Explanation In Legal Scholarship: The Inferential Structure Of Doctrinal Analysis, W. Bradley Wendel
Explanation In Legal Scholarship: The Inferential Structure Of Doctrinal Analysis, W. Bradley Wendel
Cornell Law Faculty Publications
This paper aims to understand the logic that underlies a familiar type of legal scholarship, in which the author purports to explain or render intelligible some legal doctrine or area of law in terms of an end or rationale. Loosely speaking, the argument is that some doctrine is "all about" some end. This form of argument is familiar but undertheorized, so this paper draws from the philosophy of science, particularly the notion of inference to the best explanation (IBE), to clarify the underlying rhetorical strategy of doctrinal legal scholarship. One way of making IBE arguments with reference to legal doctrine …
United Nations Peacekeeping Operations And Security And Reconstruction, Muna Ndulo
United Nations Peacekeeping Operations And Security And Reconstruction, Muna Ndulo
Cornell Law Faculty Publications
Several studies show that despite recent increases in the number of minor conflicts, long-term trends suggest that international and civil wars are declining. Analyzing the causes of the improvement in global security since 1990, the 2006 Human Security Report argues that the United Nations played a critically important role in spearheading a huge upsurge of international conflict prevention, peacekeeping and peacebuilding activities. Although the number of wars has decreased, far too many remain — and there are still several places of instability around the globe that could easily turn into conflict areas. In August 2000, a famous UN report, the …
Fannie Mae, Freddie Mac, And The Future Of Federal Housing Finance Policy: A Study Of Regulatory Privilege, David J. Reiss
Fannie Mae, Freddie Mac, And The Future Of Federal Housing Finance Policy: A Study Of Regulatory Privilege, David J. Reiss
Cornell Law Faculty Publications
The federal government recently placed Fannie Mae and Freddie Mac, the government-chartered, privately owned mortgage finance companies, in conservatorship. These two massive companies are profit-driven, but as government-sponsored enterprises they also have a government-mandated mission to provide liquidity and stability to the United States mortgage market and to achieve certain affordable housing goals. How the two companies should exit their conservatorship has implications that reach throughout the global financial markets and are of key importance to the future of American housing finance policy.
While the American taxpayer will be required to fund a bailout of the two companies that will …
Jurisprudence Of A Fledgling Federation: A Critical Analysis Of Pakistan’S Judicial View On Federalism, Umer Akram Chaudhry
Jurisprudence Of A Fledgling Federation: A Critical Analysis Of Pakistan’S Judicial View On Federalism, Umer Akram Chaudhry
Cornell Law School Inter-University Graduate Student Conference Papers
Although the impediments in development of federation in Pakistan can be explored from different facets, this paper aims to critically analyze the constitutional history and judicial interpretation of federalism in Pakistan against the scholarly and conceptual debates over the idea. The paper argues that Pakistan’s judiciary, despite recognizing federalism as cornerstone of the Constitution, has not upheld the principle as strongly as other salient features of the Constitution. The superior judiciary has strengthened the official discourse of a unitary national identity leaving little room for ethnical pluralism and participatory nationalism. The paper shall also review measures introduced by the recent …
Biases In Domestic Violence Criminal Decision Making: Are System Actors Lenient In Domestic Violence Cases?, Silvana Del Valle
Biases In Domestic Violence Criminal Decision Making: Are System Actors Lenient In Domestic Violence Cases?, Silvana Del Valle
Cornell Law School Inter-University Graduate Student Conference Papers
This essay makes a review of studies about the presence of biases against victims in the Judicial Decisionmaking of Domestic Violence (DV) crimes. The global recognition of the phenomenon has promoted a legal reform movement, in which the United States has been part. The first reform in the topic in the US was the Violence Against Women Act (VAWA) of 1991. This federal statute detected biases not only in the judges, but also in other criminal prosecution actors -police departments and prosecutors. Then, it introduced research funds and legal tools to fight against biases, under the premise that DV is …
