Exploring Outer Space: The Role Of Private Companies, Ankita Joshi Mar 2025

Exploring Outer Space: The Role Of Private Companies, Ankita Joshi

Cardozo International & Comparative Law Review (CICLR) Blog

Over the past two decades, discussions about the future of outer space have often gone hand in hand with the role that private space companies, such as SpaceX, Blue Origin, and Rocket Lab, have had in transforming the space industry. Outer space has quickly developed into a competitive commercial landscape, a contrast to initial space law activity that focused on exploration.[1] With this shift, questions have arisen about whether current international space treaties provide adequate protections for space governance between states and private entities, and the protection of outer space resources.

Health insurance is a type of insurance policy that provides coverage for a predetermined set of medical risks over a specified period. A health insurance policy is an agreement between an insurance provider and an individual, wherein the provider commits to covering pre-determined medical expenses, while the individual pays a fixed monthly premium (which may vary depending on the terms of the agreement). Upon acceptance into this plan, the consumer becomes part of a risk pool, which is further categorized into low-risk and high-risk segments. One’s risk assessment provides information regarding their propensity to need more medical services, and this …

Blake Lively And Justin Baldoni Dispute: It Ends With Arbitration?, Alisha Augustine

Cardozo Journal of Conflict Resolution (CJCR) Blog

The film adaptation of the best-selling novel, “It Ends With Us” depicts a tale of a seemingly romantic relationship turned abusive and how a woman grows beyond her experience with domestic abuse. The film and novel tell the story of Lilly, Blake Lively’s character, falling in love with Ryle, Justin Baldoni’s character, and how their relationship evolves for the worse. Despite the important message that the movie should be known for, it has now been caught in the cross-fire in the impending case between co-stars Blake Lively and Justin Baldoni. In December 2024, Lively filed a complaint against Baldoni claiming …

Market participants are preparing for the tax and trade policies pursued by the second Trump administration. Regarding taxes, proposals include making expiring Tax Cuts and Jobs Act provisions permanent, ending green energy subsidies from the Inflation Reduction Act, and exempting certain income from taxation. Proposed tariffs range from retaliatory measures-in-kind to targeting Chinese market participation to a universal 20% import tariff. On the campaign trail, the President often presented these proposals as part of a shift of financial burdens from domestic taxpayers to foreign companies. In a panel discussion with tax and trade experts, we will seek to determine the …

Mapping State Reactions To The Icc Arrest Warrants For Netanyahu And Gallant, Rebecca Ingber Mar 2025

Mapping State Reactions To The Icc Arrest Warrants For Netanyahu And Gallant, Rebecca Ingber

Online Publications

On Thursday, the International Criminal Court (ICC) announced it had issued arrest warrants for Benjamin Netanyahu, the Prime Minister of Israel, and Yoav Gallant, the former defense minister, in connection with alleged crimes committed in the ongoing armed conflict between Israel and Hamas. In doing so, the Court rejected as premature Israel’s challenge to the Court’s jurisdiction. The Court’s decision to issue a warrant for the sitting Prime Minister of a state, which is notably not a party to the Rome Statute, also demonstrates the Court’s embrace of its prior controversial decision on immunity, namely that customary international law does …

November 19, 2024 marked 1000 days since Russia’s February 2022 invasion of Ukraine.  There is an ongoing debate as to whether the invasion can be classified as a crime of aggression. United Nations General Assembly (UNGA) Resolution 3314 defines aggression as “the use of armed force by a State against the sovereignty, territorial integrity or political independence of another State, or in any other manner inconsistent with the Charter of the United Nations, as set out in this Definition.” Article 3 of this resolution outlines specific acts that constitute acts of aggression per se. Russia's February 2022 invasion of …

Final-Offer Arbitration In Major League Baseball: An Effective Dispute Resolution Process, Jeremy Ahdoot Mar 2025

Final-Offer Arbitration In Major League Baseball: An Effective Dispute Resolution Process, Jeremy Ahdoot

Cardozo Journal of Conflict Resolution (CJCR) Blog

Final-offer arbitration, commonly referred to as “baseball arbitration,” is a process where one or more arbitrators will settle an issue by selecting one of the final offers proposed by disputants. In the 1973-1974 offseason, Major League Baseball (MLB) introduced final-offer arbitration as a mechanism to handle salary disputes between professional baseball players and their teams. To be eligible for salary arbitration, players must have more than three, but less than six, years of service time. One year of service time is completed when a player spends 172 days on a team’s 26-man roster or MLB’s injured list in a given …

