An Ethical Model For Mandatory Reporting To Avoid Preventable Adverse Harm In Health Care, Kate A. Molchan

Electronic Theses and Dissertations

The goal of the dissertation is to undertake an analysis in healthcare ethics that focuses upon organizational ethics to resolve problems related to medical error in the U.S. The ethical argument focuses upon justifying a model of mandatory reporting nationally. While countless others have argued in favor of the implementation of a mandatory reporting system, this dissertation presents its model through the lens of organizational theory; arguing first that healthcare organizations are ethically required to invest in patient safety. This premise frames the foundation for this dissertation's central argument; namely, that U.S. healthcare organizations have an ethical imperative to protect …

Optimizing A Method For Dna Recovery While Preserving Latent Prints On Paper, Niti Dalal

Student Theses

Paper evidence is commonly encountered in cases of kidnapping, threatening letters, extortion, and bank robbery, and the optimal workflow between latent print processing and DNA collection is of interest to the forensic community. The overall aim of this project was to achieve optimal amounts of DNA for typing without destroying the fingerprint. The first study compared two collection techniques—tape-lifting by Scotch Removable Poster Tape and dry swabbing with FLOQSwabs— using prints deposited in defined locations. Samples were processed for DNA and developed with 1,2-indanedione. The second aim was to determine if visualizing print locations with fingerprint powder prior to DNA …

In Translation: An Examination Of Esl Policy On Paper As It Relates To The Realities Of Implementation, Grace M. Cuevas

Senior Honors Projects, 2010-2019

This honors research project explores the features of Title III requirements as they relate to the actual experience of students and their families. This paper synthesizes my experience researching English as a Second Language (ESL) specific supports and policy to inform my time spent accompanying an upper-level administrator for the Harrisonburg City Public School (HCPS) system, and interviewing professionals at an area school. In this paper I outline the results of interviews with 13 service providers. Interviews examined the “letter of the law” and the subsequent “spirit of the law” through application of a social work lens to the different …

Tall Tales Of Danger And Security: How A Critical Human Security Approach Can Address Major Contradictions Revealed Through A Critical Narrative Analysis Of Dominant U.S. Security Strategies, Stephen Schneider Dec 2018

Tall Tales Of Danger And Security: How A Critical Human Security Approach Can Address Major Contradictions Revealed Through A Critical Narrative Analysis Of Dominant U.S. Security Strategies, Stephen Schneider

Master's Theses

Over many generations, humans have developed many perspectives and practices regarding the best ways to recognize and address what they perceive to be dangerous. Stories are used to help shape and narrate perceptions about the world, and they serve to pass on vital information that impacts how a society responds to threats and vulnerabilities. These narratives of danger and security are subjective to the experiences and political intentions of society, and therefore in many ways are partial and biased in their assessments and policies. This results in flawed security practices that may actually exacerbate threats or create new insecurities. What …

What Role Is Neuroscience Playing In New State Raise-The-Age Laws?, Dane N. Stallone Dec 2018

What Role Is Neuroscience Playing In New State Raise-The-Age Laws?, Dane N. Stallone

Capstones

Several states have cited neuroscientific evidence to help justify new raise-the-age laws that raise the age at which offenders can be tried as adults. Neuroscience shows that adolescent brains continue to mature well into their 20s. How much influence neuroscience should have in determining legal policy, however, remains contested among experts.

Adapting To $15: As The Minimum Wage Approaches $15 In Nyc, Business Owners Are Finding Ways To Make It Work, Alexandra Semenova, Sharif Paget

Capstones

This project examines the impact of minimum wage increases across major industries in New York City and State and concludes they have been manageable and even fueled broader economic growth. Since the incremental wage hikes were first signed into law in 2015, data and anecdotal evidence has shown business owners have been able to make it work and many of critics' concerns that the higher labor costs would lead to disemployment have been misplaced. The story provides an in-depth analysis of how restaurant and food establishments, health care and retail employers have adapted to higher labor costs by innovating their …

Inside The Virtual Ambazonia: Separatism, Hate Speech , Disinformation And Diaspora In The Cameroonian Anglophone Crisis, Sombaye Eyango Jules Roger

Master's Theses

This study examines the dynamics of the anglophone separatist claims in Cameroon, the so-called “Anglophone Crisis”. I focus on explaining why the separatist claims reemerged in 2016 after being shut down for about 20 years. It explains how the Anglophone separatist revendications have sustained over time despite the extremely centralized power of the Paul Biya government. This paper first argues that the Anglophone Crisis is more than an identity struggle between Anglophone/Francophone Cameroonians, but rather a conflict about historical and institutional grievances, political competition, and regional politics involving the neighboring state of Nigeria.

