The Impact Of Roe V. Wade (1973) On The American Abortion Rights Movement, Claire M. Adkins May 2017

The Impact Of Roe V. Wade (1973) On The American Abortion Rights Movement, Claire M. Adkins

Senior Honors Projects, 2010-2019

My research examines the impact of the Supreme Court case, Roe v. Wade (1973), on the American abortion rights movement during the 1970s. Previous research is divided on the extent of the Court’s influence on social movements and I seek to fill a gap in the previous literature. I conduct an in-depth document analysis to measure the Court’s effect on the abortion rights movement. Specifically, I examine abortion sections from the 1970s feminist publications, “Our Bodies Ourselves” and “off our backs,” to represent the American abortion rights movement. Both publications offer slightly different feminist perspectives with abortion rights advocacy and …

The Drone Question: Legality, Ethics, And The Need To Recognize Transnational Armed Conflict, Matthew T. Mueller May 2017

The Drone Question: Legality, Ethics, And The Need To Recognize Transnational Armed Conflict, Matthew T. Mueller

Senior Honors Projects, 2010-2019

This work focuses on the legality and ethics of targeted killings via drones conducted by the United States. The first section of this work looks at the use of drone strikes by the U.S. government as they fall outside of the traditional notion of a zone of armed conflict, that being one that can be defined geographically and temporally, and explores whether these strikes could be considered legal under international humanitarian law and the international law of self-defense. This work assumes that an armed conflict exists between the United States and the non-state armed actors that have been targeted by …

Israel And Palestine- An Analysis Of The 2014 Israel-Gaza War From A Genocidal Perspective, Shannon M. Culverwell May 2017

Israel And Palestine- An Analysis Of The 2014 Israel-Gaza War From A Genocidal Perspective, Shannon M. Culverwell

Senior Honors Projects, 2010-2019

During the 2014 Israel-Gaza War, approximately 2,251 Palestinians and 73 Israelis were killed as a result of the fifty-one day long conflict. As the deadliest and most destructive conflict since 1948, the international community has widely condemned the actions taken by Israeli and Palestinian actors throughout the conflict. Despite international condemnation, currently the International Criminal Court (ICC) is the only institution conducting a criminal investigation into the recent conflict. Upon Palestine accession into the Rome Statute in June of 2015, the ICC opened a preliminary examination regarding alleged crimes committed in the occupied territory of Palestine since June 13, 2014. …

Longitudinal Awareness: A Study Of Vulnerability To Flooding In Polk County, Iowa, Kerri A. Dickey

USF Tampa Graduate Theses and Dissertations

Flooding has become a problem of national proportion and many scholars have started to take note of the human impacts in this area. This study will focus on the social vulnerability framework in tandem with the environmental justice theoretical frameworks being applied to Polk County Iowa so that information can be added to the body of works within a Midwestern U.S. context. This research will contribute to the current geographical knowledge in natural hazards, environmental justice, and vulnerability to flood hazards. Taking into consideration the scarcity of county or sub-county studies in the Midwest U.S. measuring spatial tendencies in hazards …

Case Study: Healthy Texas Women Program In The Abilene-Taylor County Public Health District, Saul Francisco Delgado May 2017

Case Study: Healthy Texas Women Program In The Abilene-Taylor County Public Health District, Saul Francisco Delgado

Electronic Theses and Dissertations

The public healthcare system faces continuous transformations and challenges of constant adjustments to the increasing usage of fee for service revenue and the decrease of federal investment to women’s healthcare services and to the safety net healthcare providers (Meit, 2013; Weisman, 1997).