In the mid-1840s, American settlers flocked westward on the Oregon Trail, unknowingly bringing with them measles and other foreign diseases to which the Cayuse peoples along the trail had no immunity. Hundreds of Cayuse children were brought to Narcissa and Marcus Whitman at the Whitman Mission for treatment, but ultimately these children could not be saved. In 1847, members of the Cayuse Tribe, acting under Cayuse law to dispose of false doctors (medicine men, or tewat), participated in an attack on the Presbyterian Whitman Mission in Walla Walla Washington, killing the Whitmans and eleven others. After a two-year pursuit, the …

A Shelter From Litigation: How Mediation Helped Preserve The Core Of New York City’S Right To Shelter, Jared J. Jackson

Cardozo Journal of Conflict Resolution (CJCR) Blog

In 1979, a class action lawsuit was brought against New York City by a coalition of homeless individuals. After almost two years of negotiations, the parties of this suit, called Callahan v. Carey, entered into a consent decree, which provided that the City and State of New York would “provide shelter and board to all homeless men who met the need standard for welfare or who were homeless ‘by reason of physical, mental, or social dysfunction.’”

The print edition of the issue has also been released. This post was originally published on the Cardozo Journal of Conflict Resolution website on …

Regulating Hidden Ai Authorship, Jacob Noti-Victor

With the rapid emergence of high-quality generative artificial intelligence (“AI”), some have advocated for mandatory disclosure when the technology is used to generate new text, images, or video. But the precise harms posed by nontransparent uses of generative AI have not been fully explored. While the use of the technology to produce material that masquerades as factual (“deepfakes”) is clearly deceptive, this Article focuses on a more ambiguous area: the consumer’s interest in knowing whether works of art or entertainment were created using generative AI. In the markets for creative content—fine art, books, movies, television, music, and the like—producers have …

Is The Housing Access Voucher Program The Solution To New York’S Affordable Housing Crisis?, Ushna Khan

Cardozo Journal of Equal Rights and Social Justice (ERSJ) Blog

New York City’s affordable housing crisis has reached an alarming state, with nearly half of renters spending more than thirty percent of their annual income on rent, and eviction filings surpassing pre-COVID pandemic levels.  The rising eviction rate continues to disproportionately impact low-income and marginalized communities.  The longstanding impact of antiquated, restrictive zoning policies, underinvestment in affordable housing, and mounting construction costs have compounded the housing crisis into a “state of emergency” in New York.

From High Hopes To Hesitation: What Rfk Jr.’S Senate Confirmation Hearings Say About His Current Stance On Marijuana Reform, Andrew Greenberg

Cardozo Journal of Equal Rights and Social Justice (ERSJ) Blog

Recently, Robert F. Kennedy (“RFK”) Jr.’s nomination for secretary of the Department of Health and Human Services (“HHS”) was confirmed by the Senate, and he will soon become the leader of America’s largest health agency.  While some of his controversial claims include his “refusal to embrace science that shows vaccines do not cause autism” and “denials of the efficacy of vaccines” in general, he has also advocated for the federal decriminalization of marijuana.  However, his more recent declarations and the government forces at play mean this decriminalization will not likely come to fruition.

Early Neutral Evaluation: Flawed Foundations In Statistical Predictions, Jacqueline Kitzes

Cardozo Journal of Conflict Resolution (CJCR) Blog

Early Neutral Evaluation (ENE) is a form of Alternative Dispute Resolution (ADR) designed to help parties resolve disputes more efficiently. It is an increasingly popular method encouraged by courts and private providers alike. ENE involves a neutral third party, often an experienced attorney or retired judge, who assesses the strengths and weaknesses of each party’s case early in the dispute. The primary goal is to encourage parties to focus on the strengths and weaknesses of their cases and their opponent’s early in the litigation process, potentially avoiding unnecessary pre-trial expenses. ENE aims to facilitate a more informed negotiation process and …

For all of the ink that has been spilled over the Supreme Court in recent years, no one has been able to bridge the growing divide between those who think we should bury the Court and those who think we should praise it. Meanwhile, public faith in the Court continues to decline. This reality raises significant legal and policy questions regarding workers’ rights and protections for gig workers. This blog post compares the United States’ treatment of gig workers with Australia’s, analyzing the positives and negatives of each system and evaluating whether the U.S. should adopt an alternative model.

Seven days into the 2025 new year, the most expensive natural disaster in United States history broke out. 29 people were killed, and at least 16,000 structures were destroyed. Damages estimations have been varied. One analyst firm reasoned the fires could cost as much as $35 billion[3], another thought $45 billion, and the University of Southern California thinks $75 billion. Among the hardest hit neighborhoods was Altadena, California. Northwest Altadena stood as one of the few areas black families could purchase homes in Southern California, as “81% of Black households in Altadena own homes, compared with 32% across Los Angeles …
