The Violence Against Women's Act: From The Criminalization Of Domestic Violence Through Modern Political Challenges, Carrie Anderson May 2020

The Violence Against Women's Act: From The Criminalization Of Domestic Violence Through Modern Political Challenges, Carrie Anderson

Theses/Capstones/Creative Projects

The Violence Against Women’s Act, or VAWA, is a landmark piece of federal legislation to combat domestic violence in the United States. It passed in 1994 following various state efforts to stop intimate partner violence. Broad federal legislation was needed to end domestic violence because of the unique nature of the crime including the strong connection between victims and perpetrators, the vast scale of the problem, and the reoccurring nature of domestic violence (Fagan, p. 28-29, 1996). VAWA has been expanded through reauthorization efforts in 2000, 2005, and 2013. Reform efforts have focused on increasing protections for victims especially focusing …

Juvenile Diversion Programs: Comparing Minnesota County Characteristics To Determine Their Role In Pre-Trial Diversion Programs, Kaydin Schmitt May 2020

Juvenile Diversion Programs: Comparing Minnesota County Characteristics To Determine Their Role In Pre-Trial Diversion Programs, Kaydin Schmitt

Political Science Theses and Capstones

The main goal of the juvenile justice system is to rehabilitate offenders and prevent youth from entering the adult justice system. One approach is through the use of diversion programs. The state of Minnesota requires all counties to offer at least one type of pre-trial diversion program. However, there is no ubiquitous program; the number and types of programs differ between counties, and the reason for these differences between jurisdictions is under-researched. I analyze the number and types of pre-trial diversion programs in Minnesota counties and compare them to various county characteristics to determine which characteristics play a role in …

Law Enforcement, Public Opinion, The Media, And Its Effects, Aaron Borcyk May 2020

Law Enforcement, Public Opinion, The Media, And Its Effects, Aaron Borcyk

Theses/Capstones/Creative Projects

The United States Bureau of Labor Statistics estimates that, in 2018, law enforcement workers made up about .8% of the country’s workforce. Given that they make up such a large percentage of the workforce plus the extreme public visibility of the profession by nature, law enforcement is a highly discussed topic. After the controversial officer-involved shootings of Michael Brown, Walter Scott, and Freddie Gray between 2014 and 2016 the credibility and integrity of law enforcement came into question. Law enforcement is depicted on many media platforms in many different ways; The current research leverages qualitative data obtained from in-depth oral …

Responding To Victims Of Human Trafficking In The United States: A Review Of Treatment Providers, Morgan A. Mcbride May 2020

Responding To Victims Of Human Trafficking In The United States: A Review Of Treatment Providers, Morgan A. Mcbride

Theses/Capstones/Creative Projects

Scholars have made strides to illuminate the scope and nature of human trafficking, but there have been minimal efforts to inform responses to victims. Importantly, if we do not address the issues that made people vulnerable in the first place, then they could be susceptible to re-victimization in the future. It is vital then that treatment agencies are available and engaging in effective practices to maximize recovery efforts. Thus, the current study examined treatment providers in the United States in two stages to determine how they respond to victims of these crimes. In the first stage, a systematic literature review …

Working To Prevent Gun Violence In The United States: The Role Of Policy & Advocacy, Allison Popovits May 2020

Working To Prevent Gun Violence In The United States: The Role Of Policy & Advocacy, Allison Popovits

Political Science & International Studies | Senior Theses

There are several laws in place regarding the legal purchase and possession of firearms in the United States (Giffords Law Center, 2020). There are also laws regarding the prohibited purchase and possession of firearms (Giffords Law Center, 2020). Yet, prohibited persons purchase and possess firearms regularly (Giffords Law Center, 2020). This happens because there are loopholes in the law (Brady United, 2020). For example, federal law requires background checks for gun purchases from licensed firearm dealers, but not at gun shows where sellers may not be licensed. This means that a felon (prohibited purchaser and possessor) buying a gun from …

