the scoping phase of the National Environmental Policy Act (NEPA) process would be disproportionately represented as changes in subsequent drafts of NorthMet’s Environmental Impact Statement (EIS).

Methods: Tabular analysis of data collected from the Minnesota DNR publication of Response to the Public Scoping Projects PolyMet Mining Inc.; NorthMet Project. 2005

Results: There is an excellent cross section of comment sources represented in changes to subsequent drafts of NorthMet’s EIS. A lot of overlap exists between various types of participants and their concerns, resulting in many of the successful comments stemming from …

A Validation Study Of Risk Management Systems, Bridget Kelly

UNLV Theses, Dissertations, Professional Papers, and Capstones

The purpose of this study was to examine the predictive validity of Risk Management Systems (RMS) as a risk assessment instrument. To date, a published validation study does not exist for the RMS. The study employs secondary data analysis to examine the predictive validity of RMS recidivism and violence scores on three outcomes: arrest, unsuccessful termination from supervision, and technical violations. The study sample consisted of 830 probationers from the United States Probation Office, District of Nevada. The analyses showed that RMS recidivism and violence scores were moderately predictive of all three outcomes.

Optimization Of The Microprecipitation Procedure For Nuclear Forensics Applications, Lyndsey Renee Kelly Jan 2009

Optimization Of The Microprecipitation Procedure For Nuclear Forensics Applications, Lyndsey Renee Kelly

UNLV Theses, Dissertations, Professional Papers, and Capstones

Microprecipitation has become one of the most widely used sample preparation techniques for alpha spectroscopy. Many factors during the precipitation process can affect the yield and energy resolution by adding unwanted mass to the sample. Current applications in nuclear forensics call for an optimization of energy resolution and yield in order to improve identification and quantify specific radionuclides. The purpose of this research is to determine the optimal parameters used for microprecipitation. The optimal solution temperature, precipitation time, carrier amount, and hydrofluoric acid amount are used to investigate the influence of varying the type of carrier, as well as, the …

Predisposition Or Socialization? A Study Of Law Enforcement Values, Everett O. Doolittle Dr. Jan 2009

Predisposition Or Socialization? A Study Of Law Enforcement Values, Everett O. Doolittle Dr.

School of Business Student Theses and Dissertations

This research was intended to contribute to this debate and its policy implications by examining whether students entering a law enforcement degree program hold predetermined beliefs and values that are significantly different from their classmates not entering law enforcement careers and that vary among themselves according to age, race, or gender. Over 5 years, a 30-question survey of 28 classes regarding current criminal justice issues and debates was conducted among 833 students taking an introductory-level criminal justice course at a mid-western university.

The data strongly supported the research hypothesis that beginning law enforcement students held different beliefs and values than …

Violence Attribution Errors Among Low-Risk And High-Risk Offenders, Vicki Waytowich Jan 2009

Violence Attribution Errors Among Low-Risk And High-Risk Offenders, Vicki Waytowich

UNF Graduate Theses and Dissertations

Juvenile offenders have numerous factors that contribute to their delinquency, including family dysfunction, drug and alcohol abuse, negative peer influences, and social cognitive development. One area of social cognitive development linked to deviant behavior is attributional biases. Based on the prior research of Daley and Onwuegbuzie (2004), the purpose of the present concurrent mixed methods study was to explore the differences in the frequency of violence attribution errors among juvenile delinquents; the extent that peer-victimization, self-esteem, and demographic variables predict violence attribution errors among juveniles; and the differences in the types of violence attribution errors between incarcerated (high-risk) and probation …

Determinants Of Increased Safety Belt Use By High School Students In Motor Vehicles: The Influence Of Parents And Peers And Implications For Virginia's Graduated Driver Licensing Laws, Georjeane Linley Blumling Jan 2009

Determinants Of Increased Safety Belt Use By High School Students In Motor Vehicles: The Influence Of Parents And Peers And Implications For Virginia's Graduated Driver Licensing Laws, Georjeane Linley Blumling

School of Public Service Theses & Dissertations

Motor vehicle crashes are the number one cause of injuries and fatalities for persons 15-19 years of age in the United States. The higher fatality rate is caused in part from the lack of driving experience and the increased risk taking behaviors of adolescent drivers. Graduated driver licensing laws have been enacted in most states to address the risks associated with inexperience by adding restrictions on nighttime driving and limiting the number of teen passengers in the vehicle for novice drivers.

Inconsistent use or non-use of a safety belt when riding in a motor vehicle is a prevalent risk taking …

An Examination Of Section 504 In Practice: Dark Days For Student Rights, Ann S. Maydosz Jan 2009

An Examination Of Section 504 In Practice: Dark Days For Student Rights, Ann S. Maydosz

Communication Disorders & Special Education Theses & Dissertations

Section 504 of the Rehabilitation Act of 1973 is a broadly worded statement that addresses discrimination in schools and other settings. Enacted at about the same time as the Individuals with Disabilities Education Act (IDEA), Section 504 has been used sparingly in elementary and secondary schools. Section 504 presents an opportunity to redress educational inequities for struggling students because it can provide support for students with disabilities and impairments not covered by IDEA. However, due to vague wording, unclear case law, and limited training for school divisions and practitioners, schools are unsure how to implement and to comply with Section …