Sks Microfinance And For-Profit Mfis, Unscrupulous Predators Or Political Prey? Examining The Microfinance Credit Crunch In Andhra Pradesh And Assessing The Applicability Of The Un Global Compact "Protect Respect Remedy" Framework, Ashley Feasley
Cornell Law School Inter-University Graduate Student Conference Papers
Microfinance is the practice of originating small loans and capital infusions in developing countries to poor individual families and small businesses that are outside traditional banks. Today microfinance has grown into a multi-billion dollar industry that has stakeholders in the financial services industry, private international organizations (including non-governmental organizations ("NGOs")) and global politics. The successful initial public offering ("IPO") of SKS Microfinance, ("SKS") a for-profit microfinance institution ("MFI") in August 2010 marked the pinnacle of success for the theory that for-profit MFIs could eradicate poverty while simultaneously making a huge profit through microfinance. The extremely successful SKS IPO bolstered the …
Rewiring Old Architecture: Why U.S. Courts Have Been So Slow And Uneven In Their Take-Up Of Digital Technology, Peter W. Martin
Rewiring Old Architecture: Why U.S. Courts Have Been So Slow And Uneven In Their Take-Up Of Digital Technology, Peter W. Martin
Cornell Law Faculty Working Papers
Given the centrality of information and communication to the activities and institutions of law and government it is not surprising that during the early turbulent days of the digital revolution enthusiasts imagined that the new technology would work dramatic changes on this critical sphere, changes far greater in magnitude than those flowing from such past innovations as calculators, tape recorders, or copy machines. Students of government and consultants drew analogies between transformations taking place in the private sector (the emergence of e-commerce and distributed, virtual enterprises) and what governments might or should or would become (e-government). Greater efficiency, improved accessibility …
Name Calling On The Internet: The Problems Faced By Victims Of Defamatory Content In Cyberspace, Sarudzai Chitsa
Name Calling On The Internet: The Problems Faced By Victims Of Defamatory Content In Cyberspace, Sarudzai Chitsa
Cornell Law School Inter-University Graduate Student Conference Papers
In the past decade or so, internet libel has become one of the hot topics in internet law. Internationally, courts have dealt with an enormous amount of cases brought by both the suppliers and consumers of the internet services. Although the advent of the World Wide Web has come with many legal problems; this paper will only focus at the problems that are being faced by the victims of defamatory speech on the internet in trying to seek compensation through the courts. These problems include, inter alia, the reluctance of the courts in unmasking the identity of the authors of …

In Light Of Oklahoma Sq 755: How Islamic Law Antecedes In Solving Minorities’ Personal Law Issues?, Mansour A. Alhaidary
Cornell Law School Inter-University Graduate Student Conference Papers
In November 2010, a proposal was passed to amend Section 1 of Article VII of the Oklahoma State Constitution to prevent considering Sharia Law in making judicial decisions as well as international law. This amendment is being challenged in the court by Muslims and a temporary restraining order has been granted. In this paper, I will show, in contrast to what Oklahoma legislators wanted to enact, how Islamic law of 1400 years ago provided freedom of application of personal law for religious minorities more than any other legal system. Although other legal systems provide one type of freedom or another, …
The China Currency Issue: Why The World Trade Organization Would Fail To Provide The United States With An Effective Remedy, Marcus Sohlberg
The China Currency Issue: Why The World Trade Organization Would Fail To Provide The United States With An Effective Remedy, Marcus Sohlberg
Cornell Law School Inter-University Graduate Student Conference Papers
A critical issue in the global trading system that came to the forefront in 2010 concerns exchange rates. Having suffered to various degrees through the worst economic and financial downturn since the Great Depression, many large trading nations have sought to achieve economic recovery through export-led growth. In order to boost international competitiveness, many have engaged in competitive devaluations, i.e. interventions in currency markets to devalue domestic currency. According to Brazilian Finance Minister Guido Mantega this situation has escalated into a “global currency war”.