Business And Human Rights In The Context Of Sanctions: A Road To Filling The Governance Gap, Bahareh Jafarian May 2020

Business And Human Rights In The Context Of Sanctions: A Road To Filling The Governance Gap, Bahareh Jafarian

LLM Theses

As concerns about the negative impacts of sanctions on the human rights of civilians and the environment increases, it is necessary to reflect upon the lawfulness and legal status of such measures in international law, and their impact on business enterprises and the field of Business and Human Rights (BHR). While current academic literature tends to focus on implementation, enforcement and business compliance with unilateral and multilateral sanctions, the negative impacts of sanctions on non-state actors and resulting human rights violations are overlooked. Specifically, the relationship between sanctions law and the responsibility of businesses to respect human rights and the …

The Canadian Anti-Doping Program And The Charter Of Rights And Freedoms, Kate Scallion May 2020

The Canadian Anti-Doping Program And The Charter Of Rights And Freedoms, Kate Scallion

LLM Theses

This thesis examines the relationship between the Canadian Anti-Doping Program (CADP) and the Charter of Rights and Freedoms. First, the CADP is explored in depth, including the origins of anti-doping in Canada generally, how Canada's anti-doping regime aligns with international anti-doping regimes, and how the CADP functions in practice. Next, whether or not the Charter applies to the CADP is analyzed, looking at whether the administrator of the CADP, the Canadian Centre for Ethics in Sports (CCES), meets the criteria of a "government actor," as well as determining if the CADP itself would be considered a government action and thus …

Socio-Economic Well-Being Of International F-1 Students Living And Working In The United States, Elena K. Taborda May 2020

Socio-Economic Well-Being Of International F-1 Students Living And Working In The United States, Elena K. Taborda

Graduate Doctoral Dissertations

According to United States law, international F-1 students are nonimmigrant aliens residing in the United States temporarily. Yet, they are more than just short-term visitors, as many of them live in the country for years while pursuing their postsecondary studies. Since international students are foreign citizens, their rights and freedoms are bound by the constraints of the country’s immigration policies. This study is concerned with work-related restrictions imposed on F-1 students by the U.S. government, positioning international students’ limited opportunities for employment as being in violation with their basic human right to economic and social development.

This multi-method project drew …

Public Perceptions Of Police Militarization: A Nuanced Understanding Of Public Support For Police Practices, Leobardo Lopez-Cristobal May 2020

Public Perceptions Of Police Militarization: A Nuanced Understanding Of Public Support For Police Practices, Leobardo Lopez-Cristobal

UNLV Theses, Dissertations, Professional Papers, and Capstones

In recent years, there has been heavily publicized incidents of police use of military weapons and tactics, which has raised concerns regarding the militarization of police. More famously, in 2014, Ferguson police utilized military weapons and tactics to quell the masses after the police shooting of Michael Brown incited protests and riots. Despite an overall decrease in incidents of police use of force and deadly shootings, individual dramatic events of police militarization paint a picture of a militarized police force. This coincides with an overall increase in military equipment transfers (e.g., weapons, vehicles) to police agencies in the United States. …

Catalan Artist Pierre Daura As Exile, Refugee, Naturalized American Citizen, Teresa Gunter May 2020

Catalan Artist Pierre Daura As Exile, Refugee, Naturalized American Citizen, Teresa Gunter

Undergraduate Theses and Capstone Projects

The impetus for this paper began with the following question: where once Daura’s identity had been firmly grounded in his Catalonian origins and within the milieu of international artists in France, did this period of change in his artistic output originate from a grave insecurity in nationality? By examining U.S. immigration policies and Daura’s identity as a refugee, immigrant, and naturalized American citizen, I will establish that a crisis of nationality, complicated by Nation of Origin Quotas and nativist immigration policies, influenced the art of Pierre Daura and coincided with a striking transformation of his style.