In 2016, the Texas 84th Legislation Session determined to consolidate two existing women’s healthcare service programs into one a single program: the Healthy Texas Women (HTW) program. The new women’s program is a preventative care program that provides services of family planning and chronic illness care under a complete fee for service reimbursement system as its sourse …

An Analysis Of The Racketeer Influenced Corrupt Organizations Act: How A Once Promising Bill Became A Corporate Nightmare, Joshua Hill May 2017

An Analysis Of The Racketeer Influenced Corrupt Organizations Act: How A Once Promising Bill Became A Corporate Nightmare, Joshua Hill

Senior Theses

Through sensationalism, the mafia stereotype, and past commissions’ recommendations Congress enacted the Racketeer Influenced Corrupt Organizations (RICO) Act. The Act itself was meant to eradicate organized crime while protecting legitimate businesses from their illegitimate counterparts. Unfortunately, the civil Act’s innate flaws have caused an overwhelming number of civil cases to flood the legal system, the majority of which have focused on private organizations and corporations, instead of Organized Crime (Pierson 2013). Civil RICO’s exploitation can be traced to its treble damages clause, – which was included in the Act to provide “an effective deterrent to further expansion of organized crime’s …

Is Students’ Knowledge Of The Student Conduct Code Associated With Their Conduct Code-Breaking Behaviors On Campus?, Joy D. Bonner

Honors College Theses

Annually colleges and universities spend countless hours updating their student codes of conduct, but is this added time worth the hassle if students continue to break the code? The purpose of this study was to examine the effects a student’s knowledge of a university’s code of conduct may have on the amount of code-breaking behaviors committed on campus. A survey was administered to students at Georgia Southern University analyzing students’ knowledge and perceptions of academic dishonesty and plagiarism on campus. Each participant was asked a series of questions analyzing their knowledge of the code, its sanctions, as well as the …

Regional Human Rights Regimes And Environmental Protection: A Comparison Of European And American Human Rights Regimes’ Histories, Current Law, And Opportunities For Development, Don Mccrimmon

PhD Dissertations

This work reviews the Inter-American and European human rights regimes and their abilities to respond to point-source pollution, climate change, and ecosystem conservation. It begins by reviewing leading human rights theories and the development of the relationship between human rights and the environment. It then focuses on European human rights, both under the ECHR and the CFREU, and highlights the ECHR’s ability to respond to instances of point-source-pollution though the right to privacy. The work then looks at the Inter-American human rights regime, its structure, history and ability to respond to environmental challenges. It reviews the regime’s tendency to use …

An Assessment Of Economic Considerations For Industrial Hemp Production, Luke T. Lane

Agricultural Economics and Agribusiness Undergraduate Honors Theses

The Farm Bill now allows for the legal production and research of industrial hemp as long as it meets the standards outlined in the Farm Bill. The bill passed by the House of Representatives states, “To amend the Controlled Substances Act to exclude industrial hemp from the definition of marihuana, and for other purposes” (House of Representatives, Bill 525). Prior to the passing of this bill, farmers were not allowed to produce industrial hemp. Industrial hemp is defined as, “the plant Cannabis sativa L. and any part of such plant, whether growing or not, with a delta-9 tetrahydrocannabinol concentration of …

Beyond Pluralism And Elitism: How Much Influence Do Special Interests Have On The Content Of Congressional Legislation?, Kyle Johnson May 2017

Beyond Pluralism And Elitism: How Much Influence Do Special Interests Have On The Content Of Congressional Legislation?, Kyle Johnson

Political Science Theses and Capstones

Do powerful special interests have too much influence over what is written in congressional legislation? There has been ongoing debate about how influence should be distributed between interest groups in affecting legislation. A central question in this debate asks whether interest groups with more financial clout have more influence in policy-making than interests that have fewer resources? Furthermore, much research has been on interest groups influence on the lawmaker’s vote instead of the interest’s influence prior to the vote. My research seeks to determine the extent to which interest groups influence the content of legislation in the U.S. Congress. My …

Reactions To Hybrid Mismatch Arrangements And Strategy Suggestions For Korea, Aju Nam May 2017

Reactions To Hybrid Mismatch Arrangements And Strategy Suggestions For Korea, Aju Nam