This paper focuses on China’s practice of maintaining an artificially undervalued currency, and addresses the question …
Rebalancing Oil Contracts In Venezuela, Julián Cárdenas García
Rebalancing Oil Contracts In Venezuela, Julián Cárdenas García
Cornell Law School Inter-University Graduate Student Conference Papers
During the last decade, the Venezuelan government has pursued a reform of the legal regime of hydrocarbons tailored to its interests as an oil producing country. However, the ongoing consequences of the global economic recession which negatively impacted the Venezuelan economy, call into question the suitability of such scheme. Confronting the challenge of attracting foreign investment, the methods of awarding contracts used by the Venezuelan Government have contributed to the approval of a series of incentives which are rebalancing the contractual conditions for new oil ventures. Royalty and tax reductions, access to international arbitration and the protection granted through bilateral …

From Control To Communication: Science, Philosophy, And World Trade Law, Sungjoon Cho
Cornell International Law Journal
Recently, science has become increasingly salient in various fields of international law. In particular, the World Trade Organization (WTO) Sanitary and Phytosanitary (SPS) Agreement stipulates that a regulating state must provide scientific justification for its food safety measures. Paradoxically, however, this ostensibly neutral reference to science often complicates treaty interpretation. It tends to take treaty interpretation beyond the conventional methodology provided by the Vienna Convention on the Law of Treaties, which is primarily concerned with clarifying and articulating the text of treaties. The two decades old transatlantic trade dispute over the safety of hormone-treated beef is a case in point. …

Water Pollution And Regulatory Cooperation In China, Hong Lan, Michael A. Livermore, Craig A. Wenner
Water Pollution And Regulatory Cooperation In China, Hong Lan, Michael A. Livermore, Craig A. Wenner
Cornell International Law Journal
Government authority in China, while constitutionally organized as a unitary sovereign, is, in practice, a complex system of informal and formal divisions of authority between national, provincial, and local political actors. In the context of water pollution control, an issue of considerable interest in China, both central and subnational authorities have key roles. The incentives faced by some officials, however, are ill-aligned with environmental protection, predictably leading to inefficiently high levels of pollution. Recent changes in China's water pollution regime have the potential to create a more successful cooperative arrangement between the national and subnational governments. These reforms impose stronger …

Bubbles, Busts, And Blame, Robert C. Hockett
Bubbles, Busts, And Blame, Robert C. Hockett
Cornell Law Faculty Publications
I argue that financial asset price bubbles and busts, such as those we have recently experienced in the mortgage and securities markets, are compatible with market efficiency, individual rationality, and even ethically unobjectionable behavior. The reason is that they constitute classic recursively self-amplifying collective action problems, the hallmark of which is the efficient aggregation of individually rational behaviors into collectively calamitous outcomes. In the present case, individuals rationally "legged the spread" between cheap borrowing costs and credit-fueled capital gains rates, neither of which market actors could affect in their individual capacities even when knowing that credit would have eventually to …
The Volcker Rule And Evolving Financial Markets, Charles K. Whitehead
The Volcker Rule And Evolving Financial Markets, Charles K. Whitehead
Cornell Law Faculty Publications
The Volcker Rule prohibits proprietary trading by banking entities - in effect, reintroducing to the financial markets a substantial portion of the Glass-Steagall Act’s static divide between banks and securities firms. This Article argues that the Glass-Steagall model is a fixture of the past - a financial Maginot Line within an evolving financial system. To be effective, new financial regulation must reflect new relationships in the marketplace. For the Volcker Rule, those relationships include a growing reliance by banks on new market participants to conduct traditional banking functions.
Proprietary trading has moved to less-regulated businesses, in many cases, to hedge …
Synecdoche, Gerald Torres
Synecdoche, Gerald Torres
Cornell Law Faculty Publications
This article suggests that the ideas of synecdoche and metonymy are not just figures of speech in which the part stands in for the whole. They are potentially useful metaphoric devices to understand the politics of institutional change through the inclusion of the formerly excluded.
Capture: here the hazard is that those who find themselves in a position to use institutional power may find themselves subject to pressure to conform to the norms and values of those who have traditionally benefitted from the conventional use of that institution's authority. This will often be subtle and it may merely be a …
First-Class Objects, James Grimmelmann
First-Class Objects, James Grimmelmann
Cornell Law Faculty Publications
What is the difference between "James Grimmelmann" and "@grimmelm" and why should we care? Some computer systems, like Facebook and credit reporting agencies, are inherently "about" people. Others are not. This essay argues that the key technical difference is whether they use unique identifiers to refer to people in their databases. From this single distinction, a host of social and humanistic consequences follow. The essay taxonomizes them and teases out some of their implications for privacy law.
Regulating Financial Innovation: A More Principles-Based Proposal?, Dan Awrey
Regulating Financial Innovation: A More Principles-Based Proposal?, Dan Awrey
Cornell Law Faculty Publications
Modem financial markets are characterized by complexity, seemingly perpetual innovation, chronic asymmetries of information and expertise, and pervasive agency costs. Perhaps nowhere are these characteristics-or their attendant regulatory challenges-more pronounced than within OTC derivatives markets. Mounting effective responses to these challenges must be considered amongst the most difficult and important tasks confronting financial regulators. Prescriptive, rules-based approaches toward financial regulation have thus far proven inadequate to this task. Through the utilization of outcome-oriented principles, enhanced dialogic relationships, intensive supervision, and targeted and proportional (yet vigorous) enforcement, "more principles-based" financial regulation (MPBR) manifests the potential to overcome these challenges and, in …

Sequencing The Issues For Judicial Decisionmaking: Limitations From Jurisdictional Primacy And Intrasuit Preclusion, Kevin M. Clermont
Sequencing The Issues For Judicial Decisionmaking: Limitations From Jurisdictional Primacy And Intrasuit Preclusion, Kevin M. Clermont
Cornell Law Faculty Publications
This Article treats the order of decision on multiple issues in a single case. That order can be very important, with a lot at stake for the court, society, and parties. Generally speaking, although the parties can control which issues they put before a judge, the judge gets to choose the decisional sequence in light of those various interests.