How Nondiscrimination Takes Root: An Examination Of Methods To Implement Statewide Nondiscrimination Legislation In Kentucky., Blake Nona Gould

Electronic Theses and Dissertations

This research examined the numerous fairness ordinances in Kentucky’s cities for repeated trends, patterns, and practices in their language. Through the use of a cumulative case study, cases were selected from the ordinances as well as state and federal law, judicial actions, and other relevant factors from within the state. Each of the ordinances were examined for generalizability and their ability to be applied to a single, unified state nondiscrimination law that conforms with existing state and federal law. It was found that significant similarities exist between the various ordinances, though discrepancies would also need to be addressed. In the …

Does The Press Have A Right To Be Wrong?: Fake News, Press Freedom, And Defamation Law In 2021, Nathan T. Danielson

Journalism

The following study analyzes defamation lawsuits filed against Fox News and its on-air personalities by companies that manufactured and maintained voting machines used in the 2020 US presidential election. Smartmatic and Dominion accused Fox in court of broadcasting debunked allegations that the companies had rigged the election against incumbent president (and longtime Fox viewer) Donald Trump. The size of the sought-after damages, and the size of Fox itself, make this the largest “fake news suit” in history. This study explores the merits of the suits, defenses to defamation (particularly opinion, political speech, and retraction) and the potential ramifications of a …

The Mystery Of Law: A Critical Analysis Of H.L.A Hart’S The Concept Of Law, Stephen Mark Gray Ii Apr 2020

The Mystery Of Law: A Critical Analysis Of H.L.A Hart’S The Concept Of Law, Stephen Mark Gray Ii

Honors Theses

This thesis explores the role of morality in law through a critical examination of the work of one of the most widely cited and renowned judicial scholars, H.L.A. Hart. His modified theory of positivism, which denotes that law and morality are separable and that legal rules may have any content, has had an enduring impact on the landscape of judicial thought in the last century. As Hart’s work has had an indelible hand in shaping analytical jurisprudence and as it exemplifies the antithesis of my argument, it will serve as a theoretical foil. From it, I hope to articulate my …

Analyses Of Prosecutorial Power And Discretion In Mississippi: Evaluating Proposals To Address Misconduct And Abuse, Lucy Pruitt Apr 2020

Analyses Of Prosecutorial Power And Discretion In Mississippi: Evaluating Proposals To Address Misconduct And Abuse, Lucy Pruitt

Honors Theses

To do so, the author has summarized and analyzed seven criminal cases in which defendants have become victims of prosecutorial misconduct in order to shed light on the lack of prosecutorial accountability in the state’s criminal justice system. In an attempt to solve the problem, the author has developed a novel grading rubric in order to objectively and systematically analyze and evaluate previously proposed policy recommendations by legal experts and justice organizations. The successes …

Growing Old And Getting Sick Are Dangerous In Prison: A Moral And Legal Argument For “Justice, Not Vengeance”, Jillian Sauer Apr 2020

Growing Old And Getting Sick Are Dangerous In Prison: A Moral And Legal Argument For “Justice, Not Vengeance”, Jillian Sauer

Undergraduate Theses

In 2017 the Kentucky DOC reported that Kentucky prisons housed 2,521 persons categorized as “elderly”. Even though individuals in this population are more susceptible to violence and risk developing age-related illnesses the care of these individuals is not a financial priority for those in power. These individuals occupy a unique position as a marginalized group within a marginalized group, and one which is growing rapidly. As a result, it is necessary to develop a response drawing from Catholic social teaching and criminal justice ethics which addresses the unique problems faced by this population. At the core of this response is …

Does Description Equal Prescription? A Case For Gender Quotas In Latin America, Samuel E. Hobbs Apr 2020

Does Description Equal Prescription? A Case For Gender Quotas In Latin America, Samuel E. Hobbs

