From Conflict To Resolution: The Advantages Of Mediation In Estate Planning, Sarah Natanov
From Conflict To Resolution: The Advantages Of Mediation In Estate Planning, Sarah Natanov
Cardozo Journal of Conflict Resolution (CJCR) Blog
Estate planning involves advanced planning for managing and distributing one’s assets following their passing. It entails identifying inheritors among individuals or entities and establishing measures to ensure the seamless execution of these wishes, aiming to minimize future complications. Estate planning documents often used to distribute assets after one’s passing are wills, trusts, and other legal documents. While these documents may serve as a roadmap for asset distribution, they may not invariably preclude disputes or conflicts among beneficiaries or family members.

Is The Future Private? A Look Into Litigation Under Illinois’S “Bipa” Law, Paige Green
Cardozo Arts & Entertainment Law Journal (AELJ) Blog
At Meta’s 2019 “F8” virtual development conference, Mark Zuckerberg stood in front of a presentation screen displaying the words, “the future is private.” Zuckerberg’s talking points centered on “build[ing] a more privacy-focused social media platform.” Increasing Meta’s focus on privacy, apparently, does not include ensuring compliance with Illinois’s Biometric Information Privacy Act (“BIPA”). While not exactly the first of its kind, a recent class action lawsuit against Meta alleges the company violated Illinois’s BIPA law by capturing, retaining, and profiting from the use of plaintiff’s “voiceprint” without disclosing or creating a meaningful retention policy for doing so.

Are Frozen Embryos People Too? Unpacking The Alabama Supreme Court’S Controversial Ivf Ruling, Arielle Fetman
Cardozo Journal of Equal Rights and Social Justice (ERSJ) Blog
In a landmark decision, the Alabama Supreme Court recently ruled that frozen embryos created for in vitro fertilization (IVF) purposes qualify as embryos under the state’s anti-abortion laws. This ruling has profound implications for reproductive rights, reinvigorating discussion on the legal status of embryos. The cases at the center of this ruling involved three couples who brought wrongful death suits upon the accidental destruction of their frozen embryos at a fertility clinic. The court’s decision to classify these embryos as minor children, allowing parents to sue for their deaths, highlights the evolving legal landscape surrounding reproductive technologies.

Dissociative Identity Disorder And Mediation: Exploring Legal Capacity, Bayla Zohn
Cardozo Journal of Conflict Resolution (CJCR) Blog
Dissociative Identity Disorder (“DID”) is a mental disorder where the affected individual has two or more distinct personalities. As a protection strategy against severe, persistent abuse and trauma, DID develops in childhood and lasts the entirety of the person's life. A crucial aspect of DID is "dissociation," which is defined as a defense mechanism in which threatening ideas and feelings are separated from the rest of the psyche and conflicted impulses are kept apart. Dissociation refers to the disconnection from one’s environment, emotions, memories, and thoughts. The child's neuronal sense of self-identity is still developing at the time of this …

In the early 2010s, the term “fandom” gained popularity among teenagers who were deeply devoted to their favorite musicians. The term “fandom” refers to communities of fans who come together through social media to express their shared admiration for a particular artist. When individuals unite to celebrate their mutual love for a musician, a genuine sense of connection and community is established. Through discussions about their shared passion for the artist, they often discover common interests and experiences that go beyond the music, fostering authentic friendships.

Tik Tok And Universal Music Group’S Licensing Battle, Sara Casey
Cardozo Arts & Entertainment Law Journal (AELJ) Blog
A month-long standoff between Universal Music Group (“UMG”) and TikTok persists after combative licensing negotiations have continuously failed. This stalemate led to the removal of UMG’s music from the platform on February 1, 2024, silencing thousands of videos featuring UMG’s music and, in turn, drastically reducing content creators’ music options for new clips. The effects of the broken partnership have materialized, but the extent of the fallout is unclear, as some videos using UMG recordings appeared to be unaffected, while others, such as those featuring tracks by UMG artists Taylor Swift and Drake, have been silenced, accompanied by the statement …

The Supreme Court Has Granted Review For Arbitration Stays In Employment Cases: Smith V. Spizzirri, Sarah Cole

The Supreme Court has granted review to address a circuit split on whether cases should be paused or thrown out after they are moved to arbitration. The courts are split six to four, four allowing lawsuits to be dismissed when underlying allegations must go through mandatory arbitration. The case is from the Ninth Circuit, on the allowance side of the split, Smith v. Spizzirri, with the petition granted 1/12/24. It addresses the language in a section of the Federal Arbitration Act (“FAA”). The section of the Act under review states: “If any suit or proceeding be brought in any of …

The Future Of Transnational Surrogacy: Where Do Italy And The Uk Stand Now?, Elleme Ko
Cardozo International & Comparative Law Review (CICLR) Blog
The images of thousands of abandoned babies around the world gave the transnational commercial surrogacy market a global spotlight in 2020 when COVID-19 travel bans hit. As borders closed, intended parents or “fertility tourists” were unable to claim newborns born to surrogate mothers in Russia, Ukraine, the United States, and elsewhere. Babies were left for months in hospitals, orphanages, or in the hands of surrogacy agencies. “‘The image’—of the [commercial surrogacy] industry— ‘was really bad.’” Much attention has been paid to the effects of abortion regulation and access to contraception on women’s reproductive freedom. However, the politics of pregnancy through …

The American Arbitration Association (“AAA”) has joined a long line of various organizations that are looking to make use of, and integrate artificial intelligence (“AI”) into their processes. The AAA has launched innovation programs that are lending support to the idea of AI integration into arbitration, mediation, and other Alternative Dispute Resolution (“ADR”) methods.