Maurer Theses and Dissertations

In recent years, the Organisation for Economic Co-operation and Development (OECD)’s Base Erosion and Profit Shifting (BEPS) project has been one of the biggest issues in international taxation. The OECD refers to BEPS as “tax avoidance strategies that exploit gaps and mismatches in tax rules to artificially shift profits to low or no-tax locations.” In 2014, the OECD released BEPS Action 2 as responds on Hybrid Mismatch Arrangements (“HMA”s), which are arrangements exploiting differences in the tax treatment of instruments, entities or transfers between two or more countries. Two of the major factors of HMAs are hybrid entities and hybrid …

Achieving Justice Through Adr: An Analysis Of The Korean Mediation System, Yonghwan Choung May 2017

Achieving Justice Through Adr: An Analysis Of The Korean Mediation System, Yonghwan Choung

Maurer Theses and Dissertations

The purpose of this research is to reconsider Korean judicial mediation as a part of alternative dispute resolution (“ADR”) and to discuss the possible legal transition of Korean judicial mediation into private sector mediation.

Similar to other states’ judicial problems, Korea has also faced overloaded case dockets, congestion of the civil process, an expensive legal process, and emotional stress on parties during the procedures. The Korean judicial authority continuously developed the Korean mediation programs, which can be categorized as court-related mediation, including court-annexed and court-connected mediations. Based on enactment of the Judicial Conciliation of Civil Disputes Act of 1990 (“JCCDA”) …

Uncovering The Confusing Influence Experts Have On Music Copyright Cases, Arata-Enrique Kaku May 2017

Uncovering The Confusing Influence Experts Have On Music Copyright Cases, Arata-Enrique Kaku

Honors Projects

Contemporary copyright decisions by Federal Courts perplex composers; am I the creative composer, or am I an infringer on someone else’s intellectual property? By forming a temporary monopoly to monetize new content, copyright protection incentivizes artists to be fruitful. In a creative field like music, an overly broad definition of copyrightable expression can lead to a “chilling effect” on creativity. This chilling effect is exacerbated by the great latitude given expert witnesses to claim infringement based on broad classifications of expressions. My paper addresses the question: To what extent should expert witnesses be probative when they extend ownership rights beyond …

A Content Analysis Of Media Accounts Of Death Penalty And Life Without Parole Cases, Lisa R. Kirk May 2017

A Content Analysis Of Media Accounts Of Death Penalty And Life Without Parole Cases, Lisa R. Kirk

Electronic Theses and Dissertations

The study analyzed a convenience sample of published accounts of death penalty cases and life without parole cases. The objective of the study was to explore factors that influence the selection of cases for coverage in books, think tank reports (e.g., Heritage Foundation), and periodicals and factors related to coverage of homicides resulting in a death penalty sentence or a life without parole sentence (often termed “America’s other death penalty”).

Since this study was exploratory, hypotheses were not offered. However, prior research on the death penalty and on life without parole offered several clues. For example, since black offender/white victim …

"Y'All And All These Assessments Is A Little Bit Too Much" : The Effects Of High-Stakes Testing On Critical Literacy Pedagogy., Diana Lalata May 2017

"Y'All And All These Assessments Is A Little Bit Too Much" : The Effects Of High-Stakes Testing On Critical Literacy Pedagogy., Diana Lalata

College of Arts & Sciences Senior Theses

As the United States of America becomes increasingly diverse, there is a need for teachers to embrace multiculturalism within the classroom. Shifting away from the traditional “banking model” of teaching, educational researchers call for a more critical approach—one in which teachers and students challenge dominant beliefs and practices of education. Foregrounded in those aims of cultural competence and critical consciousness, “critical literacy pedagogy” addresses the politicization of literacy education and employs conscious curriculum and teaching strategies to empower marginalized voices. Although a number of case studies on critical literacy pedagogy show considerable promise in disrupting dominant discourse and developing cultural …