Honors College Theses

Extant research demonstrates that gender quotas do increase women’s descriptive representation in national legislatures, including in Latin America (Smith 2016; Mark et al. 2012). However, there has been an evident lack of research conducted to identify the relationship between gender quotas and outcomes of gendered legislation. I argue that gender quotas implemented on the national legislature in Latin America do increase the outcome of gendered legislation. I test my hypothesis by examining the government of Chile to analyze the effects of the augmentation of women in national legislatures. To do so, I use the government’s national legislative database to search …

Retitling Title Ix, Matthew F. Marino Apr 2020

Retitling Title Ix, Matthew F. Marino

Seton Hall University Dissertations and Theses (ETDs)

Title IX, a federal education policy put into place in the early 1970s, has been under the microscope for its perceived failure to protect students from sexual misconduct. Since 2011, and especially since 2017, conflict has existed among higher education, the judicial system, and the Department of Education (ED), resulting in little clarity as to proper Title IX response. However, little research exists that attempts to examine court cases for both commonalities and divergence in how higher education institutions respond to Title IX incidents of sexual misconduct and whether those procedures mesh with how the courts view proper Title IX …

"The Tyranny Of The Majority" A Framework Proposal To Assess The Moral Justification Of Voter Identification Laws In The United States, Sally Jordan

Honors Theses

One of the most fundamental rights of democratic citizens is the right to vote. As a result, voters are entitled to equal opportunity to access the polls. Yet recently, states have begun instituting policies that impact individual access to polls, such as voter identification laws.

Since the 2013 dismantling of the Voting Rights Act, 35 states across the United States implemented voter identification laws varying in strictness and the forms of identification they accept. Numerous studies and articles have been written regarding the justification of these voter identification laws in conjunction with their disproportionate effects on certain minorities; however, many …

The First Step Act Of 2018: One Small Step Toward Social Change, Mary Teresa I. Cuzzupe

Community Engagement Student Work

Throughout history, the United States has toggled between punitive and rehabilitative policies within the criminal justice system, creating social changes that have contributed to racial inequalities within policy and practice that are still being dealt with today. The First Step Act of 2018 (Formerly Incarcerated Reenter Society Transformed, Safely Transitioning Every Person Act) is a federal prison reform attempting to implement rehabilitative social change within a society that is still not ready for it. A cyberattack is a malicious attempt by a state, third party, or individual to disrupt a computer’s network; whereas, a cyber-exploit is an action that uncovers and steals “confidential” information from a computer’s data. 1 Within this research paper, the main adversary of such cyberattacks and/or exploits will be the nation-state. The victims of these cyberattacks will range from multinational corporations, such as Sony, to nuclear programs in Iran. This essay will focus on four motivations behind such cyberattacks: (1) private sector hacking (the theft of intellectual property) (2) …

Mindful Meditation And Misconduct: A Proposal, Victoria Evans Apr 2020

Mindful Meditation And Misconduct: A Proposal, Victoria Evans

Honors Senior Capstone Projects

Rehabilitation and treatment methods used in incarceration have evolved, causing punishment philosophies in the U. S. to swing from rehabilitation to “zero tolerance” and back again. As this transition occurs, it is essential to evaluate current correctional programs as there has been a trend towards evidence-based corrections. The purpose of this research is to evaluate the SAVR (stress, anger, violence reduction) program implemented by a county jail in Massachusetts. This research will examine the extent to which participating in SAVR reduces inmate misconduct. The Revolving Door Of Recidivism, Laura E. Bull Apr 2020

The Revolving Door Of Recidivism, Laura E. Bull

Classical Conversations

With the rise in the use of prisons, recidivism also grew. Recidivism, in the broadest sense, is the act of a past offender coming back into contact with the justice system. Prisons have been used as far back as the fourth century, but over time their purpose has changed. Today in the United States, the main purpose of prisons is rehabilitation. The most recent law, the First Steps Act, reflects the desire to reduce the trend of recidivism. Many programs have been used as a method of reducing recidivism. Recidivism is a cycle of pain, creating jaded prisoners and placing …