A Perspective Of Global Capitalism, James Soller Jan 2009

A Perspective Of Global Capitalism, James Soller

UNLV Theses, Dissertations, Professional Papers, and Capstones

Since the 1970s, the political-economic structure of global society has undergone drastic restructuring. International political economy is concerned with providing explanations for these changes. This thesis will provide an alternative view of international relations that is often marginalized in the mainstream literature. It will be argued that global society needs to be understood under the historical context of capitalism and the class relations that stem from it. Central to this argument is a Gramscian derived articulation of hegemony. Thus, hegemony will be conceptualized in this thesis as a transnational class that governs over global society through consent and coercion. While …

Governor James G. Scrugham And The Search For Economic Prosperity For Nevada, 1923--1927, Paul Robert Bruno

UNLV Theses, Dissertations, Professional Papers, and Capstones

James G. Scrugham, Nevada's 14 th governor, assumed office during the economic downturn of the early 1920s. The Comstock, and Tonopah - Goldfield mining boom days were in the past, and the new governor made development of a sustainable economic model for the state the top priority of his administration.

Governor Scrugham focused on education, irrigation, parks, and highways as vehicles for economic development, and significant accomplishments were made in all these areas during his term. The governor's initiatives, however, failed to immediately alter the state's economy away from agriculture and mining. The passage of the gambling and divorce bill …

Race Stereotypic Crimes And Juror Decision Making: Hispanic, Black, And White Defendants, Joseph Francis Boetcher Jan 2009

Race Stereotypic Crimes And Juror Decision Making: Hispanic, Black, And White Defendants, Joseph Francis Boetcher

UNLV Theses, Dissertations, Professional Papers, and Capstones

A race stereotypic crime is a crime that most people tend to associate with a certain race. This is a type of racial bias that affects juror decision making by undermining the presumption of innocence and lowering the prosecution's burden of proof. Two studies investigated race stereotypic crimes. Study 1 used a new scale to identify race stereotypic crimes for black, Hispanic, and white males. Study 2 used a mock juror paradigm with a realistic stimulus and sensitive measures to focus on the influence of this type of bias on mock juror decision making. Study 1: Participants were 143 undergraduate …

A Palestinian State, Jennifer A. Hileman-Tabios Jan 2009

A Palestinian State, Jennifer A. Hileman-Tabios

UNLV Theses, Dissertations, Professional Papers, and Capstones

Should an independent, sovereign state of Palestine have the right to exist? The establishment of an independent Palestinian state is important because it could possibly end an extended period of violence with Israel, where civilian casualties have been high, and it could help to solidify a foundation of political tolerance and acceptance in the Middle East. Under the proposed two-state solution, an independent Palestinian state is possible. However, to determine if a Palestinian state is viable, it will be necessary to examine internal political struggles, economic resources, systems of communication, political systems and internal and external political policies. This qualitative …

Eminent Domain: The Unintended Consequences Of Kelo, Tracy Lynn Bower Jan 2009

Eminent Domain: The Unintended Consequences Of Kelo, Tracy Lynn Bower

UNLV Theses, Dissertations, Professional Papers, and Capstones

In recent years, local governments in the United States have increasingly used eminent domain to promote economic development, raising concerns among property-right advocates over what those advocates view as unlawful, or what should be unlawful, takings of private property in order to benefit another private property owner. This philosophical and legal dispute reached a crisis point in the 2005 United States Supreme Court decision in Kelo v. City of New London. In that decision, the court narrowly upheld a Connecticut Supreme Court ruling granting the City of New London permission to redevelop land that had been seized from existing homeowners …

A Lingering Grudge In The Face Of A Power Transition; The French Canadian Movement In Perspective, Sergio Villarreal Jan 2009

A Lingering Grudge In The Face Of A Power Transition; The French Canadian Movement In Perspective, Sergio Villarreal

Open Access Theses & Dissertations

I hypothesize that an individual that has experienced a power transition, as measured by income, will be more likely to challenge the status quo than one that has not. The hypothesis is tested by relying on a mathematical probability model and is then corroborated through a qualitative analysis.

This analysis was accomplished by using a dataset that was collected in Québec during the time of the referendum; the final vote of each individual was contrasted with their relative income and dissatisfaction with the federation.

While income alone will not bring about a secessionist vote, the increase in the likelihood of …

Does God Favor The Unequal Allocation Of Resources? A Study Of The Effects Of Religion On Ethnic Conflicts, Irene Rebeca Mendoza

Open Access Theses & Dissertations

Ethnic conflict and religious conflict are two types of conflict that are too often studied as one type of conflict. Additionally, conflicts that involve the fight over resources are today a type of conflict which appears to be on the rise. Additionally, contrary to what some scholars have argued for centuries, religious influence over people's behavior also has continued to rise. Today there is a worrisome landscape in the global landscape, ethnic conflicts are currently ongoing throughout the globe in areas such as Congo, India-Pakistan, Israel-Palestine, Sudan, Sri Lanka, and most notably Iraq. Ethnic conflicts in the past appear to …

Igos And Juridical Organs, Janeth Diaz Jan 2009

Igos And Juridical Organs, Janeth Diaz

Open Access Theses & Dissertations

Do the number of members, the level of democracy, and the level of institutionalization contribute to the creation and use of a juridical organ in IGOs? This study utilizes 495 IGOs in order to answer this question and examine which of these three elements, or all of them, are relevant to the creation and use of any type of juridical mechanism in an IGO. For each of these characteristics five dependent variables were tested. Empirical results indicate that neither the level of democracy nor the number of membership contributes to the creation and use of a juridical mechanism. In contrast, …