Second, it verifies the hypothesis that the sustainability …

The Best Interests Of The Child Or The State? The Rights Of The Child In Non-Lpr Cancellation Of Removal, Lizzie Bird Dec 2018

The Best Interests Of The Child Or The State? The Rights Of The Child In Non-Lpr Cancellation Of Removal, Lizzie Bird

Master's Theses

This thesis argues that the United States is failing to fulfill its obligations under the Convention on the Rights of the Child (CRC) in its adjudication of the hardship standard in non-LPR cancellation of removal. It is well-documented that the current interpretation of the “exceptional and extremely unusual hardship” standard results in the separation of families and de facto deportation of children, many of whom are U.S. citizens. This thesis contends that this practice is not only unjust, but also unlawful.

First, it argues that the CRC in general and Article 3 (the “best interests” principle) in particular have risen …

Understanding The Attitude In Israel Towards The Application Of The Right Of Return For Palestinian Refugees, Wafaa Abuzayda Dec 2018

Understanding The Attitude In Israel Towards The Application Of The Right Of Return For Palestinian Refugees, Wafaa Abuzayda

Master's Theses

The Palestinian refugee crisis is considered one of the oldest, largest, and most complicated refugee issues in the world. Hundreds of thousands of Palestinians have been displaced as a result of the 1948 and 1967 wars between Israel and the Arab states. Before fleeing their homes, Palestinians were persecuted and intimidated by the Israeli army in 1947 and 1948, causing people to flee to different neighboring geographical areas such as the West Bank, Gaza Strip, Jordan, Lebanon and Syria. The UNRWA, a UN-associated entity, was established and began operations on May 1, 1950 to support relief efforts benefiting the estimated …

Microplastics In Full View: Birds As Bioindicators Of Malta's Coastal Ecosystem Health, Dalton Brauer Dec 2018

Microplastics In Full View: Birds As Bioindicators Of Malta's Coastal Ecosystem Health, Dalton Brauer

Masters Theses, 2010-2019

Plastic pollution has recently become a widely studied topic, yet research on microplastics has remained lacking for specific geographic regions. Microplastics are small plastics resulting from degradation or the dumping of raw material and can lead to deleterious impacts on the coastal marine environment and its organisms. To assess Malta’s coastal environmental health, water birds (inshore, offshore and pelagic species) were used as bioindicators by assessing the presence and abundance of plastic within their stomach contents. The project hoped to fill some of the current gaps in knowledge on microplastics within Malta by creating a working baseline, as well as …

Cartographies Of Power: Unequal Urban Development And The Racialization Of Space In São Paulo, Jessica Hyman Dec 2018

Cartographies Of Power: Unequal Urban Development And The Racialization Of Space In São Paulo, Jessica Hyman

Undergraduate Honors Theses

This work aims first and foremost to add to the literature on urban politics and race in Brazil. Where other scholars have not so explicitly addressed the ever present ideology of whiteness in regards to spatial organization and displacement in Brazil, this piece aims to do so. I build off of the work of past scholars in reinforcing that the belief in the racial democracy of Brazil is in fact a myth. I do so by illustrating the processes of the racialization of space that occur in São Paulo’s favelas and their development. The right to the city —a Brazilian …

Judge Consistency In Criminal Sentencing, Emma Lindemeier, Paul Landow Dec 2018

Judge Consistency In Criminal Sentencing, Emma Lindemeier, Paul Landow

Theses/Capstones/Creative Projects

The United States’ Constitution provides certain protections for those accused of a crime, including proportionate punishment and the right to an attorney. There are sentencing guidelines in place, as well as appointed-counsel systems to ensure that everyone receives these protections when accused of a crime. Some research has shown that the type of counsel present at sentencing may affect the outcome of sentencing, although, the research on the topic is conflicting. Race is another variable that has been found to play into the role of sentencing, as well as gender and age. Other studies have suggested that the differences in …

Nationalism And Border Violence: The Global Rise In Soft Fascism, Rachel Shimabukuro Dec 2018

Nationalism And Border Violence: The Global Rise In Soft Fascism, Rachel Shimabukuro

Capstone Projects and Master's Theses

Since the election of Donald Trump in the United States in 2016, there has been a particularly nationalistic, illiberal shift in the way we interact with the rest of the world. As we have favored some while violently excluding others at our borders, the media and press which criticizes these policies is under attack. This shift is not exclusive to the United States and the following research will also focus on the illiberal democratic movements in Hungary, Brazil, the Philippines, and the unfolding right-wing politics of a post-Brexit state. In an explanatory style, this research will focus on Benedict Anderson’s …

An Empirical Study Of Workers' Demands Through Industrial Actions: A Comparative Analysis Of The United States, Germany And The People's Republic Of China Under The Bargaining Model, Xiaohan Sun

Maurer Theses and Dissertations

The Chinese traditional manufacturing industry used to rely on raw materials and low labor costs to achieve a competitive advantage, however, the Chinese lowest–cost labor market is no longer competitive and the Chinese manufacturing industry is not the strongest player in the high-tech area. The transition of manufacturing industry is confronted with difficulties and challenges.