Different Voices : Measuring Female Judges' Influence On Women's Rights Issues In The U.S. Courts Of Appeal., Alyson E Hendricks May 2017

Different Voices : Measuring Female Judges' Influence On Women's Rights Issues In The U.S. Courts Of Appeal., Alyson E Hendricks

College of Arts & Sciences Senior Theses

Beginning with President Carter and continuing with each successive president, the federal bench has become more diverse. This has caused scholars to turn their attention to how personal characteristics such as race and sex affect judging. Understanding the effects of gender and race on judging is crucial because white female and minority female judges may bring a different perspective to the bench than their male counterparts due to their shared experiences with discrimination. To fill a gap in the literature, this study examines the impact of women in terms of legal influence and voting behavior. The results demonstrate that women …

Making Sex Work For The State : The Policing Of Sex Work In The United States., Madeline A Clabough May 2017

Making Sex Work For The State : The Policing Of Sex Work In The United States., Madeline A Clabough

College of Arts & Sciences Senior Theses

This thesis analyzes the ways that sex work is regulated within the United States, and analyze the ways that regulation is shaped by contemporary feminist discourse. To do so, it analyzes the ways in which sex workers have been and pathologized since the 19th century, and address the ways that these conceptualizations have been incorporated into the legal regulation of sex workers. Finally, this thesis will look to contemporary practices in the state regulation of sex workers, and argue that the relationship between neoliberalism, the carceral state, and what has come to be termed “carceral feminism” operate in conjunction to …

Capture Theory & State Regulation Of Animal Cruelty, Kyla Henderson May 2017

Capture Theory & State Regulation Of Animal Cruelty, Kyla Henderson

Political Science Theses and Capstones

In this thesis I theorize that regulatory capture impacts animal cruelty laws in several different ways. Capture theory is the process by which regulatory agencies eventually come to be dominated by the industries they were charged with regulating. Regulatory capture happens when a regulatory agency, formed to act in the public’s interest, eventually acts in ways that benefit the industry it is supposed to be regulating, rather than the public. Animal cruelty regulations are an important factor in the way that everyday products are produced. Capture theory affecting animal cruelty is an important look at the growing concern with animal …

Education Through The Eyes Of Foster Parents, Laresha R. Richardson May 2017

Education Through The Eyes Of Foster Parents, Laresha R. Richardson

Electronic Theses, Projects, and Dissertations

Not all children live with their biological parents. In 2013, approximately 60,000 children in California were in foster care. These children comprise a significant subgroup of students in public schools today and are one of the most educationally vulnerable student populations. Often they are, as a group but with individual exceptions, low-performing.

Parents’ involvement has often been credited with improving school achievement. Foster parents, therefore, play an important role in ensuring the academic success of foster care children. Foster parents encourage, provide emotional support and guidance to these children and advocate on their behalf.

The purpose of this study was …

Towards An Effective Regime Against Online Copyright Infringement In India, Ashwin Ramakrishnan May 2017

Towards An Effective Regime Against Online Copyright Infringement In India, Ashwin Ramakrishnan

LLM Theses

With Internet usage on the rise, it is important for India to establish an effective regulatory regime to combat piracy and mass copyright infringement online. This thesis argues that, in the face of unique legal and cultural challenges specific to India, present laws in the country have failed to do so. Unless and until these challenges are met it will be difficult to have an effective mechanism that deals with online copyright infringement. Countries like the United States, Canada, Ireland, and France have all adopted different regulatory models. However, this thesis argues that each not only have significant limitations on …

The Plight Of Undocumented Female Migrants: Identifying Structural Factors That Contribute To The Proliferation Of Sex Trafficking And The Failings Of International Law, Hannah K. Valles