The law sees fit to put few limits on the judge's power to sequence. The few limits are, in fact, quite narrow in application, and even narrower if properly understood. The Steel Co.-Ruhrgas rule generally requires a federal court to decide …
Derivatives And The Legal Origin Of The 2008 Credit Crisis, Lynn A. Stout
Derivatives And The Legal Origin Of The 2008 Credit Crisis, Lynn A. Stout
Cornell Law Faculty Publications
Experts still debate what caused the credit crisis of 2008. This Article argues that dubious honor belongs, first and foremost, to a little-known statute called the Commodities Futures Modernization Act of 2000 (CFMA). Put simply, the credit crisis was not primarily due to changes in the markets; it was due to changes in the law. In particular, the crisis was the direct and foreseeable (and in fact foreseen by the author and others) consequence of the CFMA’s sudden and wholesale removal of centuries-old legal constraints on speculative trading in over-the-counter (OTC) derivatives.
Derivative contracts are probabilistic bets on future events. …
Forgetting Oblivion: The Demise Of The Legislative Pardon, Bernadette A. Meyler
Forgetting Oblivion: The Demise Of The Legislative Pardon, Bernadette A. Meyler
Cornell Law Faculty Working Papers
Since the post-Civil War cases arising out of conflicts over the proper location of the amnesty power, it has generally been thought that pardon and amnesty are synonymous and that the capacity to effect both is vested in the President under Article II. The history of the English version of amnesty—oblivion—within the seventeenth and eighteenth centuries and the colonial and state oblivions that were legislatively enacted from 1650 through the period of the Second Continental Congress suggest otherwise. Oblivion was distinct from pardoning because it erased the underlying events rather than remitting punishment and often arose as a response to …
The Dodd-Frank Act: A New Deal For A New Age?, Saule T. Omarova
The Dodd-Frank Act: A New Deal For A New Age?, Saule T. Omarova
Cornell Law Faculty Publications
This short essay is an attempt to present a few early "big picture" observations on the broad regulatory philosophy underlying the Dodd-Frank Act. The question raised here is whether the Dodd-Frank Act, in fact, provides a blueprint for the twenty-first-century version of the New Deal - a qualitatively new approach to resolving the regulatory challenges posed by today's financial markets. Answering this complex question in full is hardly possible at this stage in the process, when many critical details of the new legal and regulatory regime are yet to be determined. Nevertheless, it is worthwhile to reflect upon some of …
The Limits Of Eu Hedge Fund Regulation, Dan Awrey
The Limits Of Eu Hedge Fund Regulation, Dan Awrey
Cornell Law Faculty Publications
This article examines the mechanics of the recently adopted EU Alternative Investment Fund Managers Directive. On balance, the results of this examination are not encouraging. The EU has failed to mount a persuasive case for why the Directive represents an improvement over existing national regulatory regimes or prevailing market practices in several key areas. Furthermore, by attempting to shoehorn an economically, strategically and operationally diverse population of financial institutions into a single, artificial class of regulated actors, the EU has established what is in many respects a conceptually muddled regulatory regime. Most importantly, however, the Directive's approach toward the amelioration …
Three Concepts Of Roles, W. Bradley Wendel
Three Concepts Of Roles, W. Bradley Wendel
Cornell Law Faculty Publications
One of the many themes in the work of Fred Zacharias was the question of the moral status of role obligations or how roles should be moralized. This paper, written for an issue of the San Diego Law Review dedicated to the memory of Professor Zacharias, explores three alternative ways of conceiving of the relationship between morality and role obligations: strong role differentiation, which posits that roles can change the normative situation of actors; what I call the nexus view, which holds that roles are merely a shorthand for the intersection of existing ordinary moral obligations; and the concept of …
