Kendra’S Law: The Troubling Reality Of Involuntary Assisted Outpatient Psychiatric Treatment In New York, Matt Donelian
Kendra’S Law: The Troubling Reality Of Involuntary Assisted Outpatient Psychiatric Treatment In New York, Matt Donelian
Cardozo Journal of Equal Rights and Social Justice (ERSJ) Blog
Mental health disorders are among the most formidable public health issues facing our world today. In New York, roughly one in ten individuals battles mental health issues severe enough to impede their functionality in critical domains of life such as work, education, and family. The journey to accessing essential mental health care is fraught with obstacles, including symptom-induced recognition barriers, societal stigmatization, and economic constraints—leading to a care paradigm that is both costly and exclusionary. Alarmingly, even the availability of care does not guarantee engagement as many individuals in need refuse to seek treatment.

The Insidious War Powers Status Quo, Rebecca Ingber
Articles
This Essay highlights two features of modern war powers that hide from public view decisions that take the country to war: the executive branch’s exploitation of interpretive ambiguity to defend unilateral presidential authority, and its dispersal of the power to use force to the outer limbs of the bureaucracy.

The Consequences Of Nba Commissioner Adam Silver Arbitrating The Dispute Between The New York Knicks And The Toronto Raptors, Jane Perov
Cardozo Journal of Conflict Resolution (CJCR) Blog
Back in August 2023, the New York Knicks sent a letter addressed to the owner of the Toronto Raptors Larry Tanenbaum claiming the Raptors are engaging in illegal activity involving a former Knicks employee whom they just hired. They claimed that Ikechukwu Azotam, who at the time of his employment with the Knicks was an assistant video coordinator, “had illegally provided the Raptors with more than 3,000 confidential files.” Several days after the letter was sent the Knicks filed a lawsuit in the U.S. Southern District Court of New York against Maple Leaf Sports & Entertainment (Toronto Raptors), Darko Rajakavic, …

Navigating Divorce After Domestic Violence: The Benefits Of Adr, Anna Glasgow
Cardozo Journal of Conflict Resolution (CJCR) Blog
Navigating the complexities of divorce is challenging in any circumstance, but for survivors of domestic violence, the process of legal separation can be particularly intimidating. Most people think of domestic violence as the act of physical abuse, however, domestic violence can be described as any action or pattern that affects a spouse’s health and safety. It is estimated that one out of every five marriages, or 20% of marriages in the US involve domestic violence. It can be very hard for individuals who are victims of domestic abuse to want to get divorced. There is often fear that the abusing …

The British Parliament is in the process of voting on the Safety of Rwanda (Asylum and Immigration) Bill, that would send asylum seekers who arrive in Britain to Rwanda, a country in East Africa. This change would indicate a further distancing of the United Kingdom (UK) from the European Union (EU) and international law. That said, when viewed in the context of the UK’s support for Ukraine, one can instead see an evolving view of individual national sovereignty.

California Court Supports The End Of Free Passes In Sexual Harassment Claims, Emily Hall
California Court Supports The End Of Free Passes In Sexual Harassment Claims, Emily Hall
Cardozo Journal of Equal Rights and Social Justice (ERSJ) Blog
In response to the #MeToo movement, California took significant legislative steps in 2018 to address sexual harassment within the state. Specifically, the legislature passed Senate Bill No. 1300, which amended California’s Fair Housing and Employment Act to declare the state’s “intent with regard to application of the laws about harassment.” One particular enactment, § 12923, signified a concerted effort by California lawmakers to address the pervasive issue of workplace harassment and underscored the state's commitment to fostering environments free from harassment and discrimination. By explicitly declaring the legislative intent concerning the interpretation and enforcement of anti-harassment laws, the statute sought …

The Oregon Drug Battle: Is Measure 110 Making A Difference?, Olivia Cohen
Cardozo Journal of Equal Rights and Social Justice (ERSJ) Blog
The Oregon Drug Addiction Treatment and Recovery Act, also known as Measure 110, was passed in November 2020 to address Oregon’s addiction and overdose problem. Measure 110 was designed to implement a more humane approach to handling drug addiction. While drug possession is typically charged as a misdemeanor, Oregon’s new law reduces the charge to a civil infraction. When the police observe an individual with a small amount of drugs, a citation and $100 fine is issued instead of an arrest. This fine can then be waived if the individual calls a support line and completes a “social service needs …
Arbitration's Unraveling, Myriam E. Gilles
Arbitration's Unraveling, Myriam E. Gilles
Articles
It has been over a decade since the Supreme Court declared that the Federal Arbitration Act preempts state-law policies that stand as an obstacle to enforcement of the class-banning arbitration clauses that companies tuck into standard-form contracts. In that time, plaintiffs’ lawyers have tried challenging class action–banning arbitration provisions on myriad legal grounds, as well as pressing for federal and state legislation to undo the Court’s ruling in AT&T Mobility LLC v. Concepcion. Neither strategy has borne much fruit—until now. In the past few years, congressional action has exempted specific categories of cases from mandatory arbitration, suggesting that an area-by-area …

How Adr Can Combat The Rise In Antisemitism And Islamophobia On College Campuses, Cynthia Spitzer
Cardozo Journal of Conflict Resolution (CJCR) Blog
Since the October 7, 2023 massacre in Israel by the terrorist organization Hamas, there has been ongoing strife and protests throughout the world. Such turmoil notably coincides with a rise in hate crimes, antisemitism, and islamophobia, noticed not only on the streets of the United States, thousands of miles away from Israel, but also in the microcosm of college campuses.