International and Global Studies Undergraduate Honors Theses

The aim of this thesis is to investigate the conditions at two specific border zones, the United States-Mexico border and the Mexico-Guatemalan border, that render undocumented female migrants vulnerable to abduction or recruitment into sexual exploitation. In addition to exploring the factors that expose women to trafficking networks, the study scrutinizes the legal failings of the international law-making community with regards to the safeguarding of women whose socio-economic conditions and environment of perpetual violence prompt their extralegal international movement. The paper provides an overview of the social, economic, and historical factors that underpin the flourishing of sex trafficking operations in …

Toward The Search For The Proper Liability Rule For Harms Resulting From Sources Of Risk: A Different Approach To The Choice Between Strict Liability And Fault-Based Regime, Wen-Hsuan Yang May 2017

Toward The Search For The Proper Liability Rule For Harms Resulting From Sources Of Risk: A Different Approach To The Choice Between Strict Liability And Fault-Based Regime, Wen-Hsuan Yang

Maurer Theses and Dissertations

An important issue in Taiwan today concerns the rising tension between strict liability and negligence. Article 191-3 of the Civil Code of Taiwan imposes a fault-based standard of liability on persons conducting dangerous activities. On the other hand, the majority of scholars believe that to afford greater protection, this rule should be changed into a strict liability rule.

Traditionally, three arguments make it preferable to impose strict liability under certain circumstances. First, strict liability induces more safety incentives on the part of the defendant. Second, fairness requires that one who benefits from conducting dangerous activities should bear the risk of …

Maurer Theses and Dissertations

The purpose of this dissertation is to create legal and regulatory systems for Carbon Capture and Sequestration (CCS), based on demonstrating rationales of this technology. This dissertation analyzes whether or not existing international and domestic (including the United States, Australia, China, and South Korea) laws could cover potential legal issues. After exploring desirable directions for addressing key legal issues regarding CCS, this dissertation ultimately aims to set up a legal and regulatory framework for CCS in South Korea.

Specifically, permits, environmental impact assessments, liability, and property rights issues are of common importance, which are priority areas to establish well. In …

Administrative Disputes In The Legal System In The United Arab Emirates, إبراهيم ولد الشيخ سيديا May 2017

Administrative Disputes In The Legal System In The United Arab Emirates, إبراهيم ولد الشيخ سيديا

Theses

The legislator of the United Arab Emirates has determined the principle of legality and rule of law, as stipulated in Articles 44 and 94 of the Constitution. If the administration contravenes the principle of legality, the invalidity of the act which is in breach of the law becomes void. The invalidity varies in its gravity and effects according to the degree of the violation. However, the rule is that legal authority granted by law to that right; since administrative acts are deemed legal in principle, and it is not decided to invalidate such acts except by a judicial ruling must …

The Development And Testing Of Potential Music Piracy Warnings, Joanne Ullman

UNLV Theses, Dissertations, Professional Papers, and Capstones

A combination of technological, legal, and economic factors necessitates efforts to protect music from being illegally reproduced in a globally digital environment. Entities such as record companies, recording industry organizations, and special governmental agencies are committed to eradicating the unauthorized dissemination of copyrighted material. Furthermore, the FBI provides an official anti-piracy icon with accompanying text to be placed on websites and packaging. In support of these initiatives, the principal goal of this study was to empirically identify icon design elements that will most successfully communicate to consumers the illegality of unauthorized music reproductions.

Recommendations from extant literature indicate that viewers …

Moral Time And Homicide Investigations., David Stuart Lapsey Jr. May 2017

Moral Time And Homicide Investigations., David Stuart Lapsey Jr.

Electronic Theses and Dissertations

Previous literature explores the many dimensions of homicide investigations, including case and individual characteristics, evidence and investigative activities. However, little research delves into situational characteristics and their relationship to specific homicides, charge severity sought by prosecutors and sentence length given to homicide offenders. The current study sampled homicide cases (N=68) to gather baseline information and data regarding judicial outcomes. Donald Black’s Theory of Moral Time (2011) is tested and utilized as the study’s conceptual framework for the study’s hypotheses.