From the prior research, one of the reasons over labor conflicts is the awareness of rights consciousness. Employment dispute cases have had a significant increase since 2008, and labor disputes gradually increased since the year 2014. Industrial actions, such as strikes and protests, became the …

A Critical Review Of U.S. Securities Laws And The Status Of Initial Coin Offerings: Potential Solutions For Issuers, Muhammed Kus Dec 2018

A Critical Review Of U.S. Securities Laws And The Status Of Initial Coin Offerings: Potential Solutions For Issuers, Muhammed Kus

Maurer Theses and Dissertations

Securities law in the United States has a unique approach to defining what is a security and what is not a security. It includes broadly defined terminology and describes several investment instruments that may be considered a security. Courts use one of two methods to determine whether an investment contract is a security: the Howey Test and the Risk Capital Test.

Initial Coin Offerings are one of the most recent instruments that courts and other governmental organizations need to examine in order to answer whether they meet the criteria of being a security. Depending on the result, the issuers may …

Officer Use Of Force: A Multicase Study Of Institutional Betrayal, Margarita Mcauliffe Dec 2018

Officer Use Of Force: A Multicase Study Of Institutional Betrayal, Margarita Mcauliffe

Theses & Dissertations

Law enforcement officers in the United States are authorized to utilize force (Alpert & MacDonald, 2001); however, the use of force can cause physical and emotional trauma to the person against whom it is used, and to the person’s loved ones (WHO, 2002; Bloom, 2012; APA, 2013). The needs and rights of traumatized individuals must be addressed for healing to occur (U.S. DOJ, 2013). It was not known if the needs and rights of the survivors of officer use of force were being met. Filling a gap in the literature, this exploratory multicase study investigated 5 use-of-force incidents with demographically …

All That Glitters Is Not Gold: Media Coverage Of The Golden State Killer, Lasherica Thornton Dec 2018

All That Glitters Is Not Gold: Media Coverage Of The Golden State Killer, Lasherica Thornton

Honors Theses

This thesis focused on the media’s extensive coverage of serial killers and, thus, how it could propel them to a state of fame. It discusses that no matter a serial killer’s circumstance, the media typically finds a story. For example, a serial killer can be on a rampage or can be dormant, but in subsequent stories, the media will center a story around the killer’s first and/or recent crimes, his identity, or his possible next move. The New York Times and Los Angeles Times coverage of the Golden State Killer frames the analysis of this manuscript. The purpose was to …

Revolution In Crime: How Cryptocurrencies Have Changed The Criminal Landscape, Igor Groysman Dec 2018

Revolution In Crime: How Cryptocurrencies Have Changed The Criminal Landscape, Igor Groysman

Student Theses

This thesis will examine the ways in which various cryptocurrencies have impacted certain traditional crimes. While crime is always evolving with technology, cryptocurrencies are a game changer in that they provide anonymous and decentralized payment systems which, while they can be tracked in a reactive sense via the blockchain, are seen by criminals as having better uses for them than traditional fiat currencies, such as the ability to send money relatively fast to another party without going through an intermediary, or the ability to obscure the origin of the money for money laundering purposes. Every week there are new cryptocurrencies …

Differences In Psychopathy And Associated Traits By Police Officer Rank, Rosanne Libretti Dec 2018

Differences In Psychopathy And Associated Traits By Police Officer Rank, Rosanne Libretti

Student Theses

Most psychopathy research focuses on its manifestation in forensic populations, however these results may not generalize onto noncriminal, or “successful,” psychopaths. Lykken (1995) conjectured that socialization may enable “heroes,” like law enforcement, to utilize the interpersonal and affective aspects of psychopathy in a manner that benefits society. Previous research (Falkenbach et al., 2018a) suggests that psychopathy and its correlates differ between police recruits and individuals in the community. It is necessary to continue this work with other groups in the police force to see if the patterns found in these studies generalize to veteran officers who have worked in law …
